أخبرنا أبو النَّضر محمد بن محمد الفقيه وأبو إسحاق إبراهيم بن إسماعيل القارئ، قالا: حدثنا عثمان بن سعيد الدارِمي، حدثنا عبد الله بن صالح، حدثني الليث بن سعد، عن عمر بن عيسى القُرشي ثم الأَسَدي، عن ابن جريج، عن عطاء بن أبي رباح، عن ابن عبّاس قال: جاءت جاريةٌ إلى عمر بن الخطاب فقالت: إنَّ سيِّدي اتَّهَمني فأقعَدَني على النار حتى احترقَ فَرْجي. فقال عمر: هل رأَى ذلك عليكِ؟ قالت: لا، قال: فاعتَرفتِ له بشيء؟ قالت: لا، قال عمر: عليَّ به، فلما رأى عمرُ الرجلَ، قال: أتعذِّبُ بعذابِ الله؟! قال: يا أمير المؤمنين، اتَّهمتُها في نفسِها، قال: رأيتَ ذلك عليها؟ قال الرجل: لا، قال: فاعتَرفَتْ لك بذلك؟ قال: لا، قال: والذي نفسي بيده لو لم أسمَعْ رسولَ الله ﷺ يقول: "لا يُقادُ مملوكٌ مِن مالِكِه، ولا ولدٌ من والدِه"، لأقَدْتُها منكَ، فبرَّزَه وضربَه مئةَ سوطٍ، ثم قال: اذهبي فأنتِ حُرَّة لوجه الله، وأنتِ مولاةُ الله ورسوله (1). قال أبو صالح: قال الليث: هذا معمولٌ به.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a slave-girl came to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) and said: My master accused me and made me sit on fire until my private parts were burned. Sayyiduna Umar (may Allah be pleased with him) asked: Did anyone see this (the thing he accused you of) on you? She said: No. He asked: Did you confess any crime before him? She said: No. Sayyiduna Umar (may Allah be pleased with him) ordered: Bring him to me. When the man came, he said: Do you punish with a punishment like the punishment of Allah?! He said: O Commander of the Faithful, I suspected her conduct. He asked: Did you see her do anything? He said: No. He asked: Did she confess? He said: No. Then Sayyiduna Umar (may Allah be pleased with him) said: By the One in whose Hand is my soul! Had I not heard the Messenger of Allah (peace and blessings be upon him) say: "A slave shall not be given retaliation against his master, nor a child against his father," I would certainly have taken retaliation from you for this slave-girl. Then he had him stand before everyone and had him given a hundred lashes, and he said to the slave-girl: Go, you are free for the sake of Allah, and you are the freedwoman (mawlah) of Allah and His Messenger.

أخبرَناه أبو جعفر بن دُحَيم، حدثنا أحمد بن حازم بن أبي غَرَزة، حدثنا مالك بن إسماعيل، حدثنا أبو شِهاب عبدُ ربِّه بن نافع عن حمزة الجَزَري، عن عمرو بن دينار، عن ابن عمر، عن عمر قال: قال رسول الله ﷺ: "مَن مَثَّل بعبدِه فهو حُرٌّ، وهو مولى اللهِ ورسولِه" (1).

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates from his father Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever mutilates his slave by cutting off a limb, the slave is free, and he is the freedman (mawla) of Allah and His Messenger."
وأخبرنا أبو جعفر بن دُحَيم، حدثنا أحمد بن حازم، حدثنا عاصم بن يوسف اليَربُوعي، حدثنا عبثر بن القاسم، حدثنا حُصَين، عن هِلال بن يِسَاف، قال: كُنَّا نزولًا في دار سُوَيد بن مُقرِّن ومعنا شيخ حَديدٌ جاهلٌ، فلا أدري ما قالت وَليدةُ سُوَيد فلَطَمَها، فغضب من ذلك غضبًا ما غَضِبَ مثلَه قَطُّ، قال: عَجَزَ عليك إِلَّا حُرُّ وجهِها؟ لقد رأيتُني سابعَ سبعةٍ من بني مُقرِّن ما لنا إلَّا خادمٌ واحدٌ، فَلَطَمَها أصغرُنا، فأمرَنا رسولُ الله ﷺ أن نُعتِقَها (2).

It is narrated from Hilal bin Yasaf that he said: We were staying in the house of Sayyiduna Suwayd bin Muqarrin (may Allah be pleased with him), and with us was a hot-tempered and ignorant old man. I do not know what Sayyiduna Suwayd's slave-girl said, but that man slapped her. At this Sayyiduna Suwayd (may Allah be pleased with him) became so intensely angry that I had never before seen him so angry. He said (to that old man): "Could you find no other place to strike but her face? I have seen the time when we of Banu Muqarrin were seven brothers and had only one maidservant, and then the youngest of us slapped her, so the Messenger of Allah (peace and blessings be upon him) ordered us to set her free."
