It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he said (regarding divorce): "If a husband says (to his wife): 'Your affair is in your own hand; decide for yourself what is best for you; and I have sent you to your family, provided they accept you,' then this will be counted as one irrevocable divorce (talaq ba'in, by which the marriage bond ends)."

Kharijah bin Zayd (may Allah have mercy on him) relates that Ibn Abi Atiq came to Sayyiduna Zayd bin Thabit (may Allah be pleased with him) weeping, and he (may Allah be pleased with him) asked: What has made you weep? He said: I made my wife the owner of her own affair (that is, I gave her the option of divorce), and as a result she separated from me. Sayyiduna Zayd (may Allah be pleased with him) asked: What led you to do that? He replied: Divine decree. So he (may Allah be pleased with him) ruled: "This will count as only one divorce; now, if you wish, take her back, and if you wish, leave her."

It is narrated from Abu Thumamah and a woman of our household that Kinanah bin Thawr had a wife who had borne him children in the Days of Ignorance. Kinanah said to her (over some matter): The whole of your body above your waist-wrapper is unlawful for me. So the woman brought this dispute before the court of Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him), and he (may Allah be pleased with him) asked: "What did you intend by this statement?" He said: "My intention was divorce." At this Sayyiduna Abu Musa al-Ash'ari (may Allah be pleased with him) gave this legal ruling: "This statement has separated this woman from you irrevocably (ba'in)."
