قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: 229] وَقَالَ: {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ} [البقرة: 230]⦗545⦘ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَالْقُرْآنُ وَاللهُ أَعْلَمُ يَدُلُّ عَلَى أَنَّ مَنْ طَلَّقَ زَوْجَةً لَهُ دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا ثَلَاثًا لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ.
Allah, glorified be His praise, says: "Divorce (that can be revoked) is twice; then either retain her in an acceptable manner or release her in a good way." [Surah al-Baqarah: 229]
And He said: "And if he divorces her (a third time), then she is not lawful for him afterwards until she marries a husband other than him." [Surah al-Baqarah: 230]
Imam al-Shafi'i (may Allah have mercy on him) said: "So the Qur'an, and Allah knows best, indicates that whoever gives his wife three divorces, whether he has consummated the marriage with her or not, she will not be lawful for him until she marries a husband other than him."
And He said: "And if he divorces her (a third time), then she is not lawful for him afterwards until she marries a husband other than him." [Surah al-Baqarah: 230]

أَخْبَرَنَا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ، نا عَلِيُّ بْنُ الْحُسَيْنِ بْنِ الْجُنَيْدِ، نا يَعْقُوبُ بْنُ حُمَيْدِ بْنِ كَاسِبٍ، نا يَعْلَى بْنُ شَبِيبٍ الْمَكِّيُّ، نا هِشَامُ بْنُ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا قَالَتْ: " كَانَ الرَّجُلُ يُطَلِّقُ امْرَأَتَهُ مَا شَاءَ أَنْ يُطَلِّقَهَا وَإِنْ طَلَّقَهَا مِائَةً أَوْ أَكْثَرَ إِذَا ارْتَجَعَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا حَتَّى قَالَ الرَّجُلُ لِامْرَأَتِهِ: وَاللهِ لَا أُطَلِّقُكِ فَتَبِينِي مِنِّي، وَلَا أُؤْوِيكِ إِلِيَّ، قَالَتْ: وَكَيْفَ ذَاكَ، قَالَ: أُطَلِّقُكِ فَكُلَّمَا هَمَّتْ عِدَّتُكِ أَنْ تَنْقَضِيَ ارْتَجَعْتُكِ ثُمَّ أُطَلِّقُكِ وَأَفْعَلُ هَكَذَا فَشَكَتِ الْمَرْأَةُ ذَلِكَ إِلَى عَائِشَةَ رَضِيَ اللهُ عَنْهَا فَذَكَرَتْ عَائِشَةُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَسَكَتَ فَلَمْ يَقُلْ شَيْئًا حَتَّى نَزَلَ الْقُرْآنُ: {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: ٢٢٩] فَاسْتَأْنَفَ النَّاسُ الطَّلَاقَ مَنْ شَاءَ طَلَّقَ وَمَنْ شَاءَ لَمْ يُطَلِّقْ " وَرَوَاهُ أَيْضًا قُتَيْبَةُ بْنُ سَعِيدٍ وَالْحُمَيْدِيُّ عَنْ يَعْلَى بْنِ شَبِيبٍ وَكَذَلِكَ قَالَ مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ يَسَارٍ بِمَعْنَاهُ وَرُوِيَ نُزُولُ الْآيَةِ فِيهِ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا.
Sayyidah Aishah (may Allah be pleased with her) says: A man would divorce his wife whenever he wished, even if it was a hundred or more times. When he took his wife back before the waiting period ended, he would say to her: I will neither divorce you so that you become separate from me, nor give you a place with me. The woman said: How is that? He would say: I will divorce you, and when your waiting period is about to end, I will take you back, then I will divorce you, and I will keep doing this. That woman complained to Sayyidah Aishah (may Allah be pleased with her), and Sayyidah Aishah (may Allah be pleased with her) mentioned it to the Prophet (peace and blessings be upon him). He (peace and blessings be upon him) remained silent and said nothing until this verse was revealed: "Divorce is twice; then either retain her in an acceptable manner or release her with kindness." [Surah al-Baqarah: 229] So people began divorce afresh: whoever wished would divorce, and whoever wished would not divorce.
أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ قَالَا: نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ قَالَ: كَانَ الرَّجُلُ إِذَا طَلَّقَ امْرَأَتَهُ ثُمَّ ارْتَجَعَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا كَانَ ذَلِكَ لَهُ وَإِنْ طَلَّقَهَا أَلْفَ مَرَّةٍ فَعَمَدَ رَجُلٌ إِلَى امْرَأَةٍ لَهُ فَطَلَّقَهَا ثُمَّ أَمْهَلَهَا حَتَّى إِذَا شَارَفَتِ انْقِضَاءَ عِدَّتِهَا ارْتَجَعَهَا ثُمَّ طَلَّقَهَا وَقَالَ: وَاللهِ لَا أُؤْوِيكِ إِلِيَّ وَلَا تَخْلِينَ أَبَدًا، فَأَنْزَلَ اللهُ تَبَارَكَ وَتَعَالَى {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: ٢٢٩] فَاسْتَقْبَلَ النَّاسُ الطَّلَاقَ جَدِيدًا مِنْ يَوْمِئِذٍ مَنْ كَانَ مِنْهُمْ طَلَّقَ أَوْ لَمْ يُطَلِّقْ " هَذَا مُرْسَلٌ وَهُوَ الصَّحِيحُ قَالَهُ الْبُخَارِيُّ وَغَيْرُهُ.
