The muhrim does not accept live game given to him as a gift

Ibn Abbas (may Allah be pleased with them both) narrates from Sa'b bin Jaththamah (may Allah be pleased with him) that he gave the Messenger of Allah (peace and blessings be upon him) a wild donkey as a gift while he (peace and blessings be upon him) was at al-Abwa or Waddan, and the Messenger of Allah (peace and blessings be upon him) returned it to him. When the Messenger of Allah (peace and blessings be upon him) saw what was in my face, he said: "We have returned it to you only because we are in the state of ihram."

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) reported that he heard Sayyiduna Sa'b bin Jaththamah al-Laythi (may Allah be pleased with him), who was one of the Companions (may Allah be pleased with them) of the Messenger of Allah (peace and blessings be upon him), relate that he gave the Prophet (peace and blessings be upon him) a wild donkey as a gift at al-Abwa or Waddan while the Messenger of Allah (peace and blessings be upon him) was in the state of ihram, and the Messenger of Allah (peace and blessings be upon him) returned it. Sayyiduna Sa'b (may Allah be pleased with him) said: When the Messenger of Allah (peace and blessings be upon him) saw in my face (the effect of) his returning my gift, he (peace and blessings be upon him) said: "There is no rejection of you on our part; but we are in the state of ihram."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) reported that Sayyiduna Sa'b bin Jaththamah (may Allah be pleased with him) told him that the Messenger of Allah (peace and blessings be upon him) passed by him at al-Abwa or Waddan, and he gave him (peace and blessings be upon him) a wild donkey as a gift, but he returned it to him. When the Messenger of Allah (peace and blessings be upon him) saw the dislike in his face, he said: "There is no rejection of you on our part; but I am in the state of ihram."

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates that Sayyiduna Sa'b bin Jaththamah (may Allah be pleased with him) told him: The Messenger of Allah (peace and blessings be upon him) passed by me while I was at al-Abwa or Waddan. I gave him (peace and blessings be upon him) a wild donkey as a gift, and he (peace and blessings be upon him) returned it to me. When he saw the dislike in my face, he said: "There is no rejection of you on our part; but we are in the state of ihram."
This is how I found it in my book; it is what al-Humaydi heard from Sufyan in earlier times, and afterwards (Sufyan) became inconsistent about it.

Abu Bakr al-Humaydi (may Allah have mercy on him) said: Sufyan used to say in this hadith: "I gave the Messenger of Allah (peace and blessings be upon him) the meat of a wild donkey as a gift"; sometimes Sufyan said "dripping with blood", and sometimes he did not say it. In earlier times Sufyan would sometimes say "a wild donkey", then he moved to saying "meat" until he died.

Ibn Abbas (may Allah be pleased with them both) says that Sa'b bin Jaththamah (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) a wild donkey as a gift while he (peace and blessings be upon him) was in the state of ihram. He (peace and blessings be upon him) returned it to him and said: "Had we not been in the state of ihram, we would have accepted it from you."

Sa'id bin Jubayr (may Allah have mercy on him) narrates from Ibn Abbas (may Allah be pleased with them both) that one side of a wild donkey was given to the Prophet (peace and blessings be upon him) as a gift, and he (peace and blessings be upon him) returned it, because he (peace and blessings be upon him) was in the state of ihram.

Sa'id bin Jubayr narrates from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Sa'b bin Jaththamah (may Allah be pleased with him) gave the Messenger of Allah (peace and blessings be upon him) a wild donkey as a gift while he was in the state of ihram, and he returned it.

Sa'id bin Jubayr narrates from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Sa'b bin Jaththamah (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) the hindquarters of a donkey as a gift while he (peace and blessings be upon him) was at a place called Qudayd and in the state of ihram. He (peace and blessings be upon him) returned it, and it was dripping with blood.
Perhaps this is the correct version: Shu'bah's narration from al-Hakam says "the hindquarters of a donkey", and his narration from Habib says "a wild donkey", as Abu Dawud narrated it.
(b) Sa'id bin Jubayr narrates from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Sa'b bin Jaththamah (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) a gift; one of the two narrators said: "at Qudayd, the hindquarters of a donkey", and the other said: "a wild donkey, and he returned it."
If the narration is like this, then Shu'bah's narration from Habib agrees with al-A'mash's narration from Habib, and Shu'bah's narration from al-Hakam agrees with Mansur's narration from al-Hakam; so al-Hakam is alone in mentioning the meat or what carries that meaning. And Allah knows best.

