أَخْبَرَنَا أَبُو صَالِحِ بْنُ أَبِي طَاهِرٍ الْعَنْبَرِيُّ، ثنا جَدِّي يَحْيَى بْنُ مَنْصُورٍ الْقَاضِي، ثنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْإِسْمَاعِيلِيُّ، ثنا عِيسَى بْنُ حَمَّادٍ، أنبأ اللَّيْثُ بْنُ سَعْدٍ، حَدَّثَنِي أَبُو الزُّبَيْرِ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، وَعَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنِ ابْنِ عَبَّاسٍ، أَتَاهُ رَجُلٌ فَقَالَ: وَطِئْتُ امْرَأَتِي قَبْلَ أَنْ أَطُوفَ بِالْبَيْتِ، قَالَ: " عِنْدَكَ شَيْءٌ؟ " قَالَ: نَعَمْ إِنِّي مُوسِرٌ، قَالَ: " فَانْحَرْ نَاقَةً سَمِينَةً فَأَطْعِمْهَا الْمَسَاكِينَ ".
Ata bin Abi Rabah (may Allah have mercy on him) narrates from Abdullah bin Abbas (may Allah be pleased with him) that a man came to him and said: I had intercourse with my wife before circumambulating the House (of Allah). He said: Do you have anything? He said: I am well-off. Abdullah bin Abbas (may Allah be pleased with him) said: Slaughter a fat she-camel and feed it to the poor.
وَرَوَاهُ حَبِيبُ بْنُ أَبِي ثَابِتٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ فِي رَجُلٍ قَضَى الْمَنَاسِكَ كُلَّهَا إِلَّا الطَّوَافَ بِالْبَيْتِ ثُمَّ وَاقَعَ، قَالَ: عَلَيْهِ بَدَنَةٌ وَتَمَّ حَجُّهُ " أَنْبَأَنِيهِ أَبُو عَبْدِ اللهِ الْحَافِظُ أَنَّ أَبَا مُحَمَّدِ بْنَ زِيَادٍ أَخْبَرَهُمْ، قَالَ: أنبأ ابْنُ خُزَيْمَةَ، قَالَ: ثنا سَلَمَةُ بْنُ جُنَادَةَ، ثنا وَكِيعٌ، عَنْ سُفْيَانَ، وَشُعْبَةَ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ فَذَكَرَهُ.
Sa'id bin Jubayr narrates from Ibn Abbas (may Allah be pleased with him) concerning a man who completed all the rites except the circumambulation of the House (of Allah) and then had intercourse. He said: A camel (badanah) is due from him, and his Hajj is complete.
وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ الْأَصْبَهَانِيُّ قَالَا: أنبأ عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، ثنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ، ثنا يَحْيَى بْنُ أَيُّوبَ، ثنا عَبِيدَةُ، ثنا الْعَلَاءُ بْنُ الْمُسَيِّبِ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ أَنَّ رَجُلًا أَصَابَ مِنْ أَهْلِهِ قَبْلَ أَنْ يَطُوفَ بِالْبَيْتِ يَوْمَ النَّحْرِ، فَقَالَ: " يَنْحَرَانِ جَزُورًا بَيْنَهُمَا وَلَيْسَ عَلَيْهِمَا الْحَجُّ مِنْ قَابِلٍ ".
Ata narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) that a man had intercourse with his wife on the Day of Sacrifice before circumambulating the House (of Allah). He said: They should sacrifice one camel between the two of them, but Hajj will not be due from them the following year.
أَخْبَرَنَا أَبُو أَحْمَدَ الْمِهْرَجَانِيُّ، أنبأ مُحَمَّدُ بْنُ جَعْفَرٍ الْمُزَكِّي، ثنا مُحَمَّدُ بْنُ إِبْرَاهِيمَ، ثنا ابْنُ بُكَيْرٍ، ثنا مَالِكٌ، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ، عَنْ عِكْرِمَةَ مَوْلَى ابْنِ عَبَّاسٍ، قَالَ: لَا أَظُنُّهُ إِلَّا عَنِ ابْنِ عَبَّاسٍ، أَنَّهُ قَالَ فِي الَّذِي يُصِيبُ أَهْلَهُ قَبْلَ أَنْ يُفِيضَ: " يَعْتَمِرُ وَيُهْدِي " قَالَ: وَحَدَّثَنَا مَالِكٌ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ كَانَ يَقُولُ مِثْلَ ذَلِكَ، قَالَ مَالِكٌ: وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ.
Thawr bin Zayd al-Dili narrates from Ikrimah, the freed slave of Ibn Abbas (may Allah be pleased with him), (who said:) I think he narrates it from Ibn Abbas (may Allah be pleased with him), that he said concerning the person who has intercourse with his wife before performing the Tawaf al-Ifadah: He shall perform Umrah and offer a sacrifice.
أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، عَنْ أَبِي الزُّبَيْرِ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، عَنِ ⦗٢٨٠⦘ ابْنِ عَبَّاسٍ " أَنَّهُ سُئِلَ عَنْ رَجُلٍ وَقَعَ عَلَى أَهْلِهِ وَهُوَ مُحْرِمٌ وَهُوَ بِمِنًى قَبْلَ أَنْ يُفِيضَ فَأَمَرَهُ أَنْ يَنْحَرَ بَدَنَةً " قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَبِهَذَا نَأْخُذُ، قَالَ مَالِكٌ: عَلَيْهِ عُمْرَةٌ وَبَدَنَةٌ وَحَجُّهُ تَامٌّ، وَرَوَاهُ عَنْ رَبِيعَةَ فَتَرَكَ قَوْلَ ابْنِ عَبَّاسٍ لِرَأْيِ رَبِيعَةَ، وَرَوَاهُ عَنْ ثَوْرِ بْنِ زَيْدٍ، عَنْ عِكْرِمَةَ يَظُنُّهُ عَنِ ابْنِ عَبَّاسٍ وَهُوَ سَيِّئُ الْقَوْلِ فِي عِكْرِمَةَ لَا يَرَى لِأَحَدٍ أَنْ يَقْبَلَ حَدِيثَهُ، وَهُوَ يَرْوِي بِيَقِينٍ عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ خِلَافَهُ، وَعَطَاءٌ ثِقَةٌ عِنْدَهُ وَعِنْدَ النَّاسِ، قَالَ الشَّيْخُ: وَرُوِّينَاهُ عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ.
Ata bin Abi Rabah (may Allah have mercy on him) narrates from Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) that he was asked about a man in ihram, at Mina, who has intercourse with his wife before the Tawaf al-Ifadah. He ordered him to sacrifice a camel.
Imam al-Shafi'i (may Allah have mercy on him) said: This is what we adopt. Imam Malik (may Allah have mercy on him) said: An Umrah and the sacrifice of a camel are due from him, and his Hajj is complete.
(b) He (Malik) narrated it from Rabi'ah (may Allah have mercy on him), and so he left the saying of Sayyiduna Abdullah bin Abbas (may Allah be pleased with him) for the opinion of Rabi'ah.
And he narrated it from Thawr bin Zayd, from Ikrimah, thinking it to be from Ibn Abbas, while he (Malik) speaks ill of Ikrimah and does not consider that anyone should accept his hadith; yet he narrates with certainty from Ata, from Ibn Abbas, the opposite of it, and Ata is trustworthy in his view and in the view of the people. The Shaykh said: We have also narrated it from the jurists of the people of Madinah.