Hisham bin Urwah (may Allah have mercy on him) narrates from his father: When a man divorced his wife and then took her back before her waiting period ended, she would remain his, even if he gave a thousand divorces. Then a man went to his wife and divorced her, then gave her time, and when her waiting period was about to end, he took her back and then divorced her again, and said: I will neither keep you with me nor let you go. So Allah, the Lord of Might, said: "Divorce is twice; then either retain her in an acceptable manner or release her with kindness." [Surah al-Baqarah: 229] So from that day people began divorce afresh, whether one had divorced or had not divorced.

وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أنا أَبُو بَكْرِ بْنُ إِسْحَاقَ، أنا بِشْرُ بْنُ مُوسَى، نا الْحُمَيْدِيُّ، نا سُفْيَانُ، نا الزُّهْرِيُّ، أَخْبَرَنِي عُرْوَةُ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَنَّهُ سَمِعَهَا تَقُولُ: جَاءَتِ امْرَأَةُ رِفَاعَةَ الْقُرَظِيِّ إِلَى رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: يَا رَسُولَ اللهِ إِنِّي كُنْتُ عِنْدَ رِفَاعَةَ الْقُرَظِيِّ فَطَلَّقَنِي فَبَتَّ طَلَاقِي فَتَزَوَّجْتُ بَعْدَهُ عَبْدَ الرَّحْمَنِ بْنَ الزُّبَيْرِ وَإِنَّمَا مَعَهُ مِثْلُ ⦗٥٤٦⦘ هُدْبَةِ الثَّوْبِ فَتَبَسَّمَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَقَالَ: " تُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ لَا حَتَّى تَذُوقِي عُسَيْلَتَهُ وَيَذُوقَ عُسَيْلَتَكِ " وَأَبُو بَكْرٍ رَضِيَ اللهُ عَنْهُ عِنْدَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَخَالِدُ بْنُ سَعِيدِ بْنِ الْعَاصِ بِالْبَابِ يَنْتَظِرُ أَنْ يُؤْذَنَ لَهُ فَنَادَى، فَقَالَ: يَا أَبَا بَكْرٍ أَلَا تَسْمَعُ إِلَى مَا تَهْجُرُ بِهِ هَذِهِ عِنْدَ رَسُولِ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ؟ أَخْرَجَاهُ فِي الصَّحِيحِ، مِنْ حَدِيثِ ابْنِ عُيَيْنَةَ وَغَيْرِهِ.
Urwah narrates from Sayyidah Aishah (may Allah be pleased with her) that the wife of Rifa'ah al-Qurazi came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah (peace and blessings be upon him)! I was married to Rifa'ah al-Qurazi, and he gave me three divorces. After him I married Abd al-Rahman bin al-Zubayr, and with him (the matter) is like the fringe of a garment. The Messenger of Allah (peace and blessings be upon him) smiled and said: "Do you want to go back to Rifa'ah? No, not until you taste his sweetness and he tastes your sweetness." Sayyiduna Abu Bakr (may Allah be pleased with him) was with the Prophet (peace and blessings be upon him), and Khalid bin Sa'id bin al-As (may Allah be pleased with him) was at the door waiting for permission. He called out: O Abu Bakr! Do you hear what this woman is openly saying in the presence of the Prophet (peace and blessings be upon him)?
أَخْبَرَنَا أَبُو عَمْرٍو مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ، أَخْبَرَنِي الْحَسَنُ هُوَ ابْنُ سُفْيَانَ نا مُحَمَّدُ بْنُ بَشَّارٍ، نا يَحْيَى بْنُ سَعِيدٍ، نا عُبَيْدُ اللهِ، نا الْقَاسِمُ، عَنْ عَائِشَةَ رَضِيَ اللهُ عَنْهَا أَنَّ رَجُلًا طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَتْ فَطَلَّقَ فَسُئِلَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَتَحِلُّ لِلْأَوَّلِ؟ قَالَ: " لَا حَتَّى تَذُوقَ عُسَيْلَتَهُ كَمَا ذَاقَ الْأَوَّلُ " رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ مُحَمَّدِ بْنِ بَشَّارٍ، وَرَوَاهُ مُسْلِمٌ عَنْ مُحَمَّدِ بْنِ الْمُثَنَّى عَنْ يَحْيَى، وَاحْتَجَّ الشَّافِعِيُّ رَحِمَهُ اللهُ أَيْضًا بِحَدِيثِ عُوَيْمِرٍ الْعَجْلَانِيِّ وَفَاطِمَةَ بِنْتِ قَيْسٍ وَقَدْ ذَكَرْنَاهُمَا.
