Mustadrak al-Hakim — Hadith 8308

حدَّثنا أبو العباس محمد بن يعقوب، حدَّثنا الرَّبيع بن سليمان، حدَّثنا أسَد بن موسى، حدَّثنا مسلم بن خالد، حدَّثنا أبو حازم، حدثني سهل بن سعد صاحبُ رسول الله ﷺ: أنَّ رجلًا من أسلم جاء النبيَّ ﷺ، فقال: إنه زَنَى بامرأة، سمَّاها وأنكَرَت، فحَدَّه وتركَها (4). هذا إسناد صحيح، ولم يُخرجاه. وشاهدُه:

It is narrated from Sayyiduna Sahl bin Sa'd (may Allah be pleased with him) that a man from the tribe of Aslam came to the Prophet (peace and blessings be upon him) and said that he had committed fornication with a woman. He also named the woman, but she denied (the act). So he (peace and blessings be upon him) established the prescribed punishment upon the man and left the woman.
This chain is sahih (authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

(4) حديث قوي، وهذا إسناد ضعيف من أجل مسلم بن خالد - وهو الزَّنجي - وكان أيضًا يرويه بذكر عبد الرحمن بن إسحاق بن عبد الله الملقَّب بعباد بينه وبين أبي حازم: واسمه سلمة بن دينار المدني. وقد توبع الزنجي في حديث هذا.
Grading: This hadith is "qawi" (strong), (but) this particular chain is "da'if" because of Muslim bin Khalid, who is al-Zanji.
Technical note / Defect ('illah): He also used to narrate it with "Abd al-Rahman bin Ishaq bin Abdullah" (whose nickname is Abbad) as an intermediary between himself and Abu Hazim (whose name is Salamah bin Dinar al-Madani). Al-Zanji has been corroborated in this hadith.
وأخرجه الطحاوي في "شرح مشكل الآثار" (4941) عن الربيع بن سليمان المرادي ونصر بن مرزوق، كلاهما عن أسد بن موسى، بهذا الإسناد.
Reference / Source: Al-Tahawi narrated it in "Sharh Mushkil al-Athar" (4941) from al-Rabi' bin Sulayman al-Muradi and Nasr bin Marzuq, both of them from Asad bin Musa, with this same chain.
وأخرجه أبو بكر الشافعي في "الغيلانيات" (606) من طريق عبد الصمد بن النعمان، عن مسلم الزنجي، به.
Reference / Source: Abu Bakr al-Shafi'i narrated it in "al-Ghaylaniyyat" (606) through the route of Abd al-Samad bin al-Nu'man, from Muslim al-Zanji, with this same chain.
وخالفهما جمع من الرواة، فرووه بذكر عباد بن إسحاق بين مسلم الزنجي وأبي حازم، أخرجه كذلك أحمد 37/ (22875) عن حسين بن محمد، والروياني في "مسنده" (1051)، والطحاوي (4942)، والطبراني في "الكبير" (5767)، وابن عدي في "الكامل" 4/ 303 و 6/ 309، والدارقطني (3155)، والبيهقي 8/ 251 من طريق هشام بن عمار، والدارقطني (3155) من طريق يونس بن محمد، والدارقطني (3155)، والخطيب في "تاريخ بغداد" 5/ 197 من طريق أبي علي أحمد بن الحكم، أربعتهم عن مسلم بن خالد الزنجي، عن عبد الرحمن بن إسحاق المعروف بعبَّاد، عن أبي حازم، عن سهل بن سعد. ولفظ رواية الطحاوي: أن امرأة أتت النبي ﷺ، فقالت: زنى بي فلان، فبعث النبي ﷺ إلى فلان، فسأله فأنكر، فرجم المرأة. وهي خطأ، ووقع في رواية هشام بن عمار وأحمد بن الحكم مكان "فحدَّه": فرجمه! ولم يسق الدارقطني لفظ رواية يونس، ورواية الجماعة عن الزنجي أولى، ولا سيما أنها توافق رواية عبد السلام بن حفص، ولفظها: فجلده الحدَّ، التي أخرجها أبو داود (4437) و (4466)، والطبراني (5924) من طريق عثمان بن أبي شيبة، عن طلق بن غنام، عن عبد السلام بن حفص، عن أبي حازم، به. وهذا إسناد قوي.
Technical note / Defect ('illah): A group of narrators contradicted the two of them: they narrated it mentioning "Abbad bin Ishaq" between Muslim al-Zanji and Abu Hazim.
Reference / Source: It was narrated in this way by Imam Ahmad (37/22875) from Husayn bin Muhammad; by al-Ruyani in his "Musnad" (1051), al-Tahawi (4942), al-Tabarani in "al-Kabir" (5767), Ibn Adi in "al-Kamil" (4/303 and 6/309), al-Daraqutni (3155) and al-Bayhaqi (8/251) through the route of Hisham bin Ammar; by al-Daraqutni (3155) through the route of Yunus bin Muhammad; and by al-Daraqutni (3155) and al-Khatib in "Tarikh Baghdad" (5/197) through the route of Abu Ali Ahmad bin al-Hakam. These four narrators narrate it from Muslim bin Khalid al-Zanji, from Abd al-Rahman bin Ishaq (known as Abbad), from Abu Hazim, from Sahl bin Sa'd (may Allah be pleased with him).
Details of the narration: The wording of Imam al-Tahawi's narration is: "A woman came to the Prophet (peace and blessings be upon him) and said: So-and-so committed adultery with me. The Prophet (peace and blessings be upon him) sent for that man and asked him, but he denied it, so he stoned the woman." This narration is "mistaken". In the narration of Hisham bin Ammar and Ahmad bin al-Hakam too, the words "he stoned him" appear in place of "he applied the hadd to him"! Al-Daraqutni did not quote the wording of Yunus's narration.
Grading: The narration of the group who narrate from al-Zanji is more worthy (of preference), especially since it agrees with the narration of Abd al-Salam bin Hafs, whose wording is: "So he had him flogged with the lashes of the hadd." Abu Dawud (4437, 4466) and al-Tabarani (5924) narrated it through the route of Uthman bin Abi Shaybah, from Talq bin Ghannam, from Abd al-Salam bin Hafs, from Abu Hazim, with this same chain, and this chain is strong.
والرجل الأسلمي هذا: هو ماعز بن مالك الأسلمي، وقد سلفت قصتُه عن غير واحد من الصحابة، انظر الأحاديث السالفة بالأرقام (8275 - 8281).
Note / Clarification: This Aslami man is Ma'iz bin Malik al-Aslami. His story has already passed from several Companions; see the previous hadiths nos. (8275-8281).
وفي باب حدّ المعترف وترك الآخر إذا لم يعترف، عن أبي هريرة وزيد بن خالد عند البخاري (2695)، ومسلم. (1697).
Reference / Source: And on the topic of carrying out the hadd on the one who confesses and leaving the other (if he does not confess), there are narrations from Abu Hurayrah and Zayd bin Khalid (may Allah be pleased with them both) in al-Bukhari (2695) and Muslim (1697).
