عَنْ عَائِشَةَ قَالَتْ : كَانَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - إِذَا أَرَادَ أَنْ يُزَوِّجَ بِنْتًا مِنْ بَنَاتِهِ جَلَسَ إِلَى خِدْرِهَا فَقَالَ : إِنَّ فُلَانًا يَذْكُرُ فُلَانَةَ " يُسَمِّيهَا وَيُسَمِّي الرَّجُلَ الَّذِي يَذْكُرُهَا ، فَإِنْ هِيَ سَكَتَتْ زَوَّجَهَا ، وَإِنْ هِيَ كَرِهَتْ نَقَرَتِ السِّتْرَ فَإِذَا نَقَرَتْهُ لَمْ يُزَوِّجْهَا .
رَوَاهُ أَحْمَدُ ، وَأَبُو يَعْلَى ، وَفِيهِ أَيُّوبُ بْنُ عُتْبَةَ ، وَهُوَ ضَعِيفٌ ، وَقَدْ وُثِّقَ .
Sayyidah Aishah (may Allah be pleased with her) narrates: When the Prophet (peace and blessings be upon him) intended to marry one of his daughters, he would sit by her curtain and say: So-and-so has mentioned so-and-so. The Prophet (peace and blessings be upon him) would name his daughter and name the man who had mentioned her. If she remained silent, he would arrange her marriage; and if she disliked it, she would tap the curtain, and when she tapped the curtain, the Prophet (peace and blessings be upon him) would not marry her to him.
Ahmad and Abu Ya'la recorded it; its chain contains Ayyub bin Utbah, who is da'if (weak), though he has also been declared trustworthy.

وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنَّهُ كَانَ إِذَا أَرَادَ أَنْ يُزَوِّجَ بِنْتًا مِنْ بَنَاتِهِ جَلَسَ عِنْدَ خِدْرِهَا ، ثُمَّ يَقُولُ : " إِنَّ فُلَانًا يَخْطُبُ فُلَانَةً " . فَإِنْ سَكَتَتْ فَذَلِكَ إِذْنُهَا أَوْ قَالَ : " سُكُوتُهَا إِذْنُهَا " .
رَوَاهُ الْبَزَّارُ ، وَرِجَالُهُ ثِقَاتٌ .
Sayyiduna Abu Hurayrah (may Allah be pleased with him) reports about the Prophet (peace and blessings be upon him): When he intended to marry one of his daughters, he would sit by her curtain and then say: "So-and-so has proposed to so-and-so." If she remained silent, that was her permission; or he said: "Her silence is her permission."
Al-Bazzar recorded it, and its narrators are thiqat (trustworthy).

وَعَنْ أَنَسِ بْنِ مَالِكٍ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - كَانَ إِذَا خُطِبَ بَعْضُ بَنَاتِهِ جَلَسَ إِلَى الْخِدْرِ فَقَالَ : " إِنَّ فُلَانًا يَخْطُبُ فُلَانَةً " . فَإِنْ هِيَ سَكَتَتْ كَانَ سُكُوتُهَا رِضَاهَا ، وَإِنْ هِيَ كَرِهَتْ طَعَنَتْ فِي الْحِجَابِ فَكَانَ ذَلِكَ مِنْهَا كَرَاهِيَةً .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ عَبْدُ الْعَزِيزِ بْنُ الْحُصَيْنِ ، وَهُوَ ضَعِيفٌ .
Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: When a proposal was made to the Prophet (peace and blessings be upon him) for any of his daughters, he would sit behind the curtain and say: "So-and-so has proposed to so-and-so." If she remained silent, her silence was counted as her consent; and if she disliked it, she would tap the curtain, and that was counted as an expression of her dislike.
At-Tabarani recorded it in al-Mu'jam al-Awsat; its chain contains Abd al-Aziz bin al-Husayn, who is da'if (weak).

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: When a proposal was made to the Prophet (peace and blessings be upon him) for any of his daughters, he would come to the curtain and say: "So-and-so has proposed to so-and-so." If she touched the curtain, the Prophet (peace and blessings be upon him) would not marry her to him; and if she did not touch the curtain, the Prophet (peace and blessings be upon him) would arrange her marriage.
At-Tabarani recorded it; its chain contains Yahya bin Abd al-Hamid al-Himmani, who has been declared trustworthy, though there is weakness in him.