Sa'id bin Jubayr narrates from Ibn Abbas (may Allah be pleased with them both) that Sa'b bin Jaththamah (may Allah be pleased with him) gave the Messenger of Allah (peace and blessings be upon him) a leg of a wild donkey as a gift while he (peace and blessings be upon him) was at a place called Qudayd. He (peace and blessings be upon him) returned it.

Imam al-Shafi'i (may Allah have mercy on him) said: If Sa'b bin Jaththamah (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) the donkey alive, then it is not permissible for a person in ihram to slaughter a live wild donkey; and if he gave him meat, then it is possible that he knew it had been hunted for him, so he returned it to him; and the clarification of this is in the hadith of Jabir bin Abdullah (may Allah be pleased with them both).
Imam al-Shafi'i (may Allah have mercy on him) said: The hadith of Imam Malik (may Allah have mercy on him), that Sa'b (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) a donkey, is more firmly established than the hadith of the one who narrated that he gave him some of the meat of a donkey. And Allah knows best.
The Shaykh (may Allah have mercy on him) said: It has also been narrated in the hadith of Sa'b (may Allah be pleased with him) that he (peace and blessings be upon him) ate from it.

Ja'far bin Amr bin Umayyah al-Damri (may Allah have mercy on him) narrates from his father (may Allah be pleased with him) that Sa'b bin Jaththamah (may Allah be pleased with him) gave the Prophet (peace and blessings be upon him) the hindquarters of a wild donkey as a gift while he (peace and blessings be upon him) was at al-Juhfah. He (peace and blessings be upon him) ate from it, and the people ate too.
This chain is sahih (authentic); if it is preserved, then it is as though he returned the live animal and accepted the meat. And Allah knows best.

Sayyiduna Ibn Abbas (may Allah be pleased with them both) says: Zayd bin Arqam (may Allah be pleased with him) came, and Abdullah bin Abbas (may Allah be pleased with them both), asking him to recall it, said: How did you tell me about the game meat that was given as a gift to the Messenger of Allah (peace and blessings be upon him) while he was in the state of ihram? He said: A portion of game meat was given to him (peace and blessings be upon him) as a gift, and he (peace and blessings be upon him) returned it and said: "We do not eat it; we are in the state of ihram."
(b) Zayd bin Arqam (may Allah be pleased with him) came, and Ibn Abbas (may Allah be pleased with them both) went to him and asked him for a fatwa about game meat. He said: Game meat was brought to the Messenger of Allah (peace and blessings be upon him) while he was in the state of ihram, and he (peace and blessings be upon him) returned it.

Ishaq bin Abdullah bin al-Harith narrates from his father that al-Harith was the deputy of Sayyiduna Uthman (may Allah be pleased with him) over al-Ta'if. He prepared food for Sayyiduna Uthman (may Allah be pleased with him), and included in it partridges, male partridges and the meat of wild game. He sent for Sayyiduna Ali bin Abi Talib (may Allah be pleased with him). The messenger came to him while he was beating down leaves for his camels, and he came shaking the leaves off his hands. They said to him: Eat. He said: Feed it to people who are not in ihram, for we are people in ihram. Then Sayyiduna Ali (may Allah be pleased with him) said: I adjure by Allah whoever is here from the tribe of Ashja': do you know that a man gave the Messenger of Allah (peace and blessings be upon him) a wild donkey as a gift while he was in the state of ihram, and he refused to eat it? They said: Yes.
(b) The explanation of these two connected reports is what al-Shafi'i (may Allah have mercy on him) mentioned in explaining the hadith of those who narrated, in the story of Sa'b bin Jaththamah, that he gave him some of the meat of a donkey. As for Sayyiduna Ali and Ibn Abbas (may Allah be pleased with them both), they held that eating it is absolutely forbidden for the person in ihram. Sayyiduna Umar, Uthman, Talhah and Zubayr (may Allah be pleased with them) and others differed with them both, and on their side is the hadith of Sayyiduna Abu Qatadah and Jabir (may Allah be pleased with them both). Hisham bin Urwah narrates from his father that Sayyidah Aishah (may Allah be pleased with her), the wife of the Prophet (peace and blessings be upon him), said to him: O son of my sister! It is only ten nights; if anything causes unease in your heart, leave it. (She meant eating game meat.)

Abdullah bin Shammas (may Allah have mercy on him) says: I came to Sayyidah Aishah (may Allah be pleased with her) and asked her about game meat that a person not in ihram gives as a gift to a person in ihram. She said: The Companions of the Messenger of Allah (peace and blessings be upon him) differed about it; some of them disliked it and some of them saw no harm in it, and there is no harm in it.
