Amir bin Sa'd (may Allah have mercy on him) said that Sa'd (may Allah be pleased with him) rode to his residence at al-Aqiq. He found a slave cutting trees, so he seized his belongings. When he returned, the slave's family came to him asking him to return to them what he had taken from their slave. He said: "Ma'adh Allah (Allah forbid) that I should return anything that the Messenger of Allah (peace and blessings be upon him) gave me as spoils!" And he did not return anything to them.

Abdullah bin Ja'far, one of the descendants of Sayyiduna al-Miswar bin Makhramah (may Allah be pleased with him), narrated it similarly, except that he said: He found a young slave cutting trees or beating off their leaves, so he seized his belongings. And at its end he said: He refused to return it to them. [Sahih. See the previous one.]

Some of the children of Sa'd narrate from Sayyiduna Sa'd (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever you catch cutting any of the trees of the sanctuary of Madinah, his belongings are yours. Its trees are not to be lopped or cut." The narrator said: Sayyiduna Sa'd (may Allah be pleased with him) saw some slaves cutting trees, so he took their belongings. They went to their masters and told them that Sayyiduna Sa'd (may Allah be pleased with him) had done such and such. They came and said: O Abu Ishaq, your slaves or your freedmen have taken the belongings of our slaves! Sayyiduna Sa'd (may Allah be pleased with him) said: Rather, I took them. I heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever you catch cutting the trees of the sanctuary, his belongings are yours." But ask me for whatever you wish from my own wealth.

Amir bin Sa'd narrates from his father (may Allah be pleased with him) that he would go out of Madinah and find a woodcutter with fresh wood that he had lopped from some of the trees of Madinah, and he would take his belongings. When he was spoken to about it, he would say: "I will not give up spoils that the Messenger of Allah (peace and blessings be upon him) granted me." And he said: "Even though I am among the wealthiest of people."

Sulayman bin Abi Abdullah said: I saw Sa'd bin Abi Waqqas (may Allah be pleased with him) seize a man who was hunting in the sanctuary of Madinah, which the Messenger of Allah (peace and blessings be upon him) had made sacred, and he stripped him of his clothes. His masters came and spoke to him about it, and Sa'd bin Abi Waqqas (may Allah be pleased with him) said: The Messenger of Allah (peace and blessings be upon him) made this sanctuary sacred and said: "Whoever catches anyone hunting in it, let him strip him of his belongings." So I will not return to you a provision that the Messenger of Allah (peace and blessings be upon him) granted me; but if you wish, I will pay you its value.