وَعَنْ عُمَرَ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - كَانَ إِذَا أَرَادَ أَنْ يُزَوِّجَ امْرَأَةً مِنْ نِسَائِهِ يَأْتِيهَا مِنْ وَرَاءِ الْحِجَابِ فَيَقُولُ لَهَا : " يَا بُنَيَّةُ إِنَّ فُلَانًا خَطَبَكِ ، فَإِنْ كَرِهْتِيهِ فَقُولِي : لَا ، فَإِنَّهُ لَا يَسْتَحِي أَحَدٌ أَنْ يَقُولَ : لَا . وَإِنْ أَحْبَبْتِ ، فَإِنَّ سُكُوتَكِ إِقْرَارٌ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ يَزِيدُ بْنُ عَبْدِ الْمَلِكِ النَّوْفَلِيُّ ، وَهُوَ مَتْرُوكٌ ، وَقَدْ وَثَّقَهُ ابْنُ مَعِينٍ فِي رِوَايَةٍ .
Sayyiduna Umar (may Allah be pleased with him) narrates: When the Prophet (peace and blessings be upon him) was to arrange the marriage of one of the women of his family, he would come to her from behind the curtain and say to her: "O my daughter! So-and-so has proposed to you. If you dislike him, say: No; for no one is ashamed to say 'No'. And if you like him, your silence will count as consent."
At-Tabarani recorded it; its chain contains Yazid bin Abd al-Malik al-Nawfali, who is matruk (abandoned), though Yahya bin Ma'in declared him trustworthy in one report.

وَعَنْ مُعَاوِيَةَ بْنِ حُدَيْجٍ قَالَ : أَرْسَلَنِي مُعَاوِيَةُ بْنُ أَبِي سُفْيَانَ إِلَى الْحَسَنِ بْنِ عَلِيٍّ أَخْطُبُ عَلَى يَزِيدَ بِنْتًا لَهُ أَوْ أُخْتًا لَهُ فَأَتَيْتُهُ فَذَكَرْتُ لَهُ يَزِيدَ فَقَالَ : إِنَّا قَوْمٌ لَا نُزَوِّجُ نِسَاءَنَا حَتَّى نَسْتَأْمِرَهُنَّ . فَأَتَيْتُهَا فَذَكَرْتُ لَهَا يَزِيدَ فَقَالَتْ : وَاللَّهِ لَا يَكُونُ ذَلِكَ حَتَّى يَسِيرَ فِينَا صَاحِبُكَ كَمَا سَارَ فِرْعَوْنُ فِي بَنِي إِسْرَائِيلَ يُذَبِّحُ أَبْنَاءَهُمْ وَيَسْتَحْيِي نِسَاءَهُمْ . فَرَجَعْتُ إِلَى الْحَسَنِ فَقُلْتُ : أَرْسَلْتَنِي إِلَى فِلْقَةٍ مِنَ الْفِلَقِ تُسَمِّي أَمِيرَ الْمُؤْمِنِينَ فِرْعَوْنَ . قَالَ : يَا مُعَاوِيَةُ إِيَّاكَ وَبُغْضَنَا ، فَإِنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " لَا يُبْغِضُنَا ، وَلَا يَحْسُدُنَا أَحَدٌ إِلَّا زِيدَ يَوْمَ الْقِيَامَةِ عَنِ الْحَوْضِ بِسِيَاطٍ مِنْ نَارٍ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ عَبْدُ اللَّهِ بْنُ عُمَرَ الْوَاقِفِيُّ ، وَهُوَ كَذَّابٌ .
Mu'awiyah bin Hudayj narrates: Sayyiduna Mu'awiyah (may Allah be pleased with him) sent me to Sayyiduna Imam Hasan bin Ali (may Allah be pleased with them both) to propose Yazid for his daughter or for one of his sisters. I came to him and mentioned Yazid to him, and he said: We are a people who do not marry off our women without first seeking their wishes. So I came to that woman and mentioned Yazid to her, and she said: By Allah! That will not happen until your master treats us the way Pharaoh treated the Children of Israel, slaughtering their sons and keeping their women alive. The narrator says: I went back to Sayyiduna Imam Hasan (may Allah be pleased with him) and said: You sent me to a sharp-tempered woman who calls the Commander of the Believers "Pharaoh". Sayyiduna Imam Hasan (may Allah be pleased with him) said: O Mu'awiyah! Beware of hating us, for the Prophet (peace and blessings be upon him) said: "No one hates us or envies us except that on the Day of Resurrection he will be driven away from the Pond with whips of fire."
At-Tabarani recorded it; its chain contains Abdullah bin Umar al-Waqifi, who is a kadhdhab (liar).