Al-Qasim (may Allah have mercy on him) narrates from Sayyidah Aishah (may Allah be pleased with her) that a man gave (his wife) three divorces; then the woman married, and the second husband divorced her. The Prophet (peace and blessings be upon him) was asked: Is she lawful for the first husband? He (peace and blessings be upon him) said: "No, not until she tastes his sweetness as the first one tasted it."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو الْوَلِيدِ الْفَقِيهُ، نا جَعْفَرُ بْنُ أَحْمَدَ الْحَافِظُ، أنا عَلِيُّ بْنُ حُجْرٍ، نا إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ قَالَ: مَكَثْتُ عِشْرِينَ سَنَةً يُحَدِّثُنِي مَنْ لَا أَتَّهِمُهُمْ أَنَّ ابْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ ثَلَاثًا وَهِيَ حَائِضٌ فَأُمِرَ أَنْ يُرَاجِعَهَا فَجَعَلْتُ لَا أَتَّهِمُهُمْ وَلَا أَعْرِفُ الْحَدِيثَ حَتَّى لَقِيتُ أَبَا غَلَّابٍ يُونُسَ بْنَ جُبَيْرٍ وَكَانَ ذَا ثَبْتٍ فَحَدَّثَنِي أَنَّهُ سَأَلَ ابْنَ عُمَرَ فَحَدَّثَهُ أَنَّهُ " طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ تَطْلِيقَةً فَأُمِرَ أَنْ يُرَاجِعَهَا "، قَالَ: فَقُلْتُ أَفَحُسِبَتْ عَلَيْهِ؟ قَالَ: " فَمَهْ وَإِنْ عَجَزَ وَاسْتَحْمَقَ " رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ عَلِيِّ بْنِ حُجْرٍ.
Ibn Sirin (may Allah have mercy on him) says: For 20 years people whom I do not suspect told me that Ibn Umar (may Allah be pleased with them both) gave his wife three divorces while she was menstruating, and he was ordered to take her back. I did not suspect them, yet I did not recognise the hadith, until I met Abu Ghallab Yunus bin Jubayr, who was reliable, and he told me that he had asked Ibn Umar, and he told him that he had given his wife one divorce while she was menstruating and was ordered to take her back. He says: I said: Was it counted against him? He said: What else, even if he was helpless and acted foolishly?
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ قَالَا: نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا أَبُو أُمَيَّةَ الطَّرَسُوسِيُّ، نا مُعَلَّى بْنُ مَنْصُورٍ الرَّازِيُّ، نا شُعَيْبُ بْنُ رُزَيْقٍ، أَنَّ عَطَاءً الْخُرَاسَانِيَّ حَدَّثَهُمْ، عَنِ الْحَسَنِ، نا عَبْدُ اللهِ بْنُ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً وَهِيَ حَائِضٌ ثُمَّ أَرَادَ أَنْ يُتْبِعَهَا بِتَطْلِيقَتَيْنِ أُخْرَاوَيْنِ عِنْدَ الْقُرْئَيْنِ الْبَاقِيَيْنِ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ⦗٥٤٧⦘ فَقَالَ: " يَا ابْنَ عُمَرَ مَا هَكَذَا أَمَرَ اللهُ تَبَارَكَ وَتَعَالَى إِنَّكَ قَدْ أَخْطَأْتَ السُّنَّةَ وَالسُّنَّةُ أَنْ تَسْتَقْبِلَ الطُّهْرَ فَتُطَلِّقَ لِكُلِّ قُرْءٍ " قَالَ: فَأَمَرَنِي رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَرَاجَعْتُهَا ثُمَّ قَالَ لِي: " إِذَا هِيَ طَهُرَتْ فَطَلِّقْ عِنْدَ ذَلِكَ أَوْ أَمْسِكْ " فَقُلْتُ: يَا رَسُولَ اللهِ أَفَرَأَيْتَ لَوْ أَنِّي طَلَّقْتُهَا ثَلَاثًا كَانَ يَحِلُّ لِي أَنْ أُرَاجِعَهَا؟ قَالَ: " لَا كَانَتْ تَبِينُ مِنْكَ وَتَكُونُ مَعْصِيَةً ".
