Imam al-Shafi'i (may Allah have mercy on him) said: "(Let him give one divorce) so that he retains the right to take back the woman with whom the marriage has been consummated, and, in the case of one with whom it has not been consummated, he can (again) be a suitor proposing to her; and whenever she is married (to him again), two divorces will remain for him over her.
And it is not unlawful for him to give two or three divorces, because Allah Almighty, glorified be His praise, has made divorce permissible for those entitled to it, and what He has made permissible is not forbidden to those entitled to it; and (also) because the Messenger of Allah (peace and blessings be upon him) taught Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) the (correct) time for divorce, and if some numbers of divorce were permissible and some forbidden, he (peace and blessings be upon him), Allah willing, would certainly have taught him that as well."

Sayyiduna Sahl bin Sa'd al-Sa'idi (may Allah be pleased with him) says regarding the li'an (mutual imprecation) of Uwaymir al-Ajlani that when the two of them had finished their li'an, Uwaymir said: If I keep her in my marriage, it will be as if I lied about her. So he gave her three divorces before the Messenger of Allah (peace and blessings be upon him) ordered him. It is stated in the book that Uwaymir gave three divorces in the presence of the Prophet (peace and blessings be upon him); had giving that been unlawful, he (peace and blessings be upon him) would have forbidden him. He says: If you must give divorce, then by giving three divorces together you will be a sinner, so do it this way.
The Shaykh said: In the narration of Ibn Umar (may Allah be pleased with them both) it is stated that the Prophet (peace and blessings be upon him) said about the two who made li'an: "Your reckoning is with Allah; one of you is a liar. You now have no authority over her." This is not in the narration of Sahl bin Sa'd (may Allah be pleased with him), and the three divorces are not in the narration of Ibn Umar (may Allah be pleased with them both). Imam al-Shafi'i (may Allah have mercy on him) took evidence from the hadith of Fatimah bint Qays (may Allah be pleased with her) that Abu Amr bin Hafs gave her three divorces, and no report has reached us that he (peace and blessings be upon him) forbade that.

Al-Sha'bi (may Allah have mercy on him) narrates from Sayyidah Fatimah bint Qays (may Allah be pleased with her) that she said: My husband gave me three divorces, and the matter was brought to the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) did not grant her housing or maintenance, and he (peace and blessings be upon him) ordered her to spend her waiting period at the house of Sayyiduna Ibn Umm Maktum (may Allah be pleased with him). In the narration of Urwah bin al-Zubayr (may Allah have mercy on him), Sayyidah Fatimah bint Qays (may Allah be pleased with her) said: O Messenger of Allah (peace and blessings be upon him)! My husband has given me three divorces, and I fear that someone will break in upon me. He (peace and blessings be upon him) gave her an order, and she moved from there.

Al-Qasim narrates from Sayyidah Aishah (may Allah be pleased with her) that a man gave his wife three divorces; then another man married that woman and divorced her before having intercourse with her. The Prophet (peace and blessings be upon him) was asked: Is this woman lawful for the first husband? He (peace and blessings be upon him) said: "No, not until the second husband tastes her sweetness as the first one tasted it."
Note: Imam al-Shafi'i (may Allah have mercy on him) says that Rukanah (may Allah be pleased with him) gave his wife a battah (irrevocable) divorce, which could mean one or three divorces, so the Prophet (peace and blessings be upon him) asked him about his intention and made him swear to it; and we do not know that he (peace and blessings be upon him) forbade three divorces. And Sayyiduna Abd al-Rahman bin Awf (may Allah be pleased with him) gave his wife three divorces.

Salamah bin Abi Salamah (may Allah have mercy on him) narrates from his father that it was mentioned in his presence that giving three divorces at one time is disliked. He said: Hafs bin Amr bin al-Mughirah gave Fatimah bint Qays (may Allah be pleased with her) three divorces at one time, and we do not know that the Prophet (peace and blessings be upon him) found fault with it; and Sayyiduna Abd al-Rahman bin Awf (may Allah be pleased with him) gave his wife three divorces and no one objected to him.
Note: Sayyiduna Abdullah bin Abbas, Sayyiduna Abu Hurayrah and Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them) say: Whoever gives his wife three divorces before consummating the marriage cannot marry her again until another man marries her and divorces her. The narrator says: Sayyiduna Abdullah bin Abbas and Sayyiduna Abu Hurayrah (may Allah be pleased with them both) did not object to giving three divorces together, and Sayyiduna Abdullah bin Amr (may Allah be pleased with them both) did not say: You did a bad thing by giving three divorces.

