بَابُ الْقُبْلَةِ وَالْمُبَاشَرَةِ لِلصَّائِمِ .

عَنْ عَبْدِ اللَّهِ بْنِ ثَعْلَبَةَ بْنِ صُعَيْرٍ ، وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ مَسَحَ عَلَى وَجْهِهِ وَأَدْرَكَ أَصْحَابَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ : كَانُوا يَنْهَوْنِي عَنِ الْقُبْلَةِ تَخَوُّفًا أَنْ أَتَقَرَّبَ لِأَكْثَرَ مِنْهَا ، ثُمَّ إِنَّ الْمُسْلِمِينَ الْيَوْمَ يَنْهَوْنِي عَنْهَا ، وَيَقُولَ قَائِلُهُمْ : إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ لَهُ مِنْ حِفْظِ اللَّهِ مَا لَيْسَ لِأَحَدٍ .

Sayyiduna Abdullah bin Tha'labah bin Su'ayr (may Allah be pleased with him), whose forehead the Prophet (peace and blessings be upon him) had stroked with his blessed hand and who met the Companions, narrates: People used to forbid me from kissing, out of fear that I would go further than that. And today too the Muslims forbid me from it, and one of them says: The protection that the Prophet (peace and blessings be upon him) had from Allah Almighty is not had by anyone else.

وَعَنْ عُمَرَ بْنِ الْخَطَّابِ قَالَ : رَأَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّوْمِ فَرَأَيْتُهُ لَا يَنْظُرُ إِلَيَّ . قُلْتُ : يَا رَسُولَ اللَّهِ ، مَا شَأْنُكَ ؟ قَالَ : " أَوَلَسْتَ الْمُقَبِّلَ وَأَنْتَ صَائِمٌ ؟ " . فَقُلْتُ : وَالَّذِي نَفْسُ عُمَرَ بِيَدِهِ لَا أُقَبِّلُ وَأَنَا صَائِمٌ أَبَدًا .
رَوَاهُ الْبَزَّارُ ، وَرِجَالُهُ رِجَالُ الصَّحِيحِ : قَالَ الْبَزَّارُ : وَقَدْ رُوِيَ عَنْ عُمَرَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خِلَافُ هَذَا .

Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) narrates: I saw the Prophet (peace and blessings be upon him) in a dream, and I saw that he was not looking at me. I said: O Messenger of Allah, what is the matter? He said: Did you not kiss while you were fasting? I said: By the One in whose Hand is the soul of Umar, I will never again kiss while I am fasting.

وَعَنْ أَبِي هُرَيْرَةَ قَالَ : نَهَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يُقَبِّلَ الرَّجُلُ وَهُوَ صَائِمٌ .

Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) forbade a man from kissing while he is fasting.
Al-Tabarani recorded it in al-Mu'jam al-Awsat. Its chain contains al-Harith bin Nabhan. Ibn Adi said: He has hasan (good) hadiths, and he is one of those whose hadith is written down. The Imams declared him da'if (weak).

It is reported about Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) that he used to forbid the fasting person from kissing, and he would say: None of you has the protection that the Prophet (peace and blessings be upon him) had.

وَعَنِ ابْنِ مَسْعُودٍ فِي الرَّجُلِ يُقَبِّلُ ، وَهُوَ صَائِمٌ قَالَ : يَقْضِي يَوْمًا مَكَانَهُ . قَالَ سُفْيَانُ : لَا يُؤْخَذُ بِهِ .

Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said about a man who kisses while he is fasting: He is to make up one day in its place. Sufyan al-Thawri said: Rulings are not given according to this.

وَعَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ قَالَ : كُنَّا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَاءَ شَابٌّ فَقَالَ : أُقَبِّلُ يَا رَسُولَ اللَّهِ وَأَنَا صَائِمٌ ؟ قَالَ : " لَا " . قَالَ : فَجَاءَ شَيْخٌ فَقَالَ : أُقَبِّلُ وَأَنَا صَائِمٌ ؟ قَالَ : " نَعَمْ " . قَالَ : فَنَظَرَ بَعْضُنَا إِلَى بَعْضٍ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " قَدْ عَلِمْتُ لِمَ نَظَرَ بَعْضُكُمْ إِلَى بَعْضٍ ; إِنَّ الشَّيْخَ يَمْلِكُ نَفْسَهُ " .

