حدثنا أبو العباس محمد بن يعقوب، حدثنا الرَّبيع بن سليمان، حدثنا عبد الله بن وهب، أخبرني سليمان بن بلال، عن كثير بن زيد، عن الوليد بن رَبَاح، عن أبي هريرة، أنَّ رسول الله ﷺ قال: "المحرومُ من حُرِمَ غَنيمةَ كَلْب ولو عِقال (3)، والذي نفسي بيده لتُباعَنَّ نساؤُهم على دَرَج دمشق، حتى تُرَدَّ المرأةُ من كَسرٍ يوجدُ بساقِها" (1). هذا حديث صحيح الإسناد، ولم يُخرجاه. It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The deprived one is he who is deprived of the spoils of the tribe of Kalb, even if it be only a rope for tying a camel ('iqal). By the One in whose Hand is my soul! Their women will certainly be sold on the steps of Damascus, until a woman will be returned because of some wound or defect found in her shin."
This hadith has a sahih (authentic) chain, but the two Shaykhs did not record it.

(3) هكذا في نسخنا الخطية وفي "تلخيص الذهبي" بلا ألف، والجادَّة فيما بعد "لو" أن يكون منصوبًا على تقدير، فعل، فلعلَّ ما هنا كُتب على لغة من يكتب المنصوب بلا ألف، أو على ما حكي أنه سُمع الرفع بعد "لو" في غير النعت، كما في "أصول النحو" لابن السرّاج 1/ 407، والله تعالى أعلم. Note / Clarification: In our handwritten manuscripts and in al-Dhahabi's "Talkhis" this word is written thus (without the alif). The rule is that after "لو" this word should be accusative, but perhaps here it was written according to the dialect of a copyist who writes the accusative without the alif, or according to the view that the nominative has also been heard after "لو", as in Ibn al-Sarraj's "Usul al-Nahw" (1/407). And Allah knows best.

Grading: Its chain is soft (weak). Technical note / Defect ('illah): Kathir bin Zayd is "saduq", but he is not very strong, especially when he is alone, and he is alone in narrating this hadith with its complete wording. To our knowledge, this hadith was not found in the sources anywhere except with the author (al-Hakim). وأخرج أوله أحمد 14 / (8669) من طريق ابن لهيعة، عن أبي الأسود، عن أبي الحلبس، عن أبي هريرة. وابن لهيعة سيئ الحفظ. Reference / Source: Ahmad (14/8669) recorded its opening portion by way of Ibn Lahi'ah, from Abu al-Aswad, from Abu al-Halbas, from Abu Hurayrah. (Note: Ibn Lahi'ah had a poor memory.)
