(1) إسناده صحيح، إلا أنه اختلف في إسناده على بكير بن عبد الله كما قال الدارقطني في "العلل" (952).
Grading: Its chain is "sahih"; however, there is disagreement from "Bukayr bin Abdullah" in its chain, as al-Daraqutni said in "al-'Ilal" (952).
فرواه عمرو بن الحارث - كما عند المصنف هنا - عن بكير، عن سليمان بن يسار، عن عبد الرحمن بن جابر، عن أبيه، عن أبي بردة. أخرجه كذلك أحمد 27/ (16487) و (16488)، والبخاري (6850)، ومسلم (1708)، وأبو داود (4492)، وابن حبان (4453)، كلهم من طريق عبد الله بن وهب، عن عمرو، به. فاستدراك الحاكم له ذهولٌ منه.
Details of the narration: Amr bin al-Harith narrated it (as it is here with the author, al-Hakim) from Bukayr, from Sulayman bin Yasar, from Abd al-Rahman bin Jabir, from his father, from Abu Burdah.
Reference / Source: Ahmad (27/16487, 16488), al-Bukhari (6850), Muslim (1708), Abu Dawud (4492) and Ibn Hibban (4453) narrated it in the same way through the route of Abdullah bin Wahb, from Amr. (Since it is in the two Sahihs) al-Hakim's adding it as something missed (istidrak) is an oversight on his part.
وتابع عمرًا عليه أسامةُ بن زيد عند ابن أبي عاصم في "الآحاد والمثاني" (1924)، والبزار في "مسنده" (3796)، والطحاوي في "شرح مشكل الآثار" (2445).
Corroborating chains and supporting reports: Usamah bin Zayd corroborated Amr in this, as found in Ibn Abi Asim's "al-Ahad wa'l-Mathani" (1924), al-Bazzar's "Musnad" (3796) and al-Tahawi's "Sharh Mushkil al-Athar" (2445).
وخالفهما الليث وسعيد بن أبي أيوب، فروياه عن يزيد بن أبي حبيب، عن بكير، عن سليمان بن يسار، عن عبد الرحمن بن جابر، عن أبي بردة، فلم يذكرا فيه جابرًا والد عبد الرحمن.
Technical note / Defect ('illah): Al-Layth and Sa'id bin Abi Ayyub contradicted the two of them: they narrated it from Yazid bin Abi Habib, from Bukayr, from Sulayman bin Yasar, from Abd al-Rahman bin Jabir, (directly) from Abu Burdah, and did not mention in it "Jabir", the father of Abd al-Rahman.
أما رواية الليث بن سعد، فأخرجها أحمد 25/ (15832) و 27/ (16486)، والبخاري (6848)، وأبو داود (4491)، وابن ماجه (2601)، والترمذي (1463)، والنسائي (7290).
Reference / Source: As for the narration of al-Layth bin Sa'd, it was transmitted by Ahmad (25/15832 and 27/16486), al-Bukhari (6848), Abu Dawud (4491), Ibn Majah (2601), al-Tirmidhi (1463) and al-Nasa'i (7290).
وأخرجه أحمد 25/ (15835) عن أبي سلمة الخزاعي، عن الليث، عن بكير بن عبد الله، عن سليمان بن يسار، عن عبد الرحمن بن جابر، عن أبي بردة بن نيار، فذكره. وكان ليث حدثناه ببغداد عن يزيد بن أبي حبيب عن بكير عن سليمان، فلما كنا بمصر قال: أخبرناه بكير بن عبد الله بن الأشج.
Reference / Source: Ahmad (25/15835) narrated it from Abu Salamah al-Khuza'i, from al-Layth, from Bukayr bin Abdullah, from Sulayman bin Yasar, from Abd al-Rahman bin Jabir, from Abu Burdah bin Niyar.
Details of the narration: (Abu Salamah said:) Al-Layth narrated this hadith to us in Baghdad "from Yazid bin Abi Habib, from Bukayr, from Sulayman", then when we were in Egypt he said: "Bukayr bin Abdullah bin al-Ashajj informed us" (i.e., he dropped the intermediary, or mentioned direct hearing).
وأما رواية سعيد بن أبي أيوب، فأخرجها أحمد 27/ (16491)، والنسائي (7289)، وابن حبان (4452)، والحاكم فيما سيأتي برقم (8351).
Reference / Source: As for the narration of Sa'id bin Abi Ayyub, it was transmitted by Ahmad (27/16491), al-Nasa'i (7289), Ibn Hibban (4452) and al-Hakim below at (8351).
وخالف كلا من سعيد بن أبي أيوب والليثِ زيدُ بن أبي أُنيسة عند النسائي (7291)، فرواه عن يزيد بن أبي حبيب، عن بكير بن عبد الله قال: بينما أنا عند سليمان، إذ جاء عبد الرحمن بن جابر، فحدَّث سليمان، ثم أقبل عليهم سليمانُ فقال: حدثني عبد الرحمن بن جابر، أنَّ أباه حدثه أنه سمع أبا بردة، فذكره. كرواية عمرو بن الحارث.
Technical note / Defect ('illah): Zayd bin Abi Unaysah contradicted both Sa'id bin Abi Ayyub and al-Layth, as found in al-Nasa'i (7291): he narrated it from Yazid bin Abi Habib, from Bukayr bin Abdullah, who said: "I was with Sulayman when Abd al-Rahman bin Jabir came and narrated to Sulayman; then Sulayman turned to them and said: Abd al-Rahman bin Jabir told me that his father told him that he heard Abu Burdah", and he mentioned the hadith (this is like the narration of Amr bin al-Harith).