Al-Hasan (may Allah have mercy on him) says that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was menstruating and also intended to give the remaining two divorces. The Prophet (peace and blessings be upon him) came to know of it, and he (peace and blessings be upon him) said: "O Ibn Umar! Is this how Allah, the Lord of Might, has commanded? You have gone against the Sunnah, and the Sunnah way is that you divorce in each period of purity." Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) says: He (peace and blessings be upon him) ordered me to take her back, then said to me: "When she becomes pure, then divorce her at that time or keep her." I said: O Messenger of Allah (peace and blessings be upon him)! What is your view if I give her three divorces: would it be lawful for me to take her back? He (peace and blessings be upon him) said: "No, she would be separated from you, and you would have committed disobedience."
أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ، أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ قَالَ: قُرِئَ عَلَى عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ وَأَنَا أَسْمَعُ حَدَّثَكُمْ إِسْمَاعِيلُ بْنُ إِبْرَاهِيمَ التَّرْجُمَانِيُّ أَبُو إِبْرَاهِيمَ نا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ أَنَّ رَجُلًا أَتَى عُمَرَ رَضِيَ اللهُ عَنْهُ فَقَالَ: إِنِّي طَلَّقْتُ امْرَأَتِي يَعْنِي الْبَتَّةَ وَهِيَ حَائِضٌ قَالَ: عَصَيْتَ رَبَّكَ وَفَارَقْتَ امْرَأَتَكَ، فَقَالَ الرَّجُلُ: فَإِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَمَرَ ابْنَ عُمَرَ رَضِيَ اللهُ عَنْهُمَا حِينَ فَارَقَ امْرَأَتَهُ أَنْ يُرَاجِعَهَا، فَقَالَ لَهُ عُمَرُ رَضِيَ اللهُ عَنْهُ: إِنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ " أَمَرَهُ أَنْ يُرَاجِعَ امْرَأَتَهُ لِطَلَاقٍ بَقِيَ لَهُ، وَإِنَّهُ لَمْ يَبْقَ لَكَ مَا تَرْتَجِعُ بِهِ امْرَأَتَكَ ".
Nafi' narrates from Ibn Umar (may Allah be pleased with them both) that a man came to Sayyiduna Umar (may Allah be pleased with him) and said: "I have given my wife a battah (irrevocable) divorce while she was menstruating." He said: "You have disobeyed your Lord and separated from your wife." The man said that the Messenger of Allah (peace and blessings be upon him) had ordered Ibn Umar (may Allah be pleased with them both), when he separated from his wife, to take her back. Sayyiduna Umar (may Allah be pleased with him) said: "The Messenger of Allah (peace and blessings be upon him) ordered him to take her back because a divorce remained for him, but no divorce remains for you by which you could take your wife back."
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ الْمُنَادِي، نا وَهْبُ بْنُ جَرِيرٍ، نا شُعْبَةُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ زَيْدِ بْنِ وَهْبٍ، أَنَّ بَطَّالًا كَانَ بِالْمَدِينَةِ فَطَلَّقَ امْرَأَتَهُ أَلْفًا فَرُفِعَ ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ فَقَالَ: إِنَّمَا كُنْتُ أَلْعَبُ فَعَلَاهُ عُمَرُ رَضِيَ اللهُ عَنْهُ بِالدِّرَّةِ وَقَالَ: " إِنْ كَانَ لَيَكْفِيكَ ثَلَاثٌ ".
Zayd bin Wahb (may Allah have mercy on him) says that there was an idle man in Madinah who gave his wife a thousand divorces. The matter reached Sayyiduna Umar (may Allah be pleased with him), and the man said: I was only joking. Sayyiduna Umar (may Allah be pleased with him) struck him with the whip and said: Three divorces would have been enough for you.
وَأَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنا أَبُو الْفَضْلِ بْنُ خُمَيْرَوَيْهِ، نا أَحْمَدُ بْنُ نَجْدَةَ، نا سَعِيدُ بْنُ مَنْصُورٍ، نا سُفْيَانُ، عَنْ شَقِيقٍ، سَمِعَ أَنَسَ بْنَ مَالِكٍ يَقُولُ: قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: " هِيَ ثَلَاثٌ لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ " وَكَانَ إِذَا أُتِيَ بِهِ أَوْجَعَهُ.
Sayyiduna Anas bin Malik (may Allah be pleased with him) says that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) said concerning a man who gave his wife three divorces before consummating the marriage: All three have taken effect; this woman is not lawful for that man until she marries another man. And when such a person was brought to him, he would punish him.
أَخْبَرَنَا أَبُو عَمْرٍو الرَّزْجَاهِيُّ، ثنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ قَالَ: قَرَأْتُ عَلَى أَبِي مُحَمَّدٍ إِسْمَاعِيلَ بْنِ مُحَمَّدٍ الْكُوفِيِّ نا أَبُو نُعَيْمٍ الْفَضْلُ بْنُ دُكَيْنٍ، نا حَسَنٌ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ فِيمَنْ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: " لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ".
