Al-Hasan (may Allah have mercy on him) narrates from Sayyiduna Ali (may Allah be pleased with him), concerning someone who broke ostrich eggs, that he should have she-camels mated in the number of the eggs. It was said to him: What if one of the she-camels miscarries? He said: Some eggs also turn out spoiled.
Imam al-Shafi'i (may Allah have mercy on him) said: Neither we, nor the people of Iraq, nor anyone we know of adopts this view; we say that he pays its price as compensation. Imam al-Shafi'i (may Allah have mercy on him) said in Kitab al-Manasik: They narrated this from Ali (may Allah be pleased with him) through a route whose like the scholars of hadith do not accept as established; that is why we have left it, and because one who owes something is not discharged by something hidden that may or may not come to be; rather, only something present suffices for him.
The Shaykh said: In what I have cited, al-Hasan's hearing from Ali (may Allah be pleased with him) is not (established), and the hadith of Mu'awiyah bin Qurrah is munqati' (broken); in it, it is narrated that this happened in the time of the Prophet (peace and blessings be upon him), and that the Prophet (peace and blessings be upon him) referred the questioner to a day's fast or feeding one poor person.