Al-Hasan (may Allah have mercy on him) says that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) gave his wife one divorce while she was menstruating, then intended to follow it with the remaining two divorces at the two remaining periods. The matter reached the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Allah did not command you like this; you have gone against the Sunnah. The Sunnah is that you wait for the state of purity and divorce at each period of purity." He says: The Prophet (peace and blessings be upon him) ordered me to take her back, and said: "When she becomes pure, divorce or keep her." I said: O Messenger of Allah (peace and blessings be upon him)! What is your view: if I had given her three divorces, would it be lawful for me to take her back? He (peace and blessings be upon him) said: "She would be separated from you, and it would be a sin."
These additions are narrated from Ata' al-Khurasani and are not in anyone else's narration, and the scholars have criticised him. It seems that his words "and it would be a sin" refer to his pronouncing the three divorces in the state of menstruation; and Allah knows best.

Nafi' narrates from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that he gave his wife one divorce while she was menstruating, so the Messenger of Allah (peace and blessings be upon him) ordered him to take her back: "then keep her until she becomes pure, then after another menstruation give her time until she becomes pure; then if he intends to divorce her, let him divorce her in the state of purity before having intercourse with her. This is the waiting period for which Allah, the Lord of Might, has commanded that women be divorced." And when Sayyiduna Ibn Umar (may Allah be pleased with them both) was asked about this, he would say: If you have given your wife three divorces, she has become unlawful for you until she marries another husband, and you have disobeyed the command of Allah, the Lord of Might, that He gave regarding divorcing women.

Nafi' says that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) said: "If you divorced once or twice, the Messenger of Allah (peace and blessings be upon him) ordered me to do this."
(b) Nafi' says that Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) divorced his wife while she was menstruating. He mentioned the hadith, and when Sayyiduna Abdullah (may Allah be pleased with him) was asked about this, he would say: "As for you, if you divorced your wife once or twice, then the Messenger of Allah (peace and blessings be upon him) ordered me to do this; but if you have given your wife three divorces, she is unlawful for you until she marries another man, and you have disobeyed the command of Allah that He gave regarding divorcing your wife." That is, there is no taking back after three divorces; taking back is only after one or two divorces.
And his words "and you have disobeyed the command of Allah regarding divorcing your wife" mean: when you divorced her in the state of menstruation; so this statement goes back to the original issue. As for the distinction (between one or two and three), it is for establishing or ending the right to take her back, not for attaching the sin to one of them rather than the other.
As for the narration of Nafi': "then let him keep her until she becomes pure, then she has another menstruation while with him, then let him give her time until she becomes pure from her menstruation," Imam al-Shafi'i (may Allah have mercy on him) says: It is possible that by this he meant istibra' (confirming the womb is free) by a complete purity and then a complete menstruation, so that it becomes known whether her waiting period is by delivery of the pregnancy or by menstruations; so that he either divorces after knowing of the pregnancy or keeps her because of the pregnancy; and so that if she had asked for divorce while not pregnant, she might refrain from it once pregnant. Others besides Nafi' narrate from Sayyiduna Ibn Umar (may Allah be pleased with them both): once she becomes pure from the menstruation in which he divorced her, let him then divorce or keep her.

(b) Nafi' narrates from Ibn Umar (may Allah be pleased with them both) that the Prophet (peace and blessings be upon him) "ordered him to take her back until she becomes pure, then menstruates and becomes pure; then if he wishes, he may divorce or keep her."

Mujahid (may Allah have mercy on him) says: I was with Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) when a man came to him and said that he had given his wife three divorces. The narrator says: Ibn Abbas (may Allah be pleased with them both) remained silent, until we thought that he would return his wife to him. Then he said: One of you does a foolish thing and then says: O Ibn Abbas! O Ibn Abbas! Allah, the Lord of Might, says: "And whoever fears Allah, He will make for him a way out." [Surah al-Talaq: 2] You did not fear Allah, so I do not find a way out for you. You have disobeyed Allah, and your wife has become separated from you. Allah says: "O Prophet, when you divorce women, divorce them at the start of their waiting period." [Surah al-Talaq: 1] In this narration it is (stated as) three in this way.

He said: Three divorces have made your wife unlawful for you, and the rest are a sin upon you, for you have made a mockery of the verses of Allah. So this hadith indicates the sin of giving more than three divorces.