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates: We were with the Prophet (peace and blessings be upon him) when a man came and said: O Messenger of Allah, may I kiss while I am fasting? The Prophet (peace and blessings be upon him) said: No. Then an old man came and said: May I kiss while I am fasting? The Prophet (peace and blessings be upon him) said: Yes. We began looking at one another, so the Prophet (peace and blessings be upon him) said: I know why you are looking at one another; the old man has control over himself.

وَعَنْ أَبِي هُرَيْرَةَ قَالَ : كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا سَأَلَهُ شَابٌّ عَنِ الْقُبْلَةِ نَهَاهُ ، وَإِذَا سَأَلَهُ شَيْخٌ رَخَّصَ لَهُ وَقَالَ : " إِنَّ الشَّابَّ لَيْسَ كَالشَّيْخِ " .
رَوَاهُ الطَّبَرَانِيُّ فِي الْأَوْسَطِ ، وَفِيهِ عَبَّادُ بْنُ صُهَيْبٍ ، وَهُوَ مَتْرُوكٌ .

Sayyiduna Abu Hurayrah (may Allah be pleased with him) narrates: When a young man asked the Prophet (peace and blessings be upon him) about kissing, he would forbid him, and when an old man asked him about it, he (peace and blessings be upon him) would grant him the concession. He would say: "The young man is not like the old man."

وَعَنِ ابْنِ عَبَّاسٍ قَالَ : رَخَّصَ لِلشَّيْخِ أَنْ يُقَبِّلَ وَهُوَ صَائِمٌ ، وَنَهَى الشَّابَّ .

وَعَنْ عَطِيَّةَ قَالَ : سَأَلَ شَابٌّ ابْنَ عَبَّاسٍ : أَيُقَبِّلُ ، وَهُوَ صَائِمٌ ؟ قَالَ : لَا . ثُمَّ جَاءَ شَيْخٌ فَقَالَ : أَيُقَبِّلُ ، وَهُوَ صَائِمٌ ؟ فَقَالَ : نَعَمْ . قَالَ الشَّابُّ : سَأَلْتُكَ أُقَبِّلُ وَأَنَا صَائِمٌ ؟ فَقُلْتَ : لَا ، وَسَأَلَكَ هَذَا أَيُقَبِّلُ وَهُوَ صَائِمٌ ؟ قُلْتَ : نَعَمْ . فَكَيْفَ يَحِلُّ لِهَذَا مَا يَحْرُمُ عَلَيَّ وَأَنَا وَهُوَ عَلَى دِينٍ وَاحِدٍ ؟ فَقَالَ لَهُ ابْنُ عَبَّاسٍ : إِنَّ عِرْقَ الْخُصْيَتَيْنِ مُعَلَّقَةٌ بِالْأَنْفِ ، فَإِذَا شَمَّ الْأَنْفُ تَحَرَّكَ الذَّكَرُ ، وَإِذَا تَحَرَّكَ الذَّكَرُ دَعَا إِلَى مَا هُوَ أَكْبَرُ مِنْ ذَلِكَ ! ! وَالشَّيْخُ أَمْلَكُ لِأَرَبِهِ - وَذَلِكَ بَعْدَمَا ذَهَبَ بَصَرُ عَبْدِ اللَّهِ وَخَلْفَهُ امْرَأَةٌ - فَقَالَ : أَذَلَّكَ اللَّهُ مِنْ جَلِيسِ قَوْمٍ .

Atiyyah narrates: A man asked Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both): May he kiss while fasting? He replied: No. Then an old man came and asked: May I kiss while fasting? He replied: Yes. The young man said: I asked you whether I may kiss while fasting and you replied: No. This man asked you whether he may kiss while fasting and you replied: Yes. How can something be lawful for this man that is unlawful for me, when he and I follow one religion? Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said to him: There is a vein in the testicles that is connected to the nose; when the nose smells, the private part stirs, and when the private part stirs, it calls to something greater than that. And the old man has control over himself. The narrator says: This was after Sayyiduna Abdullah (may Allah be pleased with him) had lost his sight, and a woman was behind him. Then (the old man) said: May Allah humiliate you as a companion of people.

