Allah, the Blessed and Exalted, says: "Then whoever (the killer) is pardoned something by his brother, (the claimant) should follow up in a fair manner, and (the killer) should pay him in a good way." [Surah al-Baqarah: 178]

Muqatil bin Hayyan (may Allah have mercy on him) said: I took this tafsir from a group of people; of them, (the narrator) Mu'adh (bin Musa) remembered Mujahid, al-Hasan and al-Dahhak bin Muzahim (may Allah have mercy on them). Concerning the verse "Then whoever is pardoned something by his brother, let there be a following up in a fair manner" [Surah al-Baqarah: 178], they say: For the people of the Torah only retaliation was binding, with no pardon or diyah, and upon the people of the Injil it was made obligatory that the killer be pardoned and not killed. The Ummah of Muhammad (peace and blessings be upon him) was given the concession that, if they wish, they may kill (in retaliation), if they wish, they may take diyah, and if they wish, they may pardon; and this is in the saying of Allah Almighty: "That is an alleviation from your Lord and a mercy." [Surah al-Baqarah: 178] Allah Almighty made diyah an alleviation, and after the diyah has been taken he (the killer) may not be killed. Then He said: "Whoever transgresses after that will have a painful punishment" [Surah al-Baqarah: 178], that is, whoever kills even after taking the diyah, for him is a painful punishment. And the saying of Allah Almighty: "And for you in retaliation there is life" [Surah al-Baqarah: 179] means that a person will not kill another out of fear, once he knows that he too will be killed in return.

Muqatil bin Hayyan (may Allah have mercy on him) said concerning the saying of Allah Almighty "Then whoever is pardoned something by his brother" [Surah al-Baqarah: 178]: When someone kills another deliberately, and the guardian of the slain pardons him, does not take retaliation and accepts the diyah, then "let there be a following up in a fair manner" [Surah al-Baqarah: 178], meaning he should demand the diyah in a good way, and "payment to him with excellence" [Surah al-Baqarah: 178], meaning the diyah should be paid in a good way and with excellence. He said that for the people of the Torah only retaliation was obligatory. Then he narrated the previous hadith in full.
And he (Muqatil, may Allah have mercy on him) says in explaining "Whoever transgresses after that will have a painful punishment" [Surah al-Baqarah: 178]: Whoever takes the diyah and also kills, for him is this punishment. That is, if someone kills another and the killer speaks to the guardians of the slain and gets them to agree to diyah, and when he comes to pay the diyah the guardian of the slain kills him and says: "I accepted the diyah only so that he would come to me and I could kill him," then this is: "Whoever transgresses after that will have a painful punishment" [Surah al-Baqarah: 178], that is, after accepting the diyah.

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: Among the Children of Israel there was retaliation, but there was no diyah among them, so Allah Almighty said to this Ummah: "Retaliation is prescribed for you in the case of those killed: the free for the free, the slave for the slave and the female for the female. Then whoever is pardoned something by his brother" [Surah al-Baqarah: 178]. The meaning of 'afw (pardon) is that they take the diyah and do not kill. "Then let there be a following up in a fair manner and payment to him with excellence. That is an alleviation from your Lord and a mercy" [Surah al-Baqarah: 178], that is, from what was prescribed for those before you. "Whoever transgresses after that will have a painful punishment" [Surah al-Baqarah: 178].

"But whoever is pardoned something by his brother, then let there be a following up with what is fair and payment to him with excellence" [Surah al-Baqarah: 178] means: when, in deliberate killing, the heir of the slain agrees to blood money, then pay the blood money with excellence. "That is an alleviation from your Lord and a mercy. So whoever transgresses after that will have a painful punishment" [Surah al-Baqarah: 178] means: in comparison with the Children of Israel.

So whoever believes in Allah and the Last Day must neither shed blood here nor cut its trees. If anyone has a concession in it, it is the Messenger of Allah; Allah made it lawful for me, not for people. Even for me it was made lawful only for an hour of a day. Then it is sacred just as it was yesterday. O Banu Khuza'ah! You have killed this man of Banu Hudhayl, and I, by Allah, am the one who will pay his blood money. Sayyiduna Abu Hurayrah (may Allah be pleased with him) said: Banu Khuza'ah killed a man of Banu Layth in retaliation on the day of the Conquest of Makkah. When he (peace and blessings be upon him) learned of it, he (peace and blessings be upon him) mounted his riding animal and delivered a sermon: "Allah protected Makkah from the elephants and made His Messenger and the believers its inheritors. Listen! Makkah was not lawful for anyone before, nor will it ever be. Yes, for me it was made lawful for part of a day, and now, at this hour, its sanctity is established and lasting again. No one is to break its thorns, nor uproot its trees, nor pick up anything that has fallen (lost) here, except one who announces it. And whoever has someone of his killed has the choice of the better of two things: he may take blood money or retaliation." A man from the people of Yemen named Abu Shah came and said: Write these things down for me. He (peace and blessings be upon him) said: "Write for Abu Shah." A man of Quraysh said: O Messenger of Allah, at least permit the idhkhir grass, for we use it in our houses and in our graves. So he (peace and blessings be upon him) said: "Very well! You may uproot the idhkhir grass."
And in Sahih al-Bukhari, Abu Nu'aym narrates from Shayban: "Either he pays (the blood money) or he gives retaliation."

Amr bin Shu'ayb narrates from his father, and he from his grandfather (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said: "Whoever commits deliberate killing, the killer is to be handed over to the heirs of the slain; they may take retaliation if they wish, or blood money." And in the hadith of Sayyiduna Wa'il bin Hujr (may Allah be pleased with him) it is that a killer was brought to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) asked the heir of the slain: "Do you pardon him?" He said: No. He (peace and blessings be upon him) asked: "Will you take blood money?" He said: No. He (peace and blessings be upon him) asked: "Will you kill him?" He said: Yes. He (peace and blessings be upon him) said: "Very well, take him away."