وَعَنْ إِبْرَاهِيمَ بْنِ صَالِحٍ - وَاسْمُهُ الَّذِي يُعْرَفُ بِهِ : نُعَيْمُ بْنُ النَّحَّامِ ، وَكَانَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - سَمَّاهُ صَالِحًا - [ أَخْبَرَهُ ] أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ قَالَ لِعُمَرَ بْنِ الْخَطَّابِ : اخْطُبْ عَلَيَّ ابْنَةَ صَالِحٍ . قَالَ : إِنَّ لَهُ يَتَامَى ، وَلَمْ يَكُنْ لِيُؤْثِرَنَا عَلَيْهِمْ . فَانْطَلَقَ عَبْدُ اللَّهِ إِلَى عَمِّهِ زَيْدِ بْنِ الْخَطَّابِ لِيَخْطُبَ فَانْطَلَقَ زَيْدٌ إِلَى صَالِحٍ فَقَالَ : إِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ أَرْسَلَنِي إِلَيْكَ يَخْطُبُ ابْنَتَكَ . فَقَالَ : لِي يَتَامَى ، وَلَمْ أَكُنْ لِأُتْرِبَ لَحْمِي وَأَرْفَعَ لَحْمَكَ أُشْهِدُكُمْ أَنِّي قَدْ أَنْكَحْتُهَا فُلَانًا . وَكَانَ هَوَى أُمِّهَا إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ فَأَتَتْ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَقَالَتْ : يَا نَبِيَّ اللَّهِ ابْنَتِي خَطَبَهَا عَبْدُ اللَّهِ بْنُ عُمَرَ فَأَنْكَحَهَا أَبُوهَا يَتِيمًا فِي حِجْرِهِ ، وَلَمْ يُؤَامِرْهَا . فَأَرْسَلَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - إِلَى صَالِحٍ فَقَالَ : " أَنْكَحْتَ ابْنَتَكَ ، وَلَمْ تُؤَامِرْهَا ؟ " قَالَ : نَعَمْ ! قَالَ : " أَشِيرُوا النِّسَاءَ فِي أَنْفُسِهِنَّ وَهُنَّ بِكْرٌ " فَقَالَ صَالِحٌ : إِنَّمَا فَعَلْتُ هَذَا لَمَّا تَصَدَّقَهَا ابْنُ عُمَرَ ، فَإِنَّ لَهُ فِي مَالِي مِثْلَ مَا أَعْطَاهَا .
رَوَاهُ أَحْمَدُ ، وَهُوَ مُرْسَلٌ ، وَرِجَالُهُ ثِقَاتٌ .
It is narrated from Ibrahim bin Salih (Salih being the man known as Sayyiduna Nu'aym bin al-Nahham (may Allah be pleased with him), whom the Prophet (peace and blessings be upon him) had named "Salih") that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him): Propose on my behalf for the daughter of Salih. Sayyiduna Umar (may Allah be pleased with him) said: He has orphans (under his care) (that is, Salih's own orphaned nephews), and he will not prefer us over them (that is, he will marry her to one of his nephews or the like). Then Sayyiduna Abdullah (may Allah be pleased with him) went to his uncle Sayyiduna Zayd bin al-Khattab (may Allah be pleased with him) so that he would make the proposal. Sayyiduna Zayd (may Allah be pleased with him) went to Sayyiduna Salih (may Allah be pleased with him) and said: Abdullah bin Umar has sent me to you to propose for your daughter. He said: I have some orphans under my care (that is, my nephews and the like), so I will not neglect my own flesh and blood and prefer your relative. I call you to witness that I have married her to so-and-so. The girl's mother wished her to be married to Sayyiduna Abdullah bin Umar (may Allah be pleased with them both), so she came to the Prophet (peace and blessings be upon him) and said: O Prophet of Allah! Abdullah bin Umar proposed for my daughter, but her father has married her to an orphan boy under his care, and he did not ask her wishes. The Prophet (peace and blessings be upon him) sent for Sayyiduna Salih (may Allah be pleased with him) and asked: "Have you married off your daughter without asking her wishes?" He replied: Yes! The Prophet (peace and blessings be upon him) said: "Consult women about themselves, even if they are virgins." Sayyiduna Salih (may Allah be pleased with him) said: She did this only because Abdullah bin Umar had given her money; Abdullah bin Umar shall have from my wealth as much as he gave her.
Ahmad recorded it, and
it is mursal; its narrators are thiqat (trustworthy).

