It is narrated from Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "The wound caused by an animal carries no liability; if someone dies while extracting from a mine, his blood carries no liability; one who dies in a well also carries no liability; and in buried treasure (rikaz) is one fifth."

Sayyiduna Abu Hurayrah (may Allah be pleased with him) says that the Messenger of Allah (peace and blessings be upon him) said: "The wound caused by an animal carries no liability, and a well also carries no liability." Hafs bin Umar added: "A mine also carries no liability, and in rikaz (buried treasure) is the khumus (one fifth)." The two Shaykhs recorded it in the Sahih from Shu'bah, and what he meant by it (Allah knows best) is a well that one digs on his own property, or in the desert, or on a clearly wide open road (it carries no liability). As for when one digs it somewhere other than these places, he will be liable for the damage. It is narrated from Sayyiduna Ali (may Allah be pleased with him) that whoever builds where he has no right, or digs a well on land not his own, will be liable.

Ibrahim al-Nakha'i (may Allah have mercy on him) says that a mule fell into a well. The dispute was brought to Qadi Shurayh (may Allah have mercy on him). Amr bin al-Harith said: "O Abu Umayyah, is anyone liable for a well?" He said: "No, but Amr bin al-Harith is liable, because his well was in a place to which he had no right."

Sayyiduna Ali (may Allah be pleased with him) says: When the Prophet (peace and blessings be upon him) sent me to Yemen, some people dug a pit to trap a lion. People were standing over the pit in which the lion had been caught, and a man fell into the pit. He grabbed a second, that one grabbed a third, and that one grabbed a fourth. The lion wounded them and they died. The people drew weapons against one another to avenge their own men, and they were close to fighting. So I said to them: "Will you kill 200 men for the sake of four people? Come, I will judge between you. If you are pleased with it, accept it; otherwise go to the Prophet (peace and blessings be upon him), for he is more entitled to judge." So I ruled a quarter of the blood money for the first, a third of the blood money for the second, half of the blood money for the third, and the full blood money for the fourth, and I placed the blood money upon the four tribes who were present there at that time. Some people accepted the ruling and some refused, and they came to him (peace and blessings be upon him). He (peace and blessings be upon him) said: "I will judge." A man said that Sayyiduna Ali (may Allah be pleased with him) had already made this judgement. When he (peace and blessings be upon him) was told, he (peace and blessings be upon him) said: "What Ali has judged is correct."

Imam al-Bukhari (may Allah have mercy on him) said: Hanash bin al-Mu'tamir (and some said: Ibn Rabi'ah); they criticise his hadith.
Our companions say: Analogy (qiyas) requires that the first receive two-thirds of the blood money, one third upon the 'aqilah of the second and one third upon the 'aqilah of the third, because he died from his own act and the act of the other two; so a third of the blood money falls away because of his own act, and the remaining two-thirds are due to him. The second also receives two-thirds of the blood money, a third of it upon the 'aqilah of the first and a third upon the 'aqilah of the third. Concerning the third person there are two views: (1) half of his blood money is upon the 'aqilah of the second; (2) he too receives two-thirds of the blood money, which the 'aqilah of the first and second will pay. The fourth receives the full blood money, which the 'aqilah of the third will pay; and there is also a view that the 'aqilah of the first, second and third will all pay it. If the hadith is proven authentic, analogy will be abandoned in its favour.

Khilas bin Amr (may Allah have mercy on him) says that a man hired four men to dig a well. Part of it fell upon one of the men and he died. The matter was brought to Sayyiduna Ali (may Allah be pleased with him), and he placed three quarters of the blood money upon the three, and waived for them the one quarter which was the share of the dead man himself.
The narrations of Khilas from Ali (may Allah be pleased with him) are not used as evidence because they are mursal (with a break in the chain). And this is upon their 'aqilahs, if the collapse of part of it was due to their own act.

Imam al-Sha'bi (may Allah have mercy on him) narrates that Sayyiduna Ali (may Allah be pleased with him) ruled two-thirds of the blood money concerning the one who pinched, the one who bucked, and the one who died of a broken neck. Ibn Abi Za'idah explains it in detail: three girls were playing together. One of them climbed onto another, and the third pinched the one being ridden upon; she bucked, so the one on top fell and her neck broke. So Sayyiduna Ali (may Allah be pleased with him) ruled two-thirds of the blood money in this matter, and because the girl who died had herself contributed to it, he waived her one-third (thulth) share.

Musa bin Ali bin Rabah al-Lakhmi says that he heard his father (say that) a blind man was reciting these verses in the time of Sayyiduna Umar (may Allah be pleased with him): "O people, I have come across something strange: will the blind man pay the blood money of the sound man? They fell together and he broke him." This was that a blind man and a sound (sighted) man came to a well and fell into it; the blind man fell on top of the sound man, and the sighted man died. So Sayyiduna Umar (may Allah be pleased with him) ruled that the blind man pay the blood money of the sighted man.
