Mustadrak al-Hakim — Hadith 8301

أخبرَناه أبو جعفر بن دُحَيم، حدثنا أحمد بن حازم بن أبي غَرَزة، حدثنا مالك بن إسماعيل، حدثنا أبو شِهاب عبدُ ربِّه بن نافع عن حمزة الجَزَري، عن عمرو بن دينار، عن ابن عمر، عن عمر قال: قال رسول الله ﷺ: "مَن مَثَّل بعبدِه فهو حُرٌّ، وهو مولى اللهِ ورسولِه" (1).

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) narrates from his father Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever mutilates his slave by cutting off a limb, the slave is free, and he is the freedman (mawla) of Allah and His Messenger."

(1) إسناده تالف، حمزة الجزري - وهو حمزة بن أبي حمزة الجعفي النَّصيبي - متهم بالوضع، وبه أعلَّه الذهبي في "التلخيص".
Grading: Its chain is "talif" (ruined, of the most severe weakness).
Technical note / Defect ('illah): Hamzah al-Jazari, who is Hamzah bin Abi Hamzah al-Ju'fi al-Nasibi, is accused of fabricating hadith. For this reason al-Dhahabi declared it defective in "al-Talkhis".
وأخرجه ابن عدي في "الكامل" 2/ 377 من طريق عاصم بن يوسف، عن عبد ربه بن نافع به.
Reference / Source: Ibn Adi narrated it in "al-Kamil" (2/377) through the route of Asim bin Yusuf, from Abd Rabbih bin Nafi', in the same way.
وأخرج عبد الرزاق (17929) عن الثوري، عن يونس بن عبيد، عن الحسن: أَنَّ رجلًا كَوَى غلامًا له بالنار، فأعتقه عمر. ورجاله ثقات لكن رواية الحسن عن عمر منقطعة.
Reference / Source: Abd al-Razzaq (17929) narrated from al-Thawri, from Yunus bin Ubayd, from al-Hasan (al-Basri): "A man branded his slave with fire, so Umar (may Allah be pleased with him) set him free."
Technical note / Defect ('illah): Its narrators are trustworthy, but the narration of al-Hasan (al-Basri) from Umar (may Allah be pleased with him) is "munqati'" (disconnected).
ويغني عنه ما رواه أحمد 11/ (6710) من طريق عمرو بن شعيب، عن أبيه، عن جده عبد الله بن عمرو: أَنَّ زِنباعًا أبا رَوْح وجد غلامًا له مع جارية له، فجَدَعَ أنفَه وجبَّه، فأتى النبي ﷺ، فقال: "مَن فعل هذا بك؟ " قال: زنباع، فدعاه النبي ﷺ، فقال: "ما حَمَلَك على هذا؟ " فقال: كان من أمره كذا وكذا، فقال النبي ﷺ للعبد: "اذهبْ فأنت حرٌّ". وهو حديث حسن كما هو مبين في "المسند"، وانظر هناك شواهدَ له.
Corroborating chains and supporting reports: What makes it (this weak narration) unnecessary is the narration which Ahmad (11/6710) transmitted through the route of Amr bin Shu'ayb, from his father, from his grandfather Abdullah bin Amr (may Allah be pleased with him): A man named Zinba' Abu Rawh found his slave with his slave-girl, so he cut off the slave's nose and castrated him. The slave came to the Prophet (peace and blessings be upon him), who asked: "Who did this to you?" He said: Zinba'. He (peace and blessings be upon him) called him and said: "What drove you to this?" He said: His situation was such-and-such (and gave the reason). So the Prophet (peace and blessings be upon him) said to the slave: "Go, you are free."
Grading: This hadith is "hasan", as is explained in "al-Musnad"; see its supporting reports there too.
