Majma al-Zawaid — Hadith 7474

عَنْ أَبِي مُوسَى قَالَ : قَالَ رَسُولُ اللَّهِ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - : " تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا ، فَإِنْ سَكَتَتْ ، فَقَدْ أَذِنَتْ ، وَإِذَا أَبَتْ لَمْ تُكْرَهْ " .
رَوَاهُ أَحْمَدُ ، وَأَبُو يَعْلَى ، وَالْبَزَّارُ ، وَالطَّبَرَانِيُّ ، وَرِجَالُ أَحْمَدَ رِجَالُ الصَّحِيحِ .
Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) said: "An orphan girl is to be consulted about herself. If she remains silent, that counts as her consent; and if she refuses, she is not to be compelled."
Imam Ahmad, Imam Abu Ya'la, Imam al-Bazzar and Imam al-Tabarani recorded it; the narrators of Imam Ahmad are the narrators of the Sahih.
