Mustadrak al-Hakim — Hadith 8303

أخبرنا أبو بكر بن إسحاق، أخبرنا عُبيد بن شَريك، حدثنا أبو الجُماهِر محمد بن عثمان، حدثنا سعيد بن بَشِير، حدثنا عمرو بن دينار، عن طاووس، عن ابن عبّاس قال: قال رسول الله ﷺ: "لا يُقاد والدٌ بولدِه، ولا تُقامُ الحدودَ في المساجد" (1)

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "A father shall not be subjected to retaliation for killing his child, nor shall the prescribed punishments be carried out in the mosques."

(1) حسن بطرقه وشواهده، وهذا إسناد ضعيف من أجل سعيد بن بشير، وقد توبع. وقال ابن عبد البر في "التمهيد" 23/ (437) عن حديث النهي عن قَوَد الوالد بالولد: حديث مشهور عند أهل العلم بالحجاز والعراق مستفيض عندهم، يُستغنَي بشهرته وقَبوله والعمل به عن الإسناد فيه، حتى يكاد أن يكون الإسناد في مثله لشهرته تكلفًا.
Grading: This hadith is "hasan" by virtue of its routes and supporting reports, (although) this particular chain is "da'if" because of Sa'id bin Bashir; but he has been corroborated.
General principle: Ibn Abd al-Barr said in "al-Tamhid" (23/437) regarding the hadith "no retaliation is taken from a father for his son": "This hadith is well known (mashhur) and widespread (mustafid) among the people of knowledge in the Hijaz and Iraq. Due to its fame, acceptance and being acted upon, it no longer needs a chain, to the extent that citing a chain for something (so well known) like it almost seems an affectation."
قلنا: ولم نقف عليه من طريق أبي الجماهر، وخالفه أبو المغيرة عبد القدوس بن الحجاج، فرواه عن سعيد بن بشير عن قتادة عن عمرو بن دينار به عند البزار في "مسنده" (4834) - ومن طريقه ابن حزم في "المحلى" 11/ 123 - وابن خُزَيمة في "فوائد الفوائد" (7)، والدارقطني (3279)، فزاد في إسناده قتادةَ بين سعيد بن بشير وعمرو بن دينار. وكلٌّ من أبي الجماهر وأبي المغيرة ثقة، فالوهم من سعيد بن بشير نفسه، ويحتمل أن يكون رواه عن قتادة ثم سمعه من عمرو بن دينار، فقد روى سعيدٌ عن كليهما، والله أعلم.
Technical note / Defect ('illah): We say: We have not found this narration through the route of Abu al-Jamahir. Abu al-Mughirah Abd al-Quddus bin al-Hajjaj contradicted him: he narrated it from Sa'id bin Bashir, from Qatadah, from Amr bin Dinar. Al-Bazzar narrated it in his "Musnad" (4834), and through his route Ibn Hazm in "al-Muhalla" (11/123), Ibn Khuzaymah in "Fawa'id al-Fawa'id" (7) and al-Daraqutni (3279). He added "Qatadah" to the chain between Sa'id bin Bashir and Amr bin Dinar. Abu al-Jamahir and Abu al-Mughirah are both trustworthy, so the mistake is from Sa'id bin Bashir himself; it is also possible that he narrated it (first) from Qatadah and then heard it (directly) from Amr bin Dinar, since Sa'id narrates from both of them. And Allah knows best.
وتابعه إسماعيل بن مسلم المكي عن عمرو بن دينار به. أخرجه ابن ماجه (2599) و (2661)، والترمذي (1401). وإسماعيل هذا ضعيف، وقال الترمذي: حديث لا نعرفه بهذا الإسناد مرفوعًا إلَّا من حديث إسماعيل بن مسلم! وإسماعيلُ بن مسلم المكي قد تكلَّم فيه بعض أهل العلم من قبل حفظه.
Corroborating chains and supporting reports: Isma'il bin Muslim al-Makki corroborated him in narrating from Amr bin Dinar. Ibn Majah (2599, 2661) and al-Tirmidhi (1401) narrated it.
Grading: This Isma'il is "da'if" (weak). Imam al-Tirmidhi said: "We do not know it as marfu' with this chain except as the hadith of Isma'il bin Muslim!" And some of the people of knowledge have criticised Isma'il bin Muslim al-Makki on account of his memory.
وتابعهما عبيدُ الله بن الحسن العنبري عن عمرو بن دينار به. أخرجه الدارقطني (3279)، والبيهقي 8/ 39 من طريق أبي حفص التمار عمر بن عامر السعدي عنه. والتمار ترجمه الذهبي في "الميزان"، وقال: روى حديثًا باطلًا.
Corroborating chains and supporting reports: Ubaydullah bin al-Hasan al-Anbari corroborated the two of them, narrating from Amr bin Dinar. Al-Daraqutni (3279) and al-Bayhaqi (8/39) narrated it from him via Abu Hafs al-Tammar Umar bin Amir al-Sa'di.
Technical note / Defect ('illah): Al-Dhahabi gave a biography of (the narrator) al-Tammar in "al-Mizan" and said: "He narrated a false (batil) hadith."
