Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "An orphan girl is to be consulted about herself. If she remains silent, that counts as her consent; and if she refuses, she is not to be compelled."
Imam Ahmad, Imam Abu Ya'la, Imam al-Bazzar and Imam al-Tabarani recorded it; the narrators of Imam Ahmad are the narrators of the Sahih.

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: Sayyiduna Uthman bin Maz'un (may Allah be pleased with him) passed away, and he left behind a daughter of his from Khuwaylah bint Hakim bin Umayyah bin Harithah bin al-Awqas. The narrator says: He appointed his brother Qudamah bin Maz'un as executor. Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) says: Those two were my maternal uncles. I proposed to Qudamah bin Maz'un for the daughter of Sayyiduna Uthman bin Maz'un (may Allah be pleased with him), and he married her to me. Mughirah bin Shu'bah went to that girl's mother and enticed her with wealth, so the mother inclined towards him, and the girl also inclined towards her mother's wish. The two of them refused, until their matter was brought before the Prophet (peace and blessings be upon him). Sayyiduna Qudamah bin Maz'un (may Allah be pleased with him) said: "O Messenger of Allah! She is my brother's daughter, and my brother appointed me as her executor. I married her to her cousin, Abdullah bin Umar, and I have not fallen short with her in goodness or in suitability (kafa'ah); but she is a woman, and she has inclined towards her mother." The narrator says: The Prophet (peace and blessings be upon him) said: "She is an orphan girl, and she cannot be married except with her consent." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) says: By Allah! She was taken away from me after I had become her husband, and they married her to Sayyiduna Mughirah bin Shu'bah (may Allah be pleased with him). (Allamah al-Haythami says:) I say: Imam Ibn Majah recorded a part of this report.
Imam Ahmad recorded it, and its narrators are thiqat (trustworthy).
