Mustadrak al-Hakim — Hadith 8307

أخبرني أبو بكر بن أبي دارِم الحافظ بالكوفة، حدَّثنا أحمد بن موسى التَّميمي، حدَّثنا مِنْجاب بن الحارث، حدَّثنا عبد الملك بن هارون بن عَنترة، عن أبيه، عن جدِّه، عن عمرو بن العاص: أنه زار عمَّةً له، فدعت له بطعام، فأبطأَتِ الجاريةُ فقالت: ألا تَستعجِلي يا زانيةُ! فقال عمرو: سبحان الله، لقد قلتِ أمرًا عظيمًا، هل اطَّلَعتِ منها على زِنًى؟ قالت: لا والله، فقال عمرو: إني سمعتُ رسول الله ﷺ يقول: "أيُّما عبدٍ أو امرأةٍ قال أو قالت لوليدِتها: يا زانيةُ، ولم تطَّلِعُ منها على زناءٍ، جلدَتْها وَليدتُها يومَ القيامة، لأنه لا حدَّ لهنَّ في الدنيا" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه، إنما اتفقا في هذا الباب على حديث عبد الرحمن بن أبي نُعْم (2)، عن أبي هريرة: "مَن قَذَفَ مملوكَه بالزِّنى، أُقيم عليه الحدُّ يومَ القيامة" (3).

It is narrated from Sayyiduna Amr bin al-As (may Allah be pleased with him) that he visited one of his paternal aunts. She called for food, and the maidservant was late in bringing it. At this his aunt said: O adulteress! Why do you not hurry? Sayyiduna Amr (may Allah be pleased with him) said: Subhan Allah! You have said a grave thing. Did you see her commit adultery? She said: By Allah, no! Then Sayyiduna Amr (may Allah be pleased with him) said: I heard the Messenger of Allah (peace and blessings be upon him) say: "Any man or woman who says to his or her maidservant, 'O adulteress,' without having seen any immorality from her, that maidservant will flog him or her on the Day of Resurrection, because there is no prescribed punishment (for slander) for them (slaves and slave-girls) in this world."
The chain of this hadith is sahih (authentic), but the two Shaykhs (Bukhari and Muslim) did not record it. However, in this chapter they both agreed on this hadith of Sayyiduna Abu Hurayrah (may Allah be pleased with him): "Whoever accuses his slave of adultery, the prescribed punishment will be established upon him on the Day of Resurrection."

(1) إسناده تالف، ابن أبي دارم - واسمه أحمد بن محمَّد بن السَّري - ضعفه المصنِّف، وعبدُ الملك بن هارون بن عنترة متهم بالكذب، كذَّبه ابن معين والجُوزجاني وابن حبان، وقال أبو حاتم: متروك، ذاهب الحديث. وبه أعلَّه الذهبي في "التلخيص"، فقال: عبد الملك متروك باتفاق، حتى قيل فيه: دجال.
Grading: Its chain is "talif" (ruined, extremely weak).
Technical note / Defect ('illah): Ibn Abi Darim, whose name is Ahmad bin Muhammad bin al-Sari, was declared weak by the author (al-Hakim). And Abd al-Malik bin Harun bin Antarah is accused of lying (muttaham bi'l-kadhib); Ibn Ma'in, al-Juzjani and Ibn Hibban called him a liar. Abu Hatim said: "He is matruk (abandoned) and dhahib al-hadith (his hadith is lost)." For this reason al-Dhahabi declared it defective in "al-Talkhis" and said: "Abd al-Malik is abandoned by agreement, to the extent that he was even called a dajjal (arch-liar)."
قلنا: والعجب من الحاكم كيف صحَّح إسناده هنا مع أنه قال عنه: ذاهب الحديث جدًّا، فيما رواه السجزي عنه في "سؤالاته" (256)، وقال أيضًا في "المدخل" (129): روى عن أبيه أحاديث موضوعة.
Note / Clarification: We say: It is astonishing that al-Hakim declared its chain sahih here, although he himself, according to the narration of al-Sijzi in "al-Su'alat" (256), said about him that he is "dhahib al-hadith jiddan" (his hadith is utterly lost), and he also said in "al-Madkhal" (129): "He narrated fabricated (mawdu') hadiths from his father."

Note / Clarification: We have not found this report transmitted by anyone other than the author (al-Hakim).

(2) تحرَّف في النسخ الخطية إلى: نعيم إلَّا (ك)، والمثبت منها.
Note / Clarification: In the handwritten manuscripts this name had been corrupted into "Nu'aym", except in manuscript (K), and what we have recorded is taken from it.

(3) هو مرفوع إلى النبي ﷺ، وهو بنحوه عند البخاري برقم (6858)، ومسلم برقم (1660).
Grading: It is "marfu'" to the Prophet (peace and blessings be upon him), and a similar version is found in al-Bukhari (6858) and Muslim (1660).
