It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) acquired land at Khaybar. He said: O Messenger of Allah, I have acquired land such that nothing is dearer to me than it. What do you (peace and blessings be upon him) command me regarding it? He (peace and blessings be upon him) said: "If you wish, give its produce in charity and retain the land itself." The narrator says: Sayyiduna Umar (may Allah be pleased with him) gave it in charity on the condition that it would not be sold, nor gifted, nor inherited; it was to be given in charity to the poor, to relatives, in the path of Allah and in freeing slaves. Ibn Awn said: I think he also said: and to the guest. There is no harm on whoever manages it if he eats from it in a reasonable manner and feeds a friend, without amassing wealth from it.

It was a garden (of date palms). Sayyiduna Umar (may Allah be pleased with him) said: O Messenger of Allah (peace and blessings be upon him)! I have acquired some property which is very precious to me, and I intend to give it in charity. The Prophet (peace and blessings be upon him) said: "Give its original property in charity: it is not to be sold, nor gifted, nor inherited, but its fruit is to be spent (in charity)." So Sayyiduna Umar (may Allah be pleased with him) gave it in charity in the path of Allah, in freeing slaves, and for the needy, the guest, the traveller and relatives, and said: There is no harm if whoever manages it eats from it in a reasonable manner or feeds his friend, without amassing wealth by it.

The Thamgh property of Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) was for Sayyidah Hafsah (may Allah be pleased with her) for as long as she lived; she would spend its fruit wherever Allah showed her. If she died, it would pass to the one of sound judgement among her family. Its original property will never be sold, nor gifted. Whoever manages it, there is no harm on him in eating its fruit in a reasonable manner, or in feeding a friend, provided he does not accumulate wealth from it. Whatever fruit remains is to be spent on the one who asks, the deprived, the guest, relatives, the traveller and in the path of Allah. If (Hafsah) dies, it will return to the one of sound judgement among my children. And the one hundred wasqs that the Messenger of Allah (peace and blessings be upon him) gave me (to eat) in the valley, I will never use them up; they will remain with Thamgh on the same way that I have commanded. If the manager of Thamgh wishes, he may buy slaves from its fruit to work it. Mu'ayqib wrote (this), and Abdullah bin al-Arqam was a witness to it: 'Bismillahir-Rahmanir-Rahim' "In the name of Allah, the Most Gracious, the Ever Merciful." This is what the servant of Allah, Umar, has bequeathed: if he dies, then Thamgh, Sirmah bin al-Akwa', the slave who is in it, the one hundred shares at Khaybar, his slaves, and the one hundred wasqs that Muhammad (peace and blessings be upon him) gave him, are with Hafsah as long as she lives; then they will go to the one of sound judgement among her family. It will not be sold nor bought. He will spend from it when he sees one who asks, one who is deprived, or a relative. There is no harm on its manager if he eats from it, or feeds (others), or buys a slave from it.

Ja'far bin Muhammad narrates from his father that Sayyiduna Umar bin al-Khattab (may Allah be pleased with him) granted Sayyiduna Ali (may Allah be pleased with him) an estate at Yanbu'. Then Sayyiduna Ali (may Allah be pleased with him) bought some other things adjoining the estate (granted by) Sayyiduna Umar (may Allah be pleased with him) and dug a spring in it. While they were working in it, water gushed out upon them like the neck of a camel. Someone came to Sayyiduna Ali (may Allah be pleased with him) and gave him the good news. Sayyiduna Ali (may Allah be pleased with him) said: "Give the good news to the heir." Then he gave it in charity to the poor, the needy, in the path of Allah, and to the traveller, whether near or far, in time of peace or in war, for the Day when some faces will turn white and some faces will turn black; so that Allah Almighty may turn my face away from the Fire and turn the Fire away from my face.

He said: What I do not recall is much more, and less than what I have mentioned would suffice. And in what I have mentioned, that some gave their houses in Makkah in charity, there is proof for the people of Makkah regarding the ownership of their houses and renting them out; because Sayyiduna Abu Bakr, Sayyiduna Umar, Sayyiduna al-Zubayr, Sayyiduna Uthman, Sayyiduna Amr bin al-As and Sayyiduna Hakim bin Hizam (may Allah be pleased with them) would not take something in which all people share equally and give it in charity to their own children, to the exclusion of those who own it along with them.
