Mustadrak al-Hakim — Hadith 8304

حدثنا أبو بكر بن إسحاق، أخبرنا عبد الله بن أحمد بن حنبل ومحمد بن أيوب وأبو جعفر الحَضرَمي، قالوا: أخبرنا أبو كُرَيب، حدثنا عبد الله بن إدريس، عن عُبيد الله بن عمر، عن ابن عمر: أنَّ النبيَّ ﷺ ضَرَبَ وغَرَّبَ [وأنَّ أبا بكر ضَرَبَ وغَرَّبَ] (1) وأنَّ عمرَ ضَرَبَ وغَرَّبَ (2).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) flogged (the one guilty of fornication) and exiled him, and indeed Abu Bakr al-Siddiq (may Allah be pleased with him) also flogged and exiled, and likewise Umar al-Faruq (may Allah be pleased with him) also flogged and exiled.
This hadith is sahih on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Note / Clarification: The wording between the square brackets was not present in the handwritten manuscripts; we recorded it from "al-Talkhis" and from the sources that transmit the hadith.

(2) صحيح موقوفًا، وهذا إسناد رجاله ثقات، لكن اختلف على عبد الله بن إدريس في رفعه ووقفه كما سيأتي، ورواه أصحاب عبيد الله بن عمر فوقفوه، وتابع عبيدَ الله بن عمر على وقفه أيضًا محمد بن إسحاق قاله الترمذي في "العلل الكبير" (413)، فرفعه خطأ كما قال أبو حاتم في "العلل" لابنه (1382)، وصوّب وقفه الدارقطني في "العلل" (2752)، والخطيب في "تاريخ بغداد" 16/ 282.
Grading: It is "sahih as mawquf", and all the narrators of this chain are trustworthy (thiqah).
Technical note / Defect ('illah): However, there is disagreement from Abdullah bin Idris over whether it is marfu' or mawquf, as will come. The students of Ubaydullah bin Umar narrated it as "mawquf", and Muhammad bin Ishaq also corroborated Ubaydullah bin Umar in narrating it as mawquf, as al-Tirmidhi said in "al-'Ilal al-Kabir" (413). Therefore narrating it as marfu' is a "mistake", as Abu Hatim said in his son's book "al-'Ilal" (1382). Al-Daraqutni in "al-'Ilal" (2752) and al-Khatib in "Tarikh Baghdad" (16/282) held its being mawquf to be correct.
أما الذين رووه مرفوعًا عن عبد الله بن إدريس، فهم: أبو كريب محمد بن العلاء عند الترمذي في "جامعه" (1438) - وقال: غريب - وفي "العلل الكبير" (413)، والنسائي (7302)، ويحيى بن أكثَم عند الترمذي في "جامعه" (1438) وفي "العلل الكبير" (413)، والخطيب في "تاريخ بغداد" 16/ 282، ومسروقُ بن المَرزُبان فيما قاله الدارقطني في "العلل" (2752)، وأبو ميسرة أحمد بن عَبد الله عند ابن عدي في "الكامل" 1/ 176، وجحدر بن الحارث عند ابن عدي أيضًا 4/ 320. قال الترمذي: حديث ابن عمر حديث غريب، رواه غير واحد عن عبد الله بن إدريس فرفعوه، وروى بعضهم عن عبد الله بن إدريس هذا الحديث موقوفًا، وهكذا روي هذا الحديث من غير رواية ابن إدريس عن عبيد الله بن عمر نحو هذا، وهكذا رواه محمد بن إسحاق عن نافع عن ابن عمر موقوفًا. ونقل الخطيب عن أبي بكر الميانجي قوله: وهذا الحديث إنما هو معروف عن أبي كريب، وإنه المنفرد به. ثم نقل الخطيب مضمون كلام الدارقطني.
Technical note / Defect ('illah): Those who narrated it from Abdullah bin Idris as "marfu'" are: (1) Abu Kurayb Muhammad bin al-Ala' [al-Tirmidhi (1438), al-'Ilal al-Kabir (413), al-Nasa'i (7302)], (2) Yahya bin Aktham [al-Tirmidhi (1438), al-'Ilal al-Kabir (413), Tarikh Baghdad (16/282)], (3) Masruq bin al-Marzuban [al-'Ilal of al-Daraqutni (2752)], (4) Abu Maysarah Ahmad bin Abdullah [al-Kamil of Ibn Adi (1/176)], and (5) Jahdar bin al-Harith [al-Kamil of Ibn Adi (4/320)]. Imam al-Tirmidhi says: "The hadith of Ibn Umar is gharib. More than one narrator narrated it from Abdullah bin Idris as marfu', while some narrated it from Abdullah bin Idris as mawquf. This hadith is also narrated as mawquf from Ubaydullah bin Umar by others besides Ibn Idris, and likewise Muhammad bin Ishaq narrated it from Nafi', from Ibn Umar, as mawquf." Al-Khatib quoted Abu Bakr al-Mayanji as saying: "This hadith is only known from Abu Kurayb, and he is alone in it." Then al-Khatib quoted the substance of al-Daraqutni's statement.
