Mustadrak al-Hakim — Hadith 8302

وأخبرنا أبو جعفر بن دُحَيم، حدثنا أحمد بن حازم، حدثنا عاصم بن يوسف اليَربُوعي، حدثنا عبثر بن القاسم، حدثنا حُصَين، عن هِلال بن يِسَاف، قال: كُنَّا نزولًا في دار سُوَيد بن مُقرِّن ومعنا شيخ حَديدٌ جاهلٌ، فلا أدري ما قالت وَليدةُ سُوَيد فلَطَمَها، فغضب من ذلك غضبًا ما غَضِبَ مثلَه قَطُّ، قال: عَجَزَ عليك إِلَّا حُرُّ وجهِها؟ لقد رأيتُني سابعَ سبعةٍ من بني مُقرِّن ما لنا إلَّا خادمٌ واحدٌ، فَلَطَمَها أصغرُنا، فأمرَنا رسولُ الله ﷺ أن نُعتِقَها (2).

It is narrated from Hilal bin Yasaf that he said: We were staying in the house of Sayyiduna Suwayd bin Muqarrin (may Allah be pleased with him), and with us was a hot-tempered and ignorant old man. I do not know what Sayyiduna Suwayd's slave-girl said, but that man slapped her. At this Sayyiduna Suwayd (may Allah be pleased with him) became so intensely angry that I had never before seen him so angry. He said (to that old man): "Could you find no other place to strike but her face? I have seen the time when we of Banu Muqarrin were seven brothers and had only one maidservant, and then the youngest of us slapped her, so the Messenger of Allah (peace and blessings be upon him) ordered us to set her free."

Grading: Its chain is "sahih". Husayn is "Husayn bin Abd al-Rahman al-Sulami".
وأخرجه أحمد 39/ (23741) و (23742)، ومسلم (1658) (32)، وأبو داود (5166)، والترمذي (1542)، والنسائي (4994) من طرق عن حصين بن عبد الرحمن، بهذا الإسناد.
Reference / Source: Ahmad (39/23741, 23742), Muslim (1658/32), Abu Dawud (5166), al-Tirmidhi (1542) and al-Nasa'i (4994) narrated it through various routes from Husayn bin Abd al-Rahman, with this same chain.
وقال الترمذي: حسن صحيح.
Grading: Imam al-Tirmidhi said: This hadith is "hasan sahih".
وأخرجه أحمد 24/ (15705) و 39 / (23740)، ومسلم (1658) (31)، وأبو داود (5167)، والنسائي (4992) من طريق معاوية بن سويد قال: لطمتُ مولى لنا فهربتُ، ثم جئت قبيل الظهر، فصلَّيت خلف أَبي، فدعاه ودعاني، ثم قال: امتثِلْ منه، فعفا، ثم قال: كنا بني مقرِّن على عهد رسول الله ﷺ ليس لنا إلا خادم واحدة، فلَطَمَها أحدنا، فبلغ ذلك النبي ﷺ، فقال: "أعتِقوها" قالوا: ليس لهم خادم غيرها، قال: "فليستخدِموها، فإذا استَغنَوا عنها فليُخلوا سبيلها".

Details of the narration: Mu'awiyah says: I slapped a slave of ours and ran away, then I came back shortly before Zuhr and prayed behind my father. He called him and called me, then said (to him): "Take retaliation from him." But he forgave. Then my father said: We, the "Banu Muqarrin", in the time of the Messenger of Allah (peace and blessings be upon him), had only one female servant, and one of us slapped her. This reached the Prophet (peace and blessings be upon him), and he said: "Set her free." They said: They have no servant other than her. He (peace and blessings be upon him) said: "Then let them make use of her service, and when they no longer need her (or find an alternative), let them release her (set her free)."
وأخرجه أحمد 24/ (15703)، ومسلم (1658) (33)، والنسائي (4993) من طريق أبي شعبة العراقي، عن سويد بن مقرِّن، أنَّ جارية له لطمها إنسان، فقال له سويد: أما علمتَ أنَّ الصورة محرّمة، فقال: لقد رأيتني وإني لسابع إخوة لي مع رسول الله ﷺ، وما لنا خادم غير واحد، فعمد أحدنا فلطمه، فأمرنا رسول الله ﷺ أن نعتقه.

Details of the narration: Someone slapped a slave-girl of his, so Suwayd said to him: "Do you not know that (striking) the face is forbidden?" Then he said: "I saw myself as the seventh of seven brothers in the time of the Messenger of Allah (peace and blessings be upon him), and we had only one servant; one of us (in anger) slapped him, and the Messenger of Allah (peace and blessings be upon him) ordered us to set him free."
وأخرجه النسائي (4990) من طريق أبي عوانة، عن مطرف عن الشعبي، عن معاوية بن سويد، فذكره مرسلًا.
Reference / Source: Al-Nasa'i (4990) narrated it through the route of Abu Awanah, from Mutarrif, from al-Sha'bi, from Mu'awiyah bin Suwayd, and mentioned it as "mursal".
وخالف أسباطُ بن محمد أبا معاوية في إسناده فرواه عند النسائي أيضًا (4991) عن مطرف، عن أبي السفر، عن معاوية بن سويد، فذكره مرسلًا.
Technical note / Defect ('illah): Asbat bin Muhammad contradicted Abu Mu'awiyah in its chain: in al-Nasa'i (4991) he narrated it from Mutarrif, from Abu al-Safar, from Mu'awiyah bin Suwayd, and he too mentioned it as "mursal".
وفي الباب عند مسلم (1657) وغيره عن ابن عمر مرفوعًا: "من لطم مملوكه، أو ضربه، فكفّارته أن يُعتقه".
Corroborating chains and supporting reports: On this topic it is narrated in Sahih Muslim (1657) and elsewhere from Ibn Umar (may Allah be pleased with him), as marfu': "Whoever slaps his slave or beats him (unjustly), his expiation is to set him free."
