Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates from the Messenger of Allah (peace and blessings be upon him) that on the day of the Conquest of Makkah he (peace and blessings be upon him) said: "There is no hijrah (emigration), but there is jihad and intention; and when you are called out to go forth, then go forth." And on the day of the Conquest of Makkah the Messenger of Allah (peace and blessings be upon him) said: "Allah made this city sacred on the day He created the heavens and the earth, so it is sacred by the sanctity of Allah until the Day of Resurrection. Its fresh grass is not to be cut, its thorny trees are not to be cut down, its game is not to be startled, and its lost property is not to be picked up except by one who announces it."
Sayyiduna Abbas (may Allah be pleased with him) said: O Messenger of Allah (peace and blessings be upon him)! Except idhkhir, for it is for their smiths and their houses. He (peace and blessings be upon him) said: "Except idhkhir."

Its fresh grass is not to be cut nor its trees cut down, its game is not to be startled, and its lost property is not to be picked up except by one who announces it." It is that one moves it away from the shade and settles in its place himself."

Ubayd bin Umayr (may Allah have mercy on him) says that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) was addressing the people at Mina when he saw a man on a mountain cutting down trees. He summoned him and asked him: Do you not know that the trees of Makkah are not to be cut down and its fresh grass is not to be cut? He said: Of course, but an emaciated camel of mine drove me to it. So he (Umar) gave him a camel to ride, and said to him: Do not do it again; and he did not impose any penalty on him.

Rabi' (may Allah have mercy on him) says that Imam al-Shafi'i (may Allah have mercy on him) said: Whoever cuts anything from the trees of the sanctuary owes compensation, whether he is in ihram or not: for a small tree a sheep, and for a large tree a cow. This is narrated from Ibn al-Zubayr (may Allah be pleased with them both) and Ata (may Allah have mercy on him) together.
(b) Ibn al-Zubayr (may Allah be pleased with them both) and Ata (may Allah have mercy on him) agree, in the earlier report on the ransom, that for a great tree (dawhah) there is a cow; the dawhah is a huge tree.
(c) And Ata (may Allah have mercy on him) said: For a tree smaller than that, a sheep.
(d) Imam al-Shafi'i (may Allah have mercy on him) said: Analogy, first of all, indicates what was described: that whoever damages it pays its value as ransom.
(e) The Shaykh said: We have narrated from Ibn Jurayj from Ata (may Allah have mercy on him), about a man who cuts from the trees of the sanctuary: For a twig, one dirham, and for a great tree, a cow.