ورواه ابن لهيعة عن بكير بن عبد الله كروايتي الليث وسعيد بن أبي أيوب، أخرجه أحمد 25/ (15834)، ليس فيه جابر.
Details of the narration: Ibn Lahi'ah also narrated it from Bukayr bin Abdullah like al-Layth and Sa'id bin Abi Ayyub; Ahmad (25/15834) transmitted it, and it too does not mention Jabir.
وأخرجه البخاري (6849)، والنسائي (7292) من طريق فضيل بن سليمان، عن مسلم بن أبي مريم، عن عبد الرحمن بن جابر، عمَّن سمع النبي ﷺ قال، فذكره.
Reference / Source: Al-Bukhari (6849) and al-Nasa'i (7292) narrated it through the route of Fudayl bin Sulayman, from Muslim bin Abi Maryam, from Abd al-Rahman bin Jabir, from "someone who heard the Prophet (peace and blessings be upon him)" (through an unnamed intermediary).
قال الحافظ ابن حجر في "فتح الباري" 21/ 656: ذكر الدارقطني في "العلل" (952) الاختلاف فيه ثم قال: القول قول الليث ومن تابعه، وخالف ذلك في كتاب "التتبع" (92) فقال: القول قول عمرو بن الحارث وقد تابعه أسامة بن زيد.
Technical note / Defect ('illah): Al-Hafiz Ibn Hajar said in "Fath al-Bari" (21/656): Al-Daraqutni mentioned this disagreement in "al-'Ilal" (952) and then said: "The view of al-Layth and those who corroborated him is the one to be relied upon." Whereas in the book "al-Tatabbu'" (92) he said the opposite: "The view of Amr bin al-Harith is the one to be relied upon, and Usamah bin Zayd corroborated him."
قلنا: كلام الدارقطني في "التتبع" يوافق كلام أبي حاتم، فقد ذكر ابنه في "العلل" (1356): قلت لأبي: أيهما أصح؟ قال: حديث عمرو بن الحارث، لأنَّ نفسين قد اتَّفقا على أبي بردة بن نيار، قصَّر أحدهما [في] ذكر جابر، وحفظ الآخر جابرًا.
Technical note / Defect ('illah): We say: Al-Daraqutni's statement in "al-Tatabbu'" agrees with the statement of Abu Hatim. His son mentioned in "al-'Ilal" (1356): "I asked my father: Which of the two is more sound? He said: The hadith of Amr bin al-Harith, because two persons agreed on Abu Burdah bin Niyar; one of them fell short in mentioning Jabir, and the other preserved Jabir (as the intermediary)."
ثم قال الحافظ ابن حجر: ولم يقدح هذا الاختلاف عند الشيخين في صحة الحديث، فإنه كيفما دار يدور على ثقة، ويحتمل أن يكون عبد الرحمن وقع له فيه ما وقع لبكير بن الأشج في تحديث عبد الرحمن بن جابر لسليمان بحضرة بكير، ثم تحديث سليمان بكيرًا به عن عبد الرحمن، أو أنَّ عبد الرحمن سمع أبا بردة لما حدث به أباه وثبته فيه أبوه، فحدث به تارةً بواسطة أبيه وتارةً بغير واسطة.
Technical note / Defect ('illah): Then al-Hafiz Ibn Hajar said: "In the view of the two Shaykhs (al-Bukhari and Muslim), this disagreement does not impair the soundness of the hadith, because whichever way it turns, it revolves around a trustworthy narrator. It is possible that the same happened with Abd al-Rahman as happened with Bukayr bin al-Ashajj (sometimes he heard it directly and sometimes through an intermediary), or that Abd al-Rahman heard Abu Burdah when he was narrating it to his father, and his father made him firm in it, so he sometimes narrates it via his father and sometimes without an intermediary."
وادعى الأصيلي أن الحديث مضطرب فلا يحتج به لاضطرابه، وتُعقِّب بأنَّ عبد الرحمن ثقة وقد صرح بسماعه، وإبهام الصحابي لا يضرُّ، وقد اتفق الشيخان على تصحيحه وهما العُمدة في التصحيح، وقد وجدتُ له شاهدًا بسند قوي لكنه مرسل، أخرجه الحارث بن أبي أسامة من رواية عبد الله بن أبي بكر بن الحارث بن هشام رفعه: "لا يحلُّ أن يُجلد فوق عشرة أسواط إلَّا في حد"، وله شاهد آخر عن أبي هريرة عند ابن ماجه (2602) ستأتي الإشارة إليه. قلنا: لكن فيه عباد بن كثير الثقفي، وهو متروك الحديث.
Technical note / Defect ('illah): Al-Asili claimed that the hadith is "mudtarib" (inconsistent) and therefore cannot be used as proof because of its inconsistency. This was refuted on the grounds that (the narrator) Abd al-Rahman is trustworthy and has explicitly stated his hearing, and that the Companion being unnamed does no harm. Moreover, the two Shaykhs (al-Bukhari and Muslim) agreed on declaring it sahih, and they are the main reliance ('umdah) in grading hadith sahih.
Corroborating chains and supporting reports: I found a "shahid" (supporting report) for it with a strong chain, but it is "mursal"; al-Harith bin Abi Usamah transmitted it as "marfu'" from the narration of Abdullah bin Abi Bakr bin al-Harith bin Hisham: "It is not permissible to give anyone more than ten lashes except in a prescribed punishment (hadd)." It has another supporting report from Abu Hurayrah (may Allah be pleased with him) in Ibn Majah (2602), which will be referred to shortly.
Grading: We say: But this (supporting report) contains "Abbad bin Kathir al-Thaqafi", and he is "matruk al-hadith" (abandoned in hadith).
