Imam al-Shafi'i (may Allah have mercy on him) said: "Allah, the Blessed and Exalted, says: 'But whoever gives it (the retaliation) up as charity (pardons it), it will be an expiation for him.' [Surah al-Ma'idah: 45]"

Sayyiduna Abdullah (may Allah be pleased with him) said regarding "But whoever gives it up as charity, it will be an expiation for him" [Surah al-Ma'idah: 45]: This is for the one who was wounded.

Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said regarding this saying of Allah Almighty, "whoever gives it up as charity, it will be an expiation for him" [Surah al-Ma'idah: 45]: That is, sins of his equal to it are removed from him. Imam al-Shafi'i (may Allah have mercy on him) said: It is narrated from the Messenger of Allah (peace and blessings be upon him) concerning pardoning retaliation that "it becomes an expiation," or he said that "there is encouragement in it to pardon retaliation."

Ata bin Abi Maymunah (may Allah have mercy on him) said: I know it only from Sayyiduna Anas (may Allah be pleased with him) that whenever a case of retaliation was brought to him (peace and blessings be upon him), he advised pardon in it. He said: I said to Affan (may Allah have mercy on him): "Who has doubt about it?" He said: Abdullah (may Allah have mercy on him) said: "I used to say 'from Anas (may Allah be pleased with him)'," and they said: "Do not doubt about it." I said: "I do not know it." And he was a very intelligent and astute man.

Alqamah bin Wa'il (may Allah have mercy on him) said that his father (Wa'il bin Hujr, may Allah be pleased with him) told him that he was sitting with the Prophet (peace and blessings be upon him) when a man came seeking retaliation from another, and he said: O Messenger of Allah, this man killed my brother. The Messenger of Allah (peace and blessings be upon him) said: "Did you kill him?" He said: If he does not confess, I will establish witnesses against him. He (the accused) said: Yes. He (peace and blessings be upon him) asked: "How did you kill him?" He replied: We were both beating leaves down from a tree when he insulted me; I became angry, struck him on the head with an axe, and he died. So he (peace and blessings be upon him) said: "Do you have anything to pay as blood money?" He said: This cloak of mine. He said: "What do you think, will your people buy you (pay the ransom for you)?" He said: I am even more worthless than that to my people. He (peace and blessings be upon him) placed the man's strap in that man's hand and said: "Take him and take your retaliation." He took hold of him and went off, and he (peace and blessings be upon him) said: "If he kills him, he will be like him." A man from the people met him and conveyed to him the words of the Prophet (peace and blessings be upon him). That man came back to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah, I took him by your command, and now I have learned this saying of yours. He said: "Yes; do you not want him to bear your sin and the sin of your brother?" He said: Of course, O Prophet of Allah! He said: "Then that is how it will be." So the man let him go.

Alqamah bin Wa'il narrates from his father that a man was brought to the Prophet (peace and blessings be upon him) so that retaliation might be taken from him; there was a strap around his neck by which he was being dragged. When they had gone, he (peace and blessings be upon him) said: "The killer and the killed are both in Hell." A man then met that man and told him what the Prophet (peace and blessings be upon him) had said, so he let him go. Isma'il said: I mentioned this to Habib bin Abi Thabit. He replied: Ibn Ashwa' told me that the Prophet (peace and blessings be upon him) asked him: "Do you pardon?" and he had refused.
And Abu Awanah narrated it from Isma'il, who said: I mentioned it to Ibn Ashwa', and Ibn Ashwa' said: I mentioned this to Habib, and he said that the Prophet (peace and blessings be upon him) had ordered him to pardon.
Sa'id bin Jubayr (may Allah have mercy on him) narrated from the Prophet (peace and blessings be upon him) in mursal form that the man said: O Messenger of Allah (peace and blessings be upon him)! He killed my brother, so he is in Hell; if I kill him, will I be like him? He (peace and blessings be upon him) said: "He killed your brother, so he is of the people of Hell; and if you disobey my command, you too will go to Hell."
And one view is that he said this because the killer had said: By Allah, I did not intend to kill him. And in the hadith of Sayyiduna Abu Hurayrah (may Allah be pleased with him) it is: If he is truthful and you kill him while knowing that he is truthful, you will become like him.

Abu al-Safar (may Allah have mercy on him) said: A man of Quraysh broke the tooth of a man of the Ansar. He went to Sayyiduna Mu'awiyah (may Allah be pleased with him), and the Ansari said: This man broke my tooth. Sayyiduna Mu'awiyah (may Allah be pleased with him) said: Not at all; we will satisfy you. The Ansari kept pressing Sayyiduna Mu'awiyah (may Allah be pleased with him) and persisted until he wearied him, so he said: Do as you wish with your man. Then Sayyiduna Abu al-Darda (may Allah be pleased with him), who was sitting with Sayyiduna Mu'awiyah (may Allah be pleased with him), said: I heard the Messenger of Allah (peace and blessings be upon him) say: "There is no Muslim who suffers any bodily injury and forgoes it as charity except that Allah Almighty raises him a degree by it and erases a sin from him."
The Ansari said to Sayyiduna Abu al-Darda (may Allah be pleased with him): Did you yourself hear this from the Prophet (peace and blessings be upon him)? He replied: Yes, my ears heard it and my heart retained it. So the Ansari said: I forgive him for the sake of Allah. Sayyiduna Mu'awiyah (may Allah be pleased with him) said: No harm; but you will not be left like this either. And he ordered that he be given wealth.

Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) said in the presence of Sayyiduna Mu'awiyah (may Allah be pleased with him): I heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever is caused a bodily injury equal to half the blood money and pardons it, that becomes an expiation for half of his misdeeds; and whoever suffers an injury equal to a third or a quarter of the blood money, for him it becomes an expiation for a quarter or a third of his sins." That man said: Did you really hear this from the Messenger of Allah (peace and blessings be upon him)? He said: "By Allah! I heard it from the Messenger of Allah (peace and blessings be upon him)."
Both of these are munqati' (with broken chains).