Abd al-Rahman bin Abi Layla narrates from Sayyiduna Ali (may Allah be pleased with him) concerning a man who gave his wife three divorces before consummating the marriage. He (may Allah be pleased with him) said: This woman is not lawful for him until she marries another man.
وَحَدَّثَنَا أَبُو نُعَيْمٍ، أنا حَاتِمُ بْنُ إِسْمَاعِيلَ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ رَضِيَ اللهُ عَنْهُ قَالَ: " لَا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ".
Ja'far bin Muhammad narrates from his father that Sayyiduna Ali (may Allah be pleased with him) said: That woman is not lawful for him until she marries another man.
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ مُحَمَّدُ بْنُ عَلِيِّ بْنِ حُبَيْشٍ الْمُقْرِئُ بِالْكُوفَةِ أنا أَبُو ⦗٥٤٨⦘ إِسْحَاقَ إِبْرَاهِيمُ بْنُ عَبْدِ اللهِ الْأَزْدِيِّ بْنِ أَبِي الْعَزَائِمِ أنا أَحْمَدُ بْنُ حَازِمٍ، أنا أَبُو نُعَيْمٍ، عَنِ الْأَعْمَشِ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ بَعْضِ أَصْحَابِهِ قَالَ: جَاءَ رَجُلٌ إِلَى عَلِيٍّ رَضِيَ اللهُ عَنْهُ فَقَالَ: طَلَّقْتُ امْرَأَتِي أَلْفًا قَالَ: " ثَلَاثٌ تُحَرِّمُهَا عَلَيْكَ وَاقْسِمْ سَائِرَهَا بَيْنَ نِسَائِكَ ".
Habib bin Abi Thabit narrates from some of his companions that a man came to Sayyiduna Ali (may Allah be pleased with him) and said: I have given my wife a thousand divorces. He said: Three divorces have made your wife unlawful for you, and distribute all the remaining divorces among your (other) wives.
أَخْبَرَنَا عَلِيُّ بْنُ أحمد بن عَبْدَانَ، أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، نا يُوسُفُ الْقَاضِي، نا سُلَيْمَانُ بْنُ حَرْبٍ، نا يَزِيدُ بْنُ إِبْرَاهِيمَ قَالَ: سَمِعْتُ مُحَمَّدَ بْنَ سِيرِينَ قَالَ: حَدَّثَنِي عَلْقَمَةُ بْنُ قَيْسٍ قَالَ: أَتَى رَجُلٌ ابْنَ مَسْعُودٍ رَضِيَ اللهُ عَنْهُ فَقَالَ إِنَّ رَجُلًا طَلَّقَ امْرَأَتَهُ الْبَارِحَةَ مِائَةً قَالَ: " قُلْتَهَا مَرَّةً وَاحِدَةً؟ " قَالَ: نَعَمْ قَالَ: " تُرِيدُ أَنْ تَبِينَ مِنْكَ امْرَأَتُكَ؟ " قَالَ: نَعَمْ قَالَ: هُوَ كَمَا قُلْتَ، قَالَ: وَأَتَاهُ رَجُلٌ فقال رجل طَلَّقَ امْرَأَتَهُ الْبَارِحَةَ عَدَدَ النُّجُومِ قَالَ: " قُلْتَهَا مَرَّةً وَاحِدَةً؟ " قَالَ: نَعَمْ قَالَ: تُرِيدُ أَنْ تَبِينَ مِنْكَ امْرَأَتُكَ؟ قَالَ: نَعَمْ قَالَ: هُوَ كَمَا قُلْتَ، قَالَ مُحَمَّدٌ: فَذَكَرَ مِنْ نِسَاءِ أَهْلِ الْأَرْضِ كَلِمَةً لَا أَحْفَظُهَا قَالَ: قَدْ بَيَّنَ اللهُ أَمْرَ الطَّلَاقِ فَمَنْ طَلَّقَ كَمَا أَمَرَهُ اللهُ فَقَدْ تَبَيَّنَ لَهُ وَمَنْ لَبَسَ عَلَيْهِ جَعَلْنَا بِهِ لُبْسَهُ وَاللهِ لَا تَلْبَسُونَ عَلَى أَنْفُسِكُمْ وَنَتَحَمَّلُهُ عَنْكُمْ هُوَ كَمَا تَقُولُونَ.
Alqamah bin Qays (may Allah have mercy on him) says: A man came to Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) and said that a man had given his wife a hundred divorces last night. He asked: Did he say it in one go? He said: Yes. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Was it your intention that your wife be separated from you? He said: Yes. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: It is just as you said. The narrator says: Then another man came and said that a man had given his wife divorces equal to the number of the stars last night. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) asked: Did you say this to your wife in one go? He said: Yes. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Did you intend to separate your wife? He said: Yes. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: It is just as you said. Muhammad (may Allah have mercy on him) says: He also said something about the women of the people of the earth, which I could not remember. Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: Allah, the Lord of Might, has made the matter of divorce clear. Whoever divorces as Allah, the Lord of Might, has commanded, (the ruling) is clear for him; and whoever confuses the matter upon himself, we likewise (judge) him by his confusion. By Allah! Do not confuse the matter upon yourselves; we accept from you just as you say.
وَأَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، أنا أَبُو حَامِدِ بْنُ بِلَالٍ، نا يَحْيَى بْنُ الرَّبِيعِ الْمَكِّيُّ، نا سُفْيَانُ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، عَنْ عَلْقَمَةَ قَالَ: كُنَّا عِنْدَ عَبْدِ اللهِ فَذَكَرَ مَعْنَاهُ وَاللَّفْظُ مُخْتَلِفٌ.
Alqamah (may Allah have mercy on him) says: We were with Abdullah (may Allah be pleased with him). He mentioned its meaning, and the wording is different.
أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنا أَبُو عَمْرِو بْنُ نُجَيْدٍ، أنا أَبُو مُسْلِمٍ الْكَجِّيُّ، نا عَبْدُ الرَّحْمَنِ بْنُ حَمَّادٍ، نا سُفْيَانُ، عَنْ عَاصِمِ ابْنِ بَهْدَلَةَ، عَنْ زِرٍّ، عَنْ عَبْدِ اللهِ قَالَ: " الْمُطَلَّقَةُ ثَلَاثًا قَبْلَ أَنْ يُدْخَلَ بِهَا بِمَنْزِلَةِ الَّتِي قَدْ دُخِلَ بِهَا ".
Sayyiduna Abdullah (may Allah be pleased with him) says: A woman divorced three times before the marriage is consummated is in the same position as the one with whom the marriage has been consummated.
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ، بِبَغْدَادَ أنا عَبْدُ اللهِ بْنُ جَعْفَرِ بْنِ دُرُسْتَوَيْهِ، نا يَعْقُوبُ بْنُ سُفْيَانَ، نا ابْنُ قَعْنَبٍ، وَابْنُ بُكَيْرٍ عَنْ مَالِكٍ، ح وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنا الرَّبِيعُ بْنُ سُلَيْمَانَ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ ثَوْبَانَ، عَنْ مُحَمَّدِ بْنِ إِيَاسِ بْنِ الْبُكَيْرِ قَالَ: طَلَّقَ رَجُلٌ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا ثُمَّ بَدَا لَهُ أَنْ يَنْكِحَهَا فَجَاءَ يَسْتَفْتِي فَذَهَبْتُ مَعَهُ اسْأَلُ لَهُ فَسَأَلَ أَبَا هُرَيْرَةَ وَعَبْدَ اللهِ بْنَ عَبَّاسٍ عَنْ ذَلِكَ فَقَالَا: " لَا نَرَى أَنْ تَنْكِحَهَا ⦗٥٤٩⦘ حَتَّى تَنْكِحَ زَوْجًا غَيْرَكَ "، قَالَ: إِنَّمَا كَانَ طَلَاقِي إِيَّاهَا وَاحِدَةً، فَقَالَ ابْنُ عَبَّاسٍ: " إِنَّكَ أَرْسَلْتَ مِنْ يَدِكَ مَا كَانَ لَكَ مِنْ فَضْلٍ ".
Muhammad bin Iyas bin al-Bukayr says: A man gave his wife three divorces before consummating the marriage. Later he decided to marry the same woman, so he came to ask for a fatwa. I went with him to ask about the matter for him, and he asked Abu Hurayrah (may Allah be pleased with him) and Abdullah bin Abbas (may Allah be pleased with them both) about it. Both of them said: "Do not marry this woman until she marries another man." He said: My divorce of her was only one. Ibn Abbas (may Allah be pleased with them both) said: "You have let go from your hand the extra that you had."
أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، نا أَبُو الْعَبَّاسِ، أنا الرَّبِيعُ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُكَيْرٍ يَعْنِي ابْنَ عَبْدِ اللهِ بْنَ الْأَشَجِّ أَخْبَرَهُ، عَنْ مُعَاوِيَةَ بْنِ أَبِي عَيَّاشٍ الْأَنْصَارِيِّ، أَنَّهُ كَانَ جَالِسًا مَعَ عَبْدِ اللهِ بْنِ الزُّبَيْرِ وَعَاصِمِ بْنِ عُمَرَ رَضِيَ اللهُ عَنْهُمْ قَالَ: فَجَاءَهُمَا مُحَمَّدُ بْنُ إِيَاسِ بْنِ الْبُكَيْرِ فَقَالَ: إِنَّ رَجُلًا مِنْ أَهْلِ الْبَادِيَةِ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا فَمَاذَا تَرَيَانِ فَقَالَ ابْنُ الزُّبَيْرِ: " إِنَّ هَذَا لَأَمْرٌ مَا لَنَا فِيهِ قَوْلٌ اذْهَبْ إِلَى ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ فَإِنِّي تَرَكْتُهُمَا عِنْدَ عَائِشَةَ رَضِيَ اللهُ عَنْهَا فَسَلْهُمَا ثُمَّ ائْتِنَا فَأَخْبِرْنَا فَذَهَبَ فَسَأَلَهُمَا قَالَ ابْنُ عَبَّاسٍ لِأَبِي هُرَيْرَةَ: أَفْتِهِ يَا أَبَا هُرَيْرَةَ فَقَدْ جَاءَتْكَ مُعْضِلَةٌ، فَقَالَ أَبُو هُرَيْرَةَ " الْوَاحِدَةُ تُبِينُهَا وَالثَّلَاثُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ " وَقَالَ ابْنُ عَبَّاسٍ مِثْلَ ذَلِكَ.
