Sayyidah Aishah (may Allah be pleased with her) said: The Prophet (peace and blessings be upon him) married me when I was six years old, and when I was sent to his home I was nine years old.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13657
Hisham bin Urwah narrates from his father that the Prophet (peace and blessings be upon him) married Sayyidah Aishah (may Allah be pleased with her) three years after the death of Sayyidah Khadijah (may Allah be pleased with her), and Sayyidah Aishah (may Allah be pleased with her) was six years old; when she was sent to his home she was nine years old, and when he (peace and blessings be upon him) passed away, Sayyidah Aishah (may Allah be pleased with her) was eighteen years old.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13658
Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) sent a marriage proposal to Sayyiduna Ali (may Allah be pleased with him), asking him to marry Umm Kulthum (may Allah be pleased with her) to him. Sayyiduna Ali (may Allah be pleased with him) said: She is still young. Sayyiduna Umar (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say: "On the Day of Resurrection every tie and lineage will be cut off, except my lineage and my tie." And I would love for my lineage and tie also to be joined to the Prophet (peace and blessings be upon him). So Sayyiduna Ali (may Allah be pleased with him) said to Sayyiduna Hasan and Sayyiduna Husayn (may Allah be pleased with them both): Marry her to him. They both said: She is a woman who should be given the choice over herself. So Sayyiduna Ali (may Allah be pleased with him) stood up in anger. Sayyiduna Hasan (may Allah be pleased with him) held him back by his garment and said: O dear father! It is impossible to bear separation from you. The narrator says: So she was married to him.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and a virgin's permission is to be sought, and her permission is her silence."
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13661
The Prophet (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and a virgin's permission is to be sought by her father, and her permission is her silence." And sometimes he (peace and blessings be upon him) also said: "Her silence is her consent."
Abu Dawud (may Allah have mercy on him) said: The words "her father" are not preserved (mahfuz).
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13663
Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) sent a marriage proposal to Nu'aym bin Abdullah, who was called al-Nahham and was one of Banu Adi. He had a virgin daughter. Nu'aym said to him: There is an orphan boy under my care, and I will not prefer anyone over him. The wife of Nu'aym went to the Messenger of Allah (peace and blessings be upon him) and said: Ibn Umar proposed marriage to my daughter, but Nu'aym refused him, and he wants to marry her to the orphan boy under his care. That woman told the Messenger of Allah (peace and blessings be upon him) the whole story, and he sent for Nu'aym, and the Prophet (peace and blessings be upon him) said: "Seek the pleasure of your wife and the pleasure of your daughter."

Al-Qasim bin Muhammad (may Allah have mercy on him) and Salim bin Abdullah (may Allah have mercy on him) used to marry off their virgin daughters and did not even consult them.

It is narrated from Abu al-Zinad from the jurists he met, whose word was final, among them Sa'id bin al-Musayyib (may Allah have mercy on him), Urwah bin al-Zubayr (may Allah have mercy on him), al-Qasim bin Muhammad (may Allah have mercy on him), Abu Bakr bin Abd al-Rahman (may Allah have mercy on him), Kharijah bin Zayd bin Thabit (may Allah have mercy on him), Ubaydullah bin Abdullah bin Utbah (may Allah have mercy on him) and Sulayman bin Yasar (may Allah have mercy on him), along with other eminent elders like them. He said: Sometimes they differed on a matter, and I took the view of the majority of them. They used to say: A man may himself marry off his virgin daughter without her permission, and if she has been previously married, it is not permissible for her father (to conclude her marriage) without her permission.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13667
Ibn Jurayj (may Allah have mercy on him) said: I said to Ata (may Allah have mercy on him): Is it permissible for a man to marry off his virgin daughter while she dislikes it? He said: Yes. Then I asked: Is it also permissible for a previously married woman who dislikes it? He said: No, because a previously married woman is herself the owner of her affair.

It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that a virgin girl came to the Prophet (peace and blessings be upon him) and said: "My father has married me to someone I dislike." So he (peace and blessings be upon him) gave her the choice.
Jarir bin Hazim erred in this hadith in narrating it from Ayyub al-Sakhtiyani; what is preserved is from Ayyub, from Ikrimah, from the Prophet (peace and blessings be upon him), mursal.

Likewise (through another chain), without mentioning Ibn Abbas.
Abu Dawud said: It is likewise narrated as mursal, and that is well known. It has also been narrated through another route from Ikrimah with a connected chain, and that too is an error.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13670
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said that he (peace and blessings be upon him) annulled the marriage of both a previously married woman and a virgin whom their father had married off while they both disliked it. He (peace and blessings be upon him) annulled the marriage of both of them.

Al-Daraqutni said: This is a mistake; the correct version is from Yahya, from al-Muhajir bin Ikrimah, mursal. Al-Dhimari erred in it against al-Thawri, and he is not strong.
It is found in the Jami' of al-Thawri, from al-Thawri, as mursal, just as Abu al-Hasan al-Daraqutni (may Allah have mercy on him) mentioned; the generality of his students narrated it from him likewise, and others besides al-Thawri also narrated it likewise from Hisham. It has also been narrated through another route in which the narrator erred.

It is narrated from Sayyiduna Jabir bin Abdullah (may Allah be pleased with them both) that a man married off his daughter, who was a virgin, against her consent. She came to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) separated the two of them.
This is a mistake; the correct version is from al-Awza'i, from Ibrahim bin Murrah, from Ata, from the Prophet (peace and blessings be upon him), mursal. Ibn al-Mubarak, Isa bin Yunus and others narrated it thus from al-Awza'i.

Likewise.
Abu Ali al-Hafiz al-Naysaburi, when asked about this hadith of Shu'ayb bin Ishaq, said: Al-Awza'i did not hear it from Ata; the hadith is originally mursal from Ata. The trustworthy narrators narrated it only from al-Awza'i, from Ibrahim bin Murrah, from Ata, from the Messenger of Allah (peace and blessings be upon him), mursal.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13674
Likewise.
Al-Daraqutni said: The correct version is mursal, and Shu'ayb's version is a mistake. Al-Athram mentioned it to Ahmad bin Hanbal, and he rejected it. It has also been narrated through another weak route from Abu al-Zubayr, from Jabir, and it is not well known. If that is authentic, then it is as though he had married her to someone who was not a suitable match, so the Prophet (peace and blessings be upon him) gave her the choice in such a case.
Hadith Referenceالسنن الكبرى للبيهقي / كتاب النكاح / 13675
A woman came to Sayyidah Aishah (may Allah be pleased with her) and said: "My father has married me to his nephew so that through me he may raise his low standing, and I dislike this." Sayyidah Aishah (may Allah be pleased with her) said: "Sit down until the Prophet (peace and blessings be upon him) comes, then tell him." When the Prophet (peace and blessings be upon him) came, she mentioned it to him. He (peace and blessings be upon him) sent for her father, and when her father came, he (peace and blessings be upon him) left the decision to her wishes. When the woman saw that the decision could be according to her wish, she said: "What my father has done in the marriage is fine; I only wanted to know whether women have any right in the matter or not."
This is mursal; Ibn Buraydah did not hear from Aishah (may Allah be pleased with her).
