Muhammad bin Iyas (may Allah have mercy on him) said: Abdullah bin Abbas (may Allah be pleased with him), Abu Hurayrah (may Allah be pleased with him) and Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with him) were asked about a virgin whose husband gives her three divorces. All of them said: "She is not lawful for him until she marries another husband."

Mu'awiyah bin Abi Ayyash al-Ansari (may Allah be pleased with him) said that he was sitting with Abdullah bin al-Zubayr and Asim bin Umar (may Allah be pleased with them both). The narrator said: Muhammad bin Iyas bin al-Bukayr (may Allah have mercy on him) came to them both and said: "A man from the desert has given his wife three divorces before consummating the marriage. What is your view about it?" Abdullah bin al-Zubayr (may Allah be pleased with him) said: "We have nothing to say about this. Go to Abdullah bin Abbas and Abu Hurayrah (may Allah be pleased with them both), whom I left with Aishah (may Allah be pleased with her); ask them, and then come and tell us too." So Muhammad bin Iyas bin al-Bukayr (may Allah have mercy on him) went and asked them. Abdullah bin Abbas (may Allah be pleased with him) said to Abu Hurayrah (may Allah be pleased with him): "Give him a ruling, for a difficult question has come to you." Abu Hurayrah (may Allah be pleased with him) said: "One divorce separates the wife, and three divorces make her forbidden." Abdullah bin Abbas (may Allah be pleased with him) said the same: "until she marries another husband."

Mu'awiyah bin Abi Ayyash narrates from Muhammad bin Iyas bin al-Bukayr that a Bedouin who had given his wife three divorces before consummating the marriage was brought to Asim bin Umar and Ibn al-Zubayr (may Allah be pleased with them both). He mentioned the meaning of the hadith of Malik and added something to it: that Sayyidah Aishah (may Allah be pleased with her) also agreed with them both.

Qatadah narrates from Ikrimah, Ata, Tawus and Jabir bin Zayd that all of them narrated from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) that he said: "It is one separating (ba'in) divorce," meaning concerning a man who gives his wife three divorces before consummating the marriage. It is possible that what is meant by it is separating them, so it does not contradict the earlier hadith.

Al-Sha'bi narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) concerning a man who gave his wife three divorces before consummating the marriage. He said: "It was a right in his hand which he has used; and when he divorces after that, it is nothing."
Sufyan said: "Tatra" (in succession) means: "You are divorced, you are divorced, you are divorced"; the first divorce separates her, and the other two have no standing. Imam al-Shafi'i (may Allah have mercy on him) reports from Abu Yusuf (may Allah have mercy on him) concerning a man who says to his wife before consummating the marriage: "You are divorced, you are divorced, you are divorced," that the first divorce takes effect and the remaining two do not. This is also the view of Imam Abu Hanifah (may Allah have mercy on him).

Abu Bakr bin Abd al-Rahman bin al-Harith (may Allah have mercy on him) said concerning a man who said to his wife before consummating the marriage: "You are divorced, you are divorced, you are divorced." Abu Bakr (may Allah have mercy on him) said: "Is a woman divorced on the open road? She became separated from him with the first divorce."

Al-Hasan (may Allah have mercy on him) said that the Messenger of Allah (peace and blessings be upon him) said: "The divorce of a woman with whom the marriage has not been consummated is one."
This is mursal, and its narrator Sulayman bin Arqam is da'if (weak).