Mu'awiyah bin Abi Ayyash al-Ansari (may Allah have mercy on him) says that he was sitting with Sayyiduna Abdullah bin al-Zubayr and Sayyiduna Asim bin Umar (may Allah be pleased with them) when Muhammad bin Iyas bin al-Bukayr came to them and said: A man from the desert people has given his wife three divorces before consummating the marriage; what is your view on this? Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him) said: We have no view on this matter. Go to Sayyiduna Abu Hurayrah (may Allah be pleased with him) and Sayyiduna Ibn Abbas (may Allah be pleased with them both); I left them both with Sayyidah Aishah (may Allah be pleased with her). Go and ask them, then come and tell us as well. He went and asked them, and Sayyiduna Ibn Abbas (may Allah be pleased with them both) said to Sayyiduna Abu Hurayrah (may Allah be pleased with him): O Abu Hurayrah (may Allah be pleased with him)! Give him a fatwa, for a difficult matter has come to you. Sayyiduna Abu Hurayrah (may Allah be pleased with him) said: One divorce separates husband and wife, and three divorces make the wife unlawful until that woman marries another man. Sayyiduna Ibn Abbas (may Allah be pleased with them both) said the same.
وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، نا أَبُو الْعَبَّاسِ، أنا الرَّبِيعُ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُكَيْرِ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ، عَنِ النُّعْمَانِ بْنِ أَبِي عَيَّاشٍ الْأَنْصَارِيِّ، عَنْ عَطَاءِ بْنِ يَسَارٍ قَالَ: جَاءَ رَجُلٌ يَسْتَفْتِي عَبْدَ اللهِ بْنَ عَمْرِو بْنِ الْعَاصِ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَمَسَّهَا فَقَالَ عَطَاءٌ فَقُلْتُ: إِنَّمَا طَلَاقُ الْبِكْرِ وَاحِدَةٌ، فَقَالَ لِي عَبْدُ اللهِ بْنُ عَمْرٍو: " إِنَّمَا أَنْتَ قَاصٌّ الْوَاحِدَةُ تُبِينُهَا وَالثَّلَاثُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ".
Al-Nu'man bin Abi Ayyash al-Ansari narrates from Ata' bin Yasar (may Allah have mercy on him) that a man came to Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) to ask about a man who had given his wife three divorces before having intercourse with her. Ata' (may Allah have mercy on him) says: I said: The divorce of a virgin is one. Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) said to me: You are only a storyteller. One divorce separates the wife, and three divorces make her unlawful until that woman marries another man.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي عَلِيُّ بْنُ حَمْشَاذٍ، أَخْبَرَنِي يَزِيدُ بْنُ الْهَيْثَمِ أَنَّ إِبْرَاهِيمَ بْنَ أَبِي اللَّيْثِ حَدَّثَهُمْ، عَنِ الْأَشْجَعِيِّ، عَنْ سُفْيَانَ، عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ قَالَ: " إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ ثَلَاثًا قَبْلَ أَنْ يَدْخُلَ لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ".
Nafi' (may Allah have mercy on him) narrates from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): When a man gives his wife three divorces before consummating the marriage, this woman is not lawful for that man until she marries another man.
وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ الْعَدْلُ، بِبَغْدَادَ أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، نا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ، نا ابْنُ نُمَيْرٍ، عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، أَنَّ رَجُلًا سَأَلَ ابْنَ عُمَرَ فَقَالَ: طَلَّقْتُ امْرَأَتِي ثَلَاثًا وَهِيَ حَائِضٌ فَقَالَ: " عَصَيْتَ رَبَّكَ وَفَارَقْتَ امْرَأَتَكَ ".
Nafi' (may Allah have mercy on him) says that a man asked Sayyiduna Abdullah bin Umar (may Allah be pleased with them both): I have given my wife three divorces while she was menstruating. He said: You have disobeyed your Lord and separated from your wife.
أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي مُحَمَّدُ بْنُ أَحْمَدَ بْنِ بَالَوَيْهِ، نا مُحَمَّدُ بْنُ غَالِبٍ، نا عُبَيْدُ اللهِ بْنُ مُعَاذٍ، نا أَبِي، نا شُعْبَةُ، عَنْ طَارِقِ بْنِ عَبْدِ الرَّحْمَنِ قَالَ: سَمِعْتُ قَيْسَ بْنَ أَبِي حَازِمٍ قَالَ: سَأَلَ رَجُلٌ الْمُغِيرَةَ بْنَ شُعْبَةَ وَأَنَا شَاهِدٌ، عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ مِائَةً قَالَ: " ثَلَاثٌ تُحَرِّمُ وَسَبْعٌ وَتِسْعُونَ فَضْلٌ ".
Qays bin Abi Hazim (may Allah have mercy on him) said: In my presence a man asked al-Mughirah bin Shu'bah (may Allah be pleased with him) about a man who had divorced his wife one hundred times. He said: Three divorces make the wife unlawful, and the 97 are excess.
أَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنا أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ، نا ⦗٥٥٠⦘ إِبْرَاهِيمُ بْنُ مُحَمَّدٍ الْوَاسِطِيُّ، نا مُحَمَّدُ بْنُ حُمَيْدٍ الرَّازِيُّ، نا سَلَمَةُ بْنُ الْفَضْلِ، عَنْ عَمْرِو بْنِ أَبِي قَيْسٍ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ الْأَعْلَى، عَنْ سُوَيْدِ بْنِ غَفَلَةَ قَالَ: كَانَتْ عَائِشَةُ الْخَثْعَمِيَّةُ عِنْدَ الْحَسَنِ بْنِ عَلِيٍّ رَضِيَ اللهُ عَنْهُ، فَلَمَّا قُتِلَ عَلِيٌّ رَضِيَ اللهُ عَنْهُ قَالَتْ: لِتَهْنِئْكَ الْخِلَافَةُ، قَالَ: بِقَتْلِ عَلِيٍّ تُظْهِرِينَ الشَّمَاتَةَ اذْهَبِي فَأَنْتِ طَالِقٌ، يَعْنِي ثَلَاثًا قَالَ: فَتَلَفَّعَتْ بِثِيَابِهَا وَقَعَدَتْ حَتَّى قَضَتْ عِدَّتَهَا فَبَعَثَ إِلَيْهَا بِبَقِيَّةٍ بَقِيَتْ لَهَا مِنْ صَدَاقِهَا وَعَشَرَةِ آلَافٍ صَدَقَةً، فَلَمَّا جَاءَهَا الرَّسُولُ قَالَتْ: مَتَاعٌ قَلِيلٌ مِنْ حَبِيبٍ مَفَارِقٍ، فَلَمَّا بَلَغَهُ قَوْلُهَا بَكَى ثُمَّ قَالَ: لَوْلَا أَنِّي سَمِعْتُ جَدِّي أَوْ حَدَّثَنِي أَبِي أَنَّهُ سَمِعَ جَدِّي يَقُولُ: " أَيُّمَا رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا عِنْدَ الْأَقْرَاءِ أَوْ ثَلَاثًا مُبْهَمَةً لَمْ تَحِلَّ لَهُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ " لَرَاجَعْتُهَا ". وَكَذَلِكَ رُوِيَ عَنْ عَمْرِو بْنِ شِمْرٍ عَنْ عِمْرَانَ بْنِ مُسْلِمٍ وَإِبْرَاهِيمُ بْنُ عَبْدِ الْأَعْلَى عَنْ سُوَيْدِ بْنِ غَفَلَةَ.
Suwayd bin Ghafalah (may Allah have mercy on him) said: Aishah al-Khath'amiyyah (may Allah be pleased with her) was married to al-Hasan bin Ali (may Allah be pleased with them both). When Ali (may Allah be pleased with him) was martyred, she said to al-Hasan bin Ali (may Allah be pleased with them both): Congratulations to you on the caliphate. Al-Hasan (may Allah be pleased with him) said: "You show joy at the killing of Ali (may Allah be pleased with him)! Go, you are divorced three times." She wrapped herself in her garments and sat until she completed her waiting period ('iddah). Then al-Hasan (may Allah be pleased with him) sent her the remainder of her dowry (mahr) and an additional ten thousand. When the messenger came, Aishah (may Allah be pleased with her) said: This is little wealth compared to a beloved who is parting. When Aishah's (may Allah be pleased with her) words reached al-Hasan (may Allah be pleased with him), he wept and then said: Had I not heard from my maternal grandfather, or had my father not told me, that he (peace and blessings be upon him) said: "Whoever divorces his wife three times at the time of the menstrual periods, or three times in an unspecified manner, she is not lawful for him until she marries another husband," I would certainly have taken her back.
