Mustadrak al-Hakim — Hadith 8305

حدثني أبو بكر محمد بن أحمد بن بالَوَيِه، حدَّثنا محمد بن أحمد بن النَّضر الأزدي، حدَّثنا معاوية بن عمرو، حدَّثنا زائدة، عن السُّدّي، عن سعد بن عُبيدة، عن أبي عبد الرحمن السُّلَمي، قال: خَطَبَ عليٌّ فقال: يا أيها الناس، أقِيمُوا الحدود على أرقَّائِكم، مَن أحصَنَ منهنَّ ومَن لم يُحصَنْ، فإنَّ أُمَةً لرسول الله ﷺ زَنَتْ، فأمرني رسولُ الله ﷺ أن أجلِدَها، فأتيتُها فإذا هي حديث عهدٍ بنِفَاس، فخشيتُ إن أنا جلدتُها أن أقتلَها وأن تموت، فأتيتُ رسول الله ﷺ فذكرتُ ذلك له، فقال: "أحسَنتَ" (1).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه!

It is narrated from Sayyiduna Ali (may Allah be pleased with him) that he delivered a sermon and said: "O people, establish the prescribed punishments upon your slaves and slave-girls, whether they are married or unmarried, for a slave-girl of the Messenger of Allah (peace and blessings be upon him) committed fornication, and the Messenger of Allah (peace and blessings be upon him) ordered me to flog her. I went to her and found that she had only recently given birth (and was in post-natal bleeding, nifas). I feared that if I flogged her, she might die. I came to the Messenger of Allah (peace and blessings be upon him) and mentioned this to him, and he (peace and blessings be upon him) said: 'You did well.'"
This hadith is sahih on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده صحيح. زائدة: هو ابن قدامة، والسدي: هو إسماعيل بن عبد الرحمن بن أبي كريمة، وأبو عبد الرحمن السلمي: هو عبد الله بن حبيب بن ربيعة.
Grading: Its chain is "sahih". Za'idah is Ibn Qudamah, al-Suddi is Isma'il bin Abd al-Rahman bin Abi Karimah, and Abu Abd al-Rahman al-Sulami is Abdullah bin Habib bin Rabi'ah.
وأخرجه أحمد 2/ (1341)، ومسلم (1705)، والترمذي (1441) من طريق أبي داود سليمان بن داود الطيالسي، عن زائدة بن قدامة، بهذا الإسناد. فاستدراك الحاكم له ذهولٌ منه.
Reference / Source: Ahmad (2/1341), Muslim (1705) and al-Tirmidhi (1441) narrated it through the route of Abu Dawud Sulayman bin Dawud al-Tayalisi, from Za'idah bin Qudamah, with this same chain.
Note / Clarification: Therefore al-Hakim's adding it (to the Mustadrak) as something missed (istidrak) is an oversight (dhuhul) on his part.
وأخرجه مسلم (1705) من طريق إسرائيل بن يونس، عن السدي، به. ولم يذكر: من أحصن منهم ومن لم يحصن، وزاد في الحديث: "اتركها حتى تماثل".
Reference / Source: Muslim (1705) narrated it through the route of Isra'il bin Yunus, from al-Suddi, in the same way.
Details of the narration: He did not mention "the married and the unmarried", and he added to the hadith: "Leave her until she recovers (is clear of postnatal bleeding)."
وأخرجه أحمد (679) و (736) (1231)، وأبو داود (4473)، والنسائي (7201) و (7227) و (7228) و (7229) من طريق عبد الأعلى بن عامر الثعلبي، عن أبي جميلة الطهوي ميسرة بن يعقوب، عن علي: أن جارية للنبي ﷺ نَفسَت من الزنى، فأرسلني النبي ﷺ لأقيم عليها الحدَّ، فوجدتها في الدم لم يجف عنها، فرجعت إلى النبي ﷺ فأخبرته، فقال لي: "إذا جفَّ الدم عنها فاجلدها الحدَّ" ثم قال: "أقيموا الحدود على ما ملكت أيمانكم، اللفظ لأحمد (1231)، وعند بعضهم مختصر. وعبد الأعلى الثعلبي ضعيف.
Reference / Source: Ahmad (679, 736, 1231), Abu Dawud (4473) and al-Nasa'i (7201, 7227, 7228, 7229) narrated it through the route of Abd al-A'la bin Amir al-Tha'labi, from Abu Jamilah al-Tuhawi Maysarah bin Ya'qub, that Ali (may Allah be pleased with him) said: A slave-girl of the Prophet (peace and blessings be upon him) gave birth as a result of adultery (and was in postnatal bleeding). He (peace and blessings be upon him) sent me to carry out the hadd on her, and I found that her blood had not yet dried, so I came back and told him (peace and blessings be upon him). He said: "When her blood has dried, give her the lashes of the hadd." Then he said: "Carry out the prescribed punishments on those whom your right hands possess (your slaves)." (This is the wording of Ahmad 1231; with some of them it is abridged.)
Grading: Abd al-A'la al-Tha'labi is "da'if" (weak).
