Majma al-Zawaid — Hadith 7801

عَنْ عَمْرِو بْنِ أُمَيَّةَ قَالَ : سَمِعْتُ رِجَالًا يَتَحَدَّثُونَ عَنِ النَّبِيِّ - صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ - أَنَّهُ قَالَ : " إِذَا عُتِقَتِ الْأَمَةُ فَهِيَ بِالْخِيَارِ مَا لَمْ يَطَأْهَا ، إِنْ شَاءَتْ فَارَقَتْهُ وَإِنْ وَطِئَهَا فَلَا خِيَارَ لَهَا ، وَلَا تَسْتَطِيعُ فِرَاقَهُ " .
رَوَاهُ أَحْمَدُ مُتَّصِلًا هَكَذَا وَمُرْسَلًا مِنْ طَرِيقٍ آخَرَ ، وَفِي الْمُتَّصِلِ الْفَضْلُ بْنُ عَمْرِو بْنِ أُمَيَّةَ ، وَهُوَ مَسْتُورٌ وَابْنُ لَهِيعَةَ حَدِيثُهُ حَسَنٌ ، وَبَقِيَّةُ رِجَالِهِ ثِقَاتٌ .
Amr bin Umayyah narrates: I heard some men narrating from the Prophet (peace and blessings be upon him) that when a slave woman is freed, she has a choice as long as her husband has not had relations with her: if she wishes, she may separate from her husband; but if the husband has had relations with her, then the woman has no choice left, and she will not be able to separate from her husband.
Ahmad recorded it as a muttasil (connected) narration in this way, and also as a mursal narration through another chain. The chain of the muttasil narration contains a narrator, al-Fadl bin Amr bin Umayyah, who is mastur (of unknown standing), and a narrator, Ibn Lahi'ah, whose hadith is hasan (good). The remaining narrators of this narration are thiqat (trustworthy).