قلنا: أما محمد بن العلاء، فثقة حافظ من رجال الشيخين.
Grading: We (the editors) say: Muhammad bin al-Ala' is a trustworthy hafiz and one of the narrators of the two Shaykhs (al-Bukhari and Muslim).
وأما مسروق بن المرزبان، فقال أبو حاتم: ليس بقوي، يكتب حديثه، وقال صالح جزرة: صدوق.
Grading: Regarding Masruq bin al-Marzuban, Abu Hatim said: "He is not strong; (however) his hadith is written down." Salih Jazarah said: He is "saduq" (truthful).
وأما يحيى بن أكثم فقد تكلموا فيه، قال أبو حاتم فيه نَظَر، وقال ابن معين: كان يكذب، وقال أبو عاصم النبيل: يحيى بن أكثم كذاب (تحرَّفت في "تهذيب الكمال" إلى: كتاب)، وقال ابن الجنيد: كان يسرق الحديث، وقال الذهبي في "تاريخ الإسلام" ضعفوه في الحديث.
Grading: Yahya bin Aktham has been criticised: Abu Hatim said: "There is something questionable about him (fihi nazar)." Ibn Ma'in said: "He used to lie." Abu Asim al-Nabil said: "Yahya bin Aktham is a liar (kadhdhab)" (in "Tahdhib al-Kamal" this word has been corrupted into "kitab"). Ibn al-Junayd said: "He used to steal hadith." Al-Dhahabi said in "Tarikh al-Islam": "They declared him weak in hadith."
وأما أبو ميسرة، فقال ابن عدي: حدّث عن الثقات بالمناكير، ويحدث عمن لا يُعرف، ويسرق حديث الناس. ثم قال: سرق هذا الحديثَ جماعةٌ من الضعفاء مثل جحدر الكفرتوثي - واسمه عبد الرحمن بن الحارث - والسري بن عاصم وأبي ميسرة الهمذاني.
Grading: Regarding Abu Maysarah, Ibn Adi said: "He narrates munkar reports from trustworthy narrators, narrates from people who are not known, and steals people's hadith." Then he said: "A group of weak narrators stole this hadith, such as Jahdar al-Kafartuthi (whose name is Abd al-Rahman bin al-Harith), al-Sari bin Asim and Abu Maysarah al-Hamadhani."
وكأنَّ الدارقطني لم يعتبر بمن رواه غير أبي كريب، فقال فيما رواه عنه الخطيب في "تاريخ بغداد" 13/ 558 - بعدما أخرجه من طريق أبي كريب - قال: لم يسنده أحد من الثقات غير أبي كريب، ووقفه أبو سعيد الأشج وغيره.
Technical note / Defect ('illah): It is as though al-Daraqutni did not take into account anyone other than Abu Kurayb who narrated it. Al-Khatib in "Tarikh Baghdad" (13/558) quoted from him, after transmitting the hadith through the route of Abu Kurayb, that al-Daraqutni said: "None of the trustworthy narrators narrated it with a full chain (as marfu') except Abu Kurayb, while Abu Sa'id al-Ashajj and others narrated it as mawquf."
وأما من رواه موقوفًا من فعل أبي بكر وعمر، فهما: أبو سعيد الأشج في "حديثه" (106)، وعنه الترمذي في "جامعه" بإثر (1438)، ومحمد بن عبد الله بن نمير فيما قاله الدارقطني في "العلل"، كلاهما (الأشج وابن نمير) عن عبد الله بن إدريس، به - ليس فيه ذكر النبي ﷺ.
Details of the narration: Those who narrated it as "mawquf" (as the practice of Abu Bakr and Umar) are: Abu Sa'id al-Ashajj in "Hadithuhu" (106), and from him al-Tirmidhi in "al-Jami'" (after 1438), and Muhammad bin Abdullah bin Numayr (as al-Daraqutni said in "al-'Ilal"). Both of them (al-Ashajj and Ibn Numayr) narrate it from Abdullah bin Idris with this same chain, and it contains no mention of the Prophet (peace and blessings be upon him).