وَعَنْ عَطَاءِ بْنِ يَسَارٍ ، عَنْ رَجُلٍ مِنَ الْأَنْصَارِ ; أَنَّ الْأَنْصَارِيَّ أَخْبَرَ عَطَاءً أَنَّهُ قَبَّلَ امْرَأَتَهُ وَهُوَ صَائِمٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَأَمَرَ امْرَأَتَهُ فَسَأَلَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَفْعَلُ ذَلِكَ " . فَأَخْبَرَتْهُ امْرَأَتُهُ ، فَقَالَ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُرَخَّصُ لَهُ فِي أَشْيَاءَ فَارْجِعِي إِلَيْهِ فَقُولِي لَهُ . فَرَجَعَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ : إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُرَخَّصُ لَهُ فِي أَشْيَاءَ . فَقَالَ : " أَنَا أَتْقَاكُمْ لِلَّهِ عَزَّ وَجَلَّ ، وَأَعْلَمُكُمْ بِحُدُودِهِ " .

Ata bin Yasar reports from a man of the Ansar that the Ansari man told Ata that, in the time of the Prophet (peace and blessings be upon him), he kissed his wife while he was fasting. He instructed his wife to ask the Prophet (peace and blessings be upon him) about it. The Prophet (peace and blessings be upon him) said: The Messenger of Allah does that too. His wife came and told him, and he said: The Prophet (peace and blessings be upon him) has been granted concessions in certain matters; go back to the Prophet (peace and blessings be upon him) and put this to him. The woman went to the Prophet (peace and blessings be upon him) and said: The Prophet (peace and blessings be upon him) must have been granted concessions in certain things. The Prophet (peace and blessings be upon him) said: "I am the most God-fearing of you towards Allah Almighty and the most knowledgeable of you about His limits."

رَوَاهُ أَحْمَدُ وَالْبَزَّارُ وَالطَّبَرَانِيُّ فِي الْكَبِيرِ وَقَالَ : أَيْ يُقَبِّلُ . وَرِجَالُ أَحْمَدَ رِجَالُ الصَّحِيحِ .

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The Prophet (peace and blessings be upon him) used to "take from the heads" while he was fasting.

وَعَنْ أَنَسِ بْنِ مَالِكٍ قَالَ : سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَيُقَبِّلُ الصَّائِمُ ؟ قَالَ : " وَمَا بَأْسٌ بِذَلِكَ رَيْحَانَةٌ يَشُمُّهَا ؟ ! " .

Sayyiduna Anas bin Malik (may Allah be pleased with him) narrates: The Prophet (peace and blessings be upon him) was asked: May a fasting person kiss? The Prophet (peace and blessings be upon him) said: What harm is there in it? It is a fragrant flower that he has smelt.

وَعَنْ عَائِشَةَ قَالَتْ : دَخَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ : " يَا عَائِشَةُ هَلْ مِنْ كِسْرَةٍ ؟ " . فَأَتَيْتُهُ بِقُرْصٍ فَوَضَعَهُ عَلَى فِيهِ وَقَالَ : " يَا عَائِشَةُ هَلْ دَخَلَ بَطْنِي مِنْهُ شَيْءٌ ، كَذَلِكَ قُبْلَةُ الصَّائِمِ ، إِنَّمَا الْإِفْطَارُ مِمَّا دَخَلَ وَلَيْسَ مِمَّا خَرَجَ " .
رَوَاهُ أَبُو يَعْلَى ، وَفِيهِ مَنْ لَمْ أَعْرِفْهُ .

Sayyidah Aishah Siddiqah (may Allah be pleased with her) narrates: The Prophet (peace and blessings be upon him) came home and asked: O Aishah, is there anything to eat? I brought him a piece of bread. The Prophet (peace and blessings be upon him) put it in his mouth and then said: O Aishah, has anything of it entered my stomach? The ruling on a fasting person's kiss is likewise. The fast is broken by what goes in, not by what comes out.
