Imam al-Rabi' (may Allah have mercy on him) said: I asked Imam al-Shafi'i (may Allah have mercy on him): Do you narrate any report with a high (short) chain on this matter? He said: "Nothing whose like is established." I said: What is the report? He said: "A trustworthy narrator informed me from Abu al-Zinad that the Prophet (peace and blessings be upon him) said: 'For an ostrich egg that a person in ihram breaks, its value is due.'" I said: This report has also been narrated mawsulan (with a connected chain), but there is disagreement about it (its chain).

Ibn Jurayj (may Allah have mercy on him) said: The best I have heard about ostrich eggs is the hadith of Abu al-Zinad, from al-A'raj, from Sayyiduna Abu Hurayrah (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said: "For every egg, a day's fast or feeding one poor person."

It is narrated from Sayyidah Aishah (may Allah be pleased with her) that the Prophet (peace and blessings be upon him) ruled, concerning ostrich eggs that a man in ihram had broken, a day's fast for every egg.
The Shaykh said: Abu Qurrah Musa bin Tariq narrated it this way from Ibn Jurayj, whereas Abu Asim and Hisham bin Sulayman narrated it from Abd al-Aziz bin Abi Rawwad, from Ibn Jurayj, from Ziyad bin Sa'd, from Abu al-Zinad, from a man, from Sayyidah Aishah (may Allah be pleased with her); and that is the correct version, as Abu Dawud al-Sijistani and other hadith masters said.

Mu'awiyah bin Qurrah narrates from a man of the Ansar that the mount of a man in ihram trampled a nest of ostrich eggs. The man went to Ali (may Allah be pleased with him) and asked him about it. Ali (may Allah be pleased with him) said: For every egg you owe the mating of a she-camel, or the foetus of a she-camel. The man went to the Prophet (peace and blessings be upon him) and told him what Ali (may Allah be pleased with him) had said. The Prophet (peace and blessings be upon him) said: "You have heard what Ali (may Allah be pleased with him) said; but come to the concession: for every egg you owe a day's fast or feeding one poor person."

Abd al-Wahhab (may Allah have mercy on him) said: Sa'id (may Allah have mercy on him) was asked about ostrich eggs that a person in ihram damages, and he narrated it to us from Matar, mentioning it with the same meaning.
This is the preserved (mahfuz) version. It has also been reported: from Mu'awiyah bin Qurrah, from Abd al-Rahman bin Abi Layla, from Sayyiduna Ali (may Allah be pleased with him).

It is narrated from Sayyiduna Ka'b bin Ujrah (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) gave the ruling: "When a person in ihram takes ostrich eggs, their price shall be imposed on him in compensation."

Ubaydullah bin al-Husayn narrates from Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) that when a person in ihram takes ostrich eggs, then for each egg he should fast one day or feed one poor person.

Ata (may Allah have mercy on him) narrates from Ibn Abbas (may Allah be pleased with them both) that he set one dirham as the penalty for every two eggs of the pigeons of the sanctuary.
(b) Imam al-Shafi'i (may Allah have mercy on him) narrated it through Ibn Jurayj as the saying of Ata (may Allah have mercy on him) himself, then he said: I think that by this saying Ata meant the value as it was on the day he said it.

Al-Hasan (may Allah have mercy on him) narrates from Sayyiduna Ali (may Allah be pleased with him), concerning someone who broke ostrich eggs, that he should have she-camels mated in the number of the eggs. It was said to him: What if one of the she-camels miscarries? He said: Some eggs also turn out spoiled.
Imam al-Shafi'i (may Allah have mercy on him) said: Neither we, nor the people of Iraq, nor anyone we know of adopts this view; we say that he pays its price as compensation. Imam al-Shafi'i (may Allah have mercy on him) said in Kitab al-Manasik: They narrated this from Ali (may Allah be pleased with him) through a route whose like the scholars of hadith do not accept as established; that is why we have left it, and because one who owes something is not discharged by something hidden that may or may not come to be; rather, only something present suffices for him.
The Shaykh said: In what I have cited, al-Hasan's hearing from Ali (may Allah be pleased with him) is not (established), and the hadith of Mu'awiyah bin Qurrah is munqati' (broken); in it, it is narrated that this happened in the time of the Prophet (peace and blessings be upon him), and that the Prophet (peace and blessings be upon him) referred the questioner to a day's fast or feeding one poor person.