وَعَنْ أَبِي مُوسَى عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " إِذَا أَرَادَ الرَّجُلُ أَنْ يُزَوِّجَ ابْنَتَهُ فَلْيَسْتَأْذِنْهَا " .
رَوَاهُ أَبُو يَعْلَى ، وَالطَّبَرَانِيُّ ، وَرِجَالُ أَبِي يَعْلَى رِجَالُ الصَّحِيحِ .
Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "When a man intends to marry off his daughter, let him seek her permission."
Abu Ya'la and at-Tabarani recorded it, and the narrators of Abu Ya'la are the narrators of the Sahih.

وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - قَالَ : " لَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ وَإِذْنُهَا الصُّمُوتُ . وَالثَّيِّبُ تُصِيبُ مِنْ أَمْرِهَا مَا لَمْ تَدْعُ إِلَى سَخْطَةٍ ، فَإِنْ دَعَتْ إِلَى سَخْطَةٍ ، وَكَانَ أَوْلِيَاؤُهَا يَدْعُونَ إِلَى رِضًا رُفِعَ ذَلِكَ إِلَى السُّلْطَانِ " .
قُلْتُ : هُوَ فِي الصَّحِيحِ بِاخْتِصَارٍ .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ وَقَالَ إِسْحَاقُ بْنُ رَاهَوَيْهِ : قُلْتُ لِعِيسَى بْنِ يُونُسَ بْنِ أَبِي إِسْحَاقَ : آخِرُ الْحَدِيثِ مِنْ حَدِيثِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - ؟ قَالَ : هَكَذَا أَنْبَأَنَا الْأَوْزَاعِيُّ . وَرِجَالُهُ رِجَالُ الصَّحِيحِ خَلَا إِبْرَاهِيمَ بْنَ مُرَّةَ ، وَهُوَ ثِقَةٌ .
Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates that the Prophet (peace and blessings be upon him) said: "A virgin shall not be married until her permission is sought, and her permission is her silence. A previously married woman (thayyib) shall act according to her own wishes, so long as she does not incline towards something displeasing; but if she inclines towards something displeasing while her guardians are inclining towards what is agreeable, then the matter shall be referred to the ruler." (Allamah al-Haythami says:) I say:
This narration is recorded in the "Sahih" in abridged form.
At-Tabarani recorded it in al-Mu'jam al-Awsat. Ishaq bin Rahawayh said: I said to Isa bin Yunus bin Abi Ishaq: Is the end of the hadith part of the Prophet's (peace and blessings be upon him) words? He said: This is how al-Awza'i narrated it to us. Its narrators are the narrators of the Sahih, except Ibrahim bin Murrah, who is nevertheless thiqah (trustworthy).

وَعَنْ أَبِي مُوسَى قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " أَمْرُ النِّسَاءِ بِأَيْدِي آبَائِهِنَّ وَإِذْنُهُنَّ سُكُوتُهُنَّ " .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ مُحَمَّدُ بْنُ سَالِمٍ الْهَمْدَانِيُّ ، وَهُوَ مَتْرُوكٌ .
Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "The affair of women is in the hands of their fathers, and their silence is their permission."
At-Tabarani recorded it; its chain contains Muhammad bin Salim al-Hamdani, who is matruk (abandoned).

وَعَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - رَدَّ نِكَاحَ ثَيِّبٍ وَبِكْرٍ أَنْكَحَهُمَا أَبُوهُمَا كَارِهَتَيْنِ .
رَوَاهُ الطَّبَرَانِيُّ ، وَفِيهِ إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ جُوثَى ، وَلَمْ أَعْرِفْهُ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) annulled the marriages of a previously married woman and a virgin whose father had married them both off, and had done so against their will.
At-Tabarani recorded it; its chain contains Ishaq bin Ibrahim bin Juthi, whom I do not know; the rest of its narrators are thiqat (trustworthy).

وَعَنِ الْعُرْسِ قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " آمِرُوا النِّسَاءَ تُعْرِبُ الثَّيِّبُ عَنْ نَفْسِهَا وَإِذْنُ الْبِكْرِ صَمْتُهَا " .
رَوَاهُ الطَّبَرَانِيُّ وَقَالَ : زَادَ سُفْيَانُ فِي الْإِسْنَادِ الْعُرْسَ .
وَرَوَاهُ اللَّيْثُ بْنُ سَعْدٍ عَنِ ابْنِ أَبِي حُسَيْنٍ ، وَلَمْ يُجَاوِزْ عَدِيَّ بْنَ عَدِيٍّ . قُلْتُ : وَرِجَالُهُ ثِقَاتٌ .
It is narrated from Sayyiduna al-Urs (bin Amirah) (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Seek the permission and counsel of women (regarding their marriage); the previously married woman (thayyib, a widow or divorcee) shall speak clearly for herself (stating it with her own tongue), and the silence of the maiden (a virgin girl) is her permission."
At-Tabarani (may Allah have mercy on him) recorded it and said that Sufyan added al-Urs (may Allah be pleased with him) to its chain, whereas al-Layth bin Sa'd narrated it from Ibn Abi Husayn and stopped the chain at Adi bin Adi, that is, he kept it mursal. I [Hafiz al-Haythami (may Allah have mercy on him)] say: All of its narrators are thiqat (trustworthy).

وَعَنْ أُمِّ سَلَمَةَ أَنَّ جَارِيَةً زَوَّجَهَا أَبُوهَا وَأَرَادَتْ أَنْ تُزَوَّجَ رَجُلًا آخَرَ فَأَتَتِ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَذَكَرَتْ ذَلِكَ لَهُ فَنَزَعَهَا مِنَ الَّذِي زَوَّجَهَا أَبُوهَا وَزَوَّجَهَا النَّبِيُّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - مِنَ الَّذِي أَرَادَتْ .
رَوَاهُ الطَّبَرَانِيُّ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ .
Sayyidah Umm Salamah (may Allah be pleased with her) narrates: A girl's father married her off, while she wanted to marry someone else. She came to the Prophet (peace and blessings be upon him) and mentioned this to him, so the Prophet (peace and blessings be upon him) separated her from the man to whom her father had married her, and the Prophet (peace and blessings be upon him) married her to the man she wanted to marry.
At-Tabarani recorded it, and its narrators are the narrators of the Sahih.

وَعَنْ عَبْدِ الرَّحْمَنِ وَمُجَمِّعٍ ابْنَيْ يَزِيدَ بْنِ جَارِيَةَ قَالَا : أَنْكَحَ حِذَامُ ابْنَتَهُ - وَهِيَ كَارِهَةٌ - رَجُلًا وَهِيَ ثَيِّبٌ فَأَتَتِ النَّبِيَّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - فَذَكَرَتْ ذَلِكَ لَهُ فَرَدَّ نِكَاحَهَا .
رَوَاهُ الطَّبَرَانِيُّ ، وَرِجَالُهُ ثِقَاتٌ .
Sayyiduna Abd al-Rahman (may Allah be pleased with him) and Sayyiduna Mujammi' bin Yazid bin Jariyah (may Allah be pleased with him) both narrate: Sayyiduna Hidham (may Allah be pleased with him) married his daughter to a man against her will, and that daughter was a thayyib (previously married woman). She came to the Prophet (peace and blessings be upon him) and mentioned this to him, so the Prophet (peace and blessings be upon him) annulled her marriage.
Imam al-Tabarani recorded it, and its narrators are thiqat (trustworthy).
