Mustadrak al-Hakim — Hadith 8309

ما حدَّثَناه محمد بن صالح بن هانئ، حدَّثنا يحيى بن محمد بن يحيى، حدَّثنا موسى بن هارون البُنِّي (1)، حدَّثنا هشام بن يوسف، حدَّثنا القاسم بن فيَّاض الأَبْناوي (1)، عن خلَّاد بن عبد الرحمن، عن سعيد بن المسيب، عن ابن عباس: أنَّ رجلًا من بني بكر بن ليث أتى النبيَّ ﷺ، فأقرَّ أنه زَنَى بامرأةٍ أربع مرارٍ، فَجُلِد مئةً، وكان بكرًا، ثم سأله البيِّنةَ على المرأة، فقالت المرأةُ: كذَبَ والله يا رسول الله، فجلدَه حدَّ الفِرْية ثمانين (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) that a man from the tribe of Banu Bakr bin Layth came to the Prophet (peace and blessings be upon him) and confessed four times that he had committed fornication with a woman. Since he was unmarried, he was given a hundred lashes. Then he asked for evidence against the woman, and the woman said: O Messenger of Allah, by Allah, he has lied. So he (peace and blessings be upon him) gave that man eighty lashes as the prescribed punishment for slander (hadd al-firyah) for making a false accusation.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) تصحف في النسخ الخطية إلى: البتي. وهو موسى بن هارون بن بشير القيسي البردي، يعرف بالبنّي، قال ابن الأثير في "اللباب" 1/ 182: البُنّي بضم الباء الموحدة وفي آخرها النون المشددة، هذه النسبة إلى البُن، وهو شيء من الكواميخ (أشياء يؤتدم بها كالصلصة والمخللات، واحدها: كامخ) والمشهور بهذه النسبة أبو هارون موسى بن زياد البُنّي الكوفي.
Technical note / Defect ('illah): (1) In the handwritten manuscripts this name has been miswritten (tashif) as "al-Batti". The correct form is that he is Musa bin Harun bin Bashir al-Qaysi al-Burdi, known by the nisbah "al-Bunni". Ibn al-Athir said in "al-Lubab" (1/182): "Al-Bunni" (with dammah on the ba' and a doubled nun at the end) is a nisbah to "al-bunn", which is a kind of kawamikh (things eaten with bread as a relish, such as sauces and pickles; singular: kamikh). Well known by this nisbah is Abu Harun Musa bin Ziyad al-Bunni al-Kufi.

Technical note / Defect ('illah): (1) In the handwritten manuscripts this name has been corrupted and written as "al-Anbari".

(2) إسناده ضعيف بمرّة من أجل القاسم بن فياض الأبناوي، وقال النسائي عن حديثه هذا: منكر، وبه أعله الذهبي في "التلخيص".
Grading: (2) This chain is very weak (da'if bi-marrah) because of al-Qasim bin Fayyad al-Abnawi. Imam al-Nasa'i said about this hadith of his: "It is munkar", and for this reason Imam al-Dhahabi declared it defective in "al-Talkhis".
وأخرجه أبو داود (4467) عن محمد بن يحيى بن فارس، والنسائي (7308) عن محمد بن عبد الرحيم، كلاهما عن موسى بن هارون البردي، بهذا الإسناد. وقال النسائي عقبه: حديث منكر.
Reference / Source: Abu Dawud (4467) narrated it from Muhammad bin Yahya bin Faris, and al-Nasa'i (7308) from Muhammad bin Abd al-Rahim, both of them from Musa bin Harun al-Burdi, with this same chain. Imam al-Nasa'i said after it: "This hadith is munkar."
