وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا بَحْرُ بْنُ نَصْرٍ، ثنا الشَّافِعِيُّ، أنبأ عَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ قَالَ: قُلْتُ لِعَطَاءٍ: " أَيَجُوزُ إِنْكَاحُ الرَّجُلِ ابْنَتَهُ بِكْرًا وَهِيَ كَارِهَةٌ؟ قَالَ: " نَعَمْ "، قُلْتُ: فَثَيِّبٌ كَارِهَةٌ؟ قَالَ: " قَدْ مَلَكَتِ الثَّيِّبُ أَمْرَهَا "، ⦗١٨٩⦘ وَرُوِّينَا عَنْ إِبْرَاهِيمَ النَّخَعِيِّ قَالَ: الْبِكْرُ يُجْبِرُهَا أَبُوهَا، وَعَنِ الشَّعْبِيِّ قَالَ: لَا يُجْبِرُ إِلَّا الْوَالِدُ.
Ibn Jurayj (may Allah have mercy on him) said: I said to Ata (may Allah have mercy on him): Is it permissible for a man to marry off his virgin daughter while she dislikes it? He said: Yes. Then I asked: Is it also permissible for a previously married woman who dislikes it? He said: No, because a previously married woman is herself the owner of her affair.
