Amr bin Umayyah narrates: I heard some men narrating from the Prophet (peace and blessings be upon him) that when a slave woman is freed, she has a choice as long as her husband has not had relations with her: if she wishes, she may separate from her husband; but if the husband has had relations with her, then the woman has no choice left, and she will not be able to separate from her husband.
Ahmad recorded it as a muttasil (connected) narration in this way, and also as a mursal narration through another chain. The chain of the muttasil narration contains a narrator, al-Fadl bin Amr bin Umayyah, who is mastur (of unknown standing), and a narrator, Ibn Lahi'ah, whose hadith is hasan (good). The remaining narrators of this narration are thiqat (trustworthy).

Hadith Takhrij«اخرجه احمد فى المسند (378/5) ، أخرجه مسند أحمد برقم: 16183، 22697»
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: The husband of Sayyidah Barirah (may Allah be pleased with her) was a slave named Mughith. Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says: I saw him following that woman in the streets of Madinah with tears flowing from his eyes. Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says: The Prophet (peace and blessings be upon him) gave four rulings concerning this woman. He ruled that the right of wala' belongs to the one who sets free; he gave this woman the choice; and he instructed her to observe the waiting period like a free woman. Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) says: Once something was given to this woman as charity, and she gave some of it to Sayyidah Aishah (may Allah be pleased with her) as a gift. Sayyidah Aishah (may Allah be pleased with her) mentioned this to the Prophet (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) said: "It was charity for her, and for us it is a gift." (Allamah al-Haythami says:) I say: Part of it is mentioned in the Sahih.
Ahmad, and al-Tabarani in al-Mu'jam al-Awsat, recorded something similar to it. The narrators of Ahmad are the narrators of the Sahih.

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrates: Sayyidah Aishah (may Allah be pleased with her) intended to buy Sayyidah Barirah (may Allah be pleased with her) and set her free, but her masters said: "No, you will have to let the right of wala' remain with us." Sayyidah Aishah (may Allah be pleased with her) mentioned this to the Prophet (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) said: "Buy her and set her free." The Prophet (peace and blessings be upon him) said: "What is the matter with people who lay down conditions that are not permitted in the Book of Allah? Whoever lays down a condition that is not permitted in the Book of Allah, that (condition) will be considered void (that is, null)." The narrator says: That woman was the wife of a slave named Mughith; he was a slave of Banu al-Mughirah. The Prophet (peace and blessings be upon him) gave this woman the choice. The narrator says: Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) narrated that the Prophet (peace and blessings be upon him) made this woman's waiting period the same as the waiting period of a free woman. (Allamah al-Haythami says:) I say: Part of this narration is reported in the Sahih.
Al-Tabarani recorded it in al-Mu'jam al-Awsat. Its chain contains a narrator, Muhammad bin Jami' al-Attar, who is da'if (weak).

Hadith Takhrij«اخرجه الطبراني فى المعجم الكبير (11744)»
Ibn Jurayj narrates: I was informed that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "If a slave woman is the wife of a slave and she is set free, and she does not know that she has the choice of separation, and then she does not choose (separation) until her husband is set free, or her husband dies, or the slave woman dies, (then in all these cases) the two of them will inherit from each other."
Al-Tabarani recorded it. Its chain is munqati' (broken), and its narrators are the narrators of the Sahih. And Allah Almighty knows best what is correct; He is the Generous, the Bestower, the One who frees necks (from bondage), the Opener of doors.
