أخبرنا أبو العباس محمد بن أحمد المحبُوبي، حدثنا محمد بن معاذ، حدثنا أبو عاصم الضحّاك بن مَخلَد، حدثني وهب بن خالد الحِمصي، حدثتني أم حَبيبة بنت العِرْباض بن ساريَة، قالت: حدثني أبي: أنَّ رسول الله ﷺ نهى عن الخَلِيسة (1) والمُجثَّمة، وأن تُوطأَ السَّبايا حتى يَضعْنَ ما في بُطونِهن (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Irbad bin Sariyah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) forbade the khalisah (an animal snatched from a predator), the mujaththamah (an animal tied up and made a target), and having intercourse with female war captives until they have delivered what is in their wombs.
This hadith has a sahih (authentic) chain of narration, but the two Shaykhs (Bukhari and Muslim) did not record it.

Hadith Takhrij «صحيح لغيره دون ذكر الخَلِيسة، وهذا إسناد حسن إن شاء الله، أم حبيبة بنت العرباض، وإن لم يرو عنها غير وهب بن خالد الحمصي، اعتبرنا حديثها على قِلَّته، فوجدناه غير منكر، بل توبعت عليه، وقال الذهبي: ما علمت في النساء من اتُّهِمت ولا من تركوها.» [ترقيم الرساله 2639] [ترقيم الشركة 2622] [ترقيم العلميه 2606]
أخبرني دَعْلَج بن أحمد السِّجِسْتاني، حدثنا عبد العزيز بن معاوية البصري، حدثنا محمد بن جَهضَم الخُراساني، حدثنا إسماعيل بن جعفر، حدثني عبد الرحمن بن الحارث، عن سليمان بن موسى (1) الأشْدق، عن مكحول، عن أبي سلَّام، عن أبي أُمامة الباهِلي صاحبِ رسول الله ﷺ، عن عُبادة بن الصامت، أنه قال: خَرجَ رسولُ الله ﷺ إلى بدر فلقي العدوّ، فلما هزمَهم اتَّبعهم طائفةٌ من المسلمين يقتلونهم، وأحْدَقَت طائفةٌ برسول الله ﷺ، واستولت طائفةٌ بالعسكر، فلما كفى اللهُ العدوَّ، ورجع الذين قتلوهم قالوا: لنا النَّفَل، نحن قتلْنا العدوَّ، وبنا نفاهُم الله وهزمَهم، وقال الذين كانوا أحدَقُوا برسول الله ﷺ: واللهِ ما أنتم بأحقَّ به منا، هو لنا، نحن أحدَقْنا برسول الله ﷺ لا ينالُ العدوُّ منه غِرَّةً، وقال الذين استولَوا على العسكر: والله ما أنتم بأحقَّ به منا، نحن استولَينا على العسكر، فأنزل الله ﷿: ﴿يَسْأَلُونَكَ عَنِ الْأَنْفَالِ قُلِ الْأَنْفَالُ لِلَّهِ وَالرَّسُولِ فَاتَّقُوا اللَّهَ وَأَصْلِحُوا ذَاتَ بَيْنِكُمْ﴾ إلى قوله: ﴿إِنْ كُنْتُمْ مُؤْمِنِينَ﴾، فقسَمه رسولُ الله ﷺ بينهم عن فُوَاقٍ (2).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه. وله شاهدٌ من حديث محمد بن إسحاق القرشي صحيح أيضًا على شرط مسلم:

It is narrated from Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) that he said: The Messenger of Allah (peace and blessings be upon him) set out for Badr and met the enemy. When he had defeated them, one group of Muslims pursued them and began killing them, one group surrounded the Messenger of Allah (peace and blessings be upon him) (so that the enemy could not attack), and one group took possession of the army's camp and goods. When Allah had sufficed them against the enemy and those who had done the killing returned, they said: These spoils are ours, because we killed the enemy and it was through us that Allah defeated them. Those who had surrounded the Messenger of Allah (peace and blessings be upon him) said: By Allah, you are not more entitled to them than we are; they are ours, because we were guarding the Messenger of Allah (peace and blessings be upon him) so that the enemy could not cause him any harm. And those who had taken possession of the camp and goods said: You are not more entitled to them than we are; we took possession of the camp and goods. So Allah, the Mighty and Majestic, revealed this verse: "They ask you about the spoils of war. Say: The spoils of war belong to Allah and the Messenger, so fear Allah and set right your mutual relations" [Surah Al-Anfal: 1], up to where He said: "if you are believers." So the Messenger of Allah (peace and blessings be upon him) distributed that wealth equally among them.
This hadith is sahih (authentic) on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it, and it has a supporting narration (shahid) through Muhammad bin Ishaq al-Qurashi which is also sahih on the condition of Imam Muslim.

حدَّثَناه أبو العباس محمد بن يعقوب، حدثنا أحمد بن عبد الجبار، حدثنا يونس بن بُكير، حدثنا محمد بن إسحاق، عن عبد الرحمن بن الحارث، عن سليمان بن الأشْدق، عن مكحول، عن أبي أُمامة الباهِلي، قال: سألتُ عُبادة بن الصامت عن الأنفال، فقال: فينا معشرَ أصحابِ بدرٍ نزلت، ثم ذكر الحديث بطُوله (1).

It is narrated from Sayyiduna Abu Umamah al-Bahili (may Allah be pleased with him): I asked Sayyiduna Ubadah bin al-Samit (may Allah be pleased with him) about the spoils of war (anfal), and he said: It was revealed concerning us, the people of Badr. Then he mentioned the complete lengthy hadith.
