It is narrated from Sayyiduna Zayd bin Khalid al-Juhani (may Allah be pleased with him) that a man came to the Messenger of Allah (peace and blessings be upon him) and asked about a found item (luqatah). He (peace and blessings be upon him) said: "Recognise its container and its tie well, then announce it for a year. If its owner comes, give it to him; otherwise it is yours." He asked: "What is the ruling on a stray sheep?" He (peace and blessings be upon him) said: "It is for you, or for your brother, or for the wolf." He asked about a stray camel, and he (peace and blessings be upon him) said: "What have you to do with it? It has its water supply and its hooves with it; it can go down to water and eat the leaves of trees until its owner finds it."

He was asked about a camel, and his (peace and blessings be upon him) face turned red and he became angry. He (peace and blessings be upon him) said: "It has its water supply and its hooves with it; it can drink water and eat the leaves of trees." He was asked about (found) money, and he (peace and blessings be upon him) said: "Announce it for a year. If its owner comes, give it to him; otherwise, recognise its tie and its container well and then add it to your own wealth; if its owner comes, give it to him."

Salamah bin Kuhayl (may Allah have mercy on him) said: I heard Suwayd bin Ghafalah (may Allah have mercy on him) say: I was on a military expedition and found a whip, and I picked it up. Zayd bin Suhan and Salman bin Rabi'ah (may Allah be pleased with them both) said to me: "Throw it away." I refused. We completed our expedition. Then I performed Hajj and passed through Madinah, where I met Ubayy bin Ka'b (may Allah be pleased with him). I mentioned this incident to him, and he said to me: In the time of the Messenger of Allah (peace and blessings be upon him) I found a purse containing a hundred dinars. I brought it to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) said to me: "Announce it for a year." I announced it for a year, but I found no one who recognised it. I came back to the Messenger of Allah (peace and blessings be upon him) again, and he (peace and blessings be upon him) said: "Announce it for a year." I did so, then returned to the Messenger of Allah (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Announce it for another year." I did so, then returned to the Messenger of Allah (peace and blessings be upon him). The fourth time he (peace and blessings be upon him) said: "Count them and remember its tie well. If its owner comes, give it to him; otherwise, make use of it." Salamah (may Allah have mercy on him) said: I do not know whether he (peace and blessings be upon him) said to announce it three times or once.

Salamah bin Kuhayl said at the end (of his narration): "If its owner comes, give it to him; otherwise, it takes the course of your own property."
In one narration the wording is: "Otherwise, make use of it"; another wording is: "Benefit from it"; another wording is: "Then meet your need with it"; and another is: "Make use of it." All of them come back to one meaning.

It is narrated from Sayyiduna Iyad bin Himar al-Mujashi'i (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said: "Whoever finds a lost item, let him take two upright persons, or one, as witnesses, and let him neither conceal it nor hide it away. If its owner comes, he has the most right to it; otherwise it is the wealth of Allah, which He gives to whomever He wills."

Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) narrates from the Prophet (peace and blessings be upon him) that he was asked about a found item, and he (peace and blessings be upon him) said: "Whatever is found on a frequented road or in an inhabited town, announce it for a year. If its owner comes, give it to him; if he does not come, it is yours. And whatever is found in a ruin, then in it and in buried treasure (rikaz) there is one fifth (khumus)."

Sayyiduna Sufyan bin Abdullah (may Allah be pleased with him) found a bag and brought it to Sayyiduna Umar bin al-Khattab (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) said: "Announce it for a year; if it is recognised, well and good, otherwise it is yours." It was not recognised, so he met him with it the following year during the (Hajj) season and mentioned it to him. Sayyiduna Umar (may Allah be pleased with him) said: "It is yours, for the Messenger of Allah (peace and blessings be upon him) commanded us to do so." He said: "I have no need of it." So Sayyiduna Umar (may Allah be pleased with him) took it and placed it in the public treasury (bayt al-mal).
It has also been narrated to us from Sayyidah Aishah (may Allah be pleased with her) that a woman asked her about a found item, and Sayyidah Aishah (may Allah be pleased with her) said: "Make use of it."

It is narrated from Ata bin Yasar (may Allah have mercy on him) that Sayyiduna Ali (may Allah be pleased with him) found a dinar in the time of the Messenger of Allah (peace and blessings be upon him). He (peace and blessings be upon him) ordered: "Announce it," but no one recognised it. He (peace and blessings be upon him) ordered Sayyiduna Ali (may Allah be pleased with him): "Consume it." Then its owner came, and he (peace and blessings be upon him) ordered Sayyiduna Ali (may Allah be pleased with him): "Pay it back."
Imam al-Shafi'i (may Allah have mercy on him) said: Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) is among those for whom charity is unlawful, because he is from Banu Hashim.

Huzayl (may Allah have mercy on him) said: I saw Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) when a man came to him with a sealed purse and said: "I have announced it, but no one has recognised it." Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "Make use of it."
Imam al-Shafi'i (may Allah have mercy on him) said: This is what is established from the Sunnah of the Prophet (peace and blessings be upon him). And they narrated a hadith from Amir, from his father Abdullah (may Allah have mercy on him), that Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) bought a slave-girl; her owner went away, so he gave her price in charity and said: 'Allahumma hadha 'an rabbiha' (O Allah, this is on behalf of her owner); "If he disapproves, then it is mine and its price is upon me." Then he said: "This is how a found item is to be dealt with." They opposed the Sunnah regarding found items, having no proof with them; and they opposed the hadith of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) which agrees with the Sunnah and which is established in their view; and they took this hadith as evidence while they themselves oppose it in the very matter it concerns.
The Shaykh (al-Bayhaqi) said: It has been narrated from Sayyiduna Ali (may Allah be pleased with him), as his own statement, something that agrees with the view of the Iraqis.

It is narrated from Asim bin Damrah (may Allah have mercy on him) that a man from Banu Ru'as found a purse. He brought the purse to Sayyiduna Ali (may Allah be pleased with him) and said: "I found money in it, and I have announced it, but no one has recognised it, and I began to wish that no one would come to recognise it." Sayyiduna Ali (may Allah be pleased with him) said: "Give it in charity. If its owner comes and is pleased with the charity, the reward will be his; otherwise, you must pay it (the money) to him, and the reward will be yours."
Asim bin Damrah is not strong. We have narrated from Sayyiduna Ali (may Allah be pleased with him), attributed to the Prophet (marfu'), that consuming it is permissible, and we have narrated it through authentic connected chains from the Prophet (peace and blessings be upon him); and the established Sunnah of the Messenger of Allah (peace and blessings be upon him) is more deserving of being followed. And success is from Allah.

Ibn Umar (may Allah be pleased with them both) said to him: "Announce it." He said: "I have done so." Ibn Umar (may Allah be pleased with them both) said: "Do so more." He said: "I have done so." Ibn Umar (may Allah be pleased with them both) said: "I do not order you to consume it; had you wished, you would not have picked it up."