وخالفهم يحيى بن العلاء البجلي ومحمد بن مسلم الطائفي عند عبد الرزاق (1710)، فروياه عن عمرو بن دينار، عن طاووس مرسلًا قال: قال رسول الله ﷺ: "لا تقام الحدود في المساجد".
Technical note / Defect ('illah): Yahya bin al-Ala' al-Bajali and Muhammad bin Muslim al-Ta'ifi contradicted all of them, as found in Abd al-Razzaq (1710): the two of them narrated it from Amr bin Dinar, from Tawus, as "mursal", that the Messenger of Allah (peace and blessings be upon him) said: "The prescribed punishments are not to be carried out in the mosques."
ويحيى البجلي تالف فلا يفرح به، لكن متابعه محمد الطائفي صدوق حسن الحديث.
Grading: Yahya al-Bajali is a "talif" (ruined, extremely weak) narrator, so there is nothing to be pleased about in him (i.e., he is not relied on); but the one who corroborates him, Muhammad al-Ta'ifi, is "saduq" (truthful) and "hasan al-hadith".
وأخرجه مقطوعًا عبد الرزاق (1708) عن ابن جريج قال: قال لي عمرو بن دينار: سمعنا أنه يُنهى أن يضرب في المسجد.
Reference / Source: Abd al-Razzaq (1708) narrated it as "maqtu'" (a saying of a Successor) from Ibn Jurayj, who said: Amr bin Dinar said to me: "We heard that striking (punishing) in the mosque is forbidden."
وأخرجه عبد الرزاق (1709) عمّن أخبره أنه سمع عمرو بن دينار يحدّث عن نافع بن جبير بن مطعم قال: نهى رسول الله ﷺ أن تُنشد الأشعار، وأن تستقاد الجِراحات، وأن تقام الحدود في المسجد. فغيّر هذا المبهم في إسناده وأرسله.
Reference / Source: Abd al-Razzaq (1709) narrated it from someone who told him that he heard Amr bin Dinar narrating from Nafi' bin Jubayr bin Mut'im, who said: "The Messenger of Allah (peace and blessings be upon him) forbade that poetry be recited, that retaliation be taken for wounds, or that the prescribed punishments be carried out in the mosque."
Technical note / Defect ('illah): This unnamed narrator changed the chain and made it "mursal".
ويشهد للنهي عن قتل الوالد بولده حديثُ عمر بن الخطاب السالف برقم (8300).
Corroborating chains and supporting reports: For the prohibition of killing a father for his son, the hadith of Umar bin al-Khattab (may Allah be pleased with him), which passed at no. (8300), serves as a supporting report.
وفي باب النهي عن إقامة الحدود في المساجد عن حَكيم بن حزام سيأتي برقم (8337)، وإسناده ضعيف، وله شواهد ذُكرت في "مسند أحمد" 24/ (15579)، وكلها متكلَّم فيها، وبمجموعها حسَّنه بعض أهل العلم.
Corroborating chains and supporting reports: On the topic of the prohibition of carrying out prescribed punishments in mosques, the narration of Hakim bin Hizam comes at no. (8337); its chain is "da'if", but its supporting reports are mentioned in "Musnad Ahmad" (24/15579); all of them are criticised, yet taken together some of the people of knowledge have graded it "hasan".
وله إسناد صحيح من فعل عمر ﵁، أخرجه عبد الرزاق (1706)، وابن أبي شيبة 10/ 42 من طريق سفيان الثوري، عن قيس بن مسلم، عن طارق بن شهاب قال: أُتي عمرُ برجل في شيء، فقال: أخرِجاه من المسجد فاضرباه.
Grading: There is a "sahih chain" for it from the practice of Umar (may Allah be pleased with him).
Reference / Source: Abd al-Razzaq (1706) and Ibn Abi Shaybah (10/42) narrated it through the route of Sufyan al-Thawri, from Qays bin Muslim, from Tariq bin Shihab: A man was brought to Umar (may Allah be pleased with him) over some matter, and he said: "Take him out of the mosque, both of you, and (then) flog him."
وأخرج ابن أبي شيبة 10/ 42 عن أبي خالد الأحمر، عن أشعث بن سوّار، عن فضيل بن زيد الرَّقاشي، عن عبد الله بن مغفل: أنَّ رجلًا جاء إلى علي فسارَّه، فقال: يا قنبر، أخرِجه من المسجد، فأقم عليه الحدَّ. وسنده حسن في المتابعات والشواهد.
Reference / Source: Ibn Abi Shaybah (10/42) narrated from Abu Khalid al-Ahmar, from Ash'ath bin Sawwar, from Fudayl bin Zayd al-Raqashi, from Abdullah bin Mughaffal: A man came to Ali (may Allah be pleased with him) and spoke to him privately (confessing a crime), so he said: "O Qanbar, take him out of the mosque and carry out the hadd on him."
Grading: In corroborating and supporting reports its chain is "hasan".
