Mustadrak al-Hakim — Hadith 8351

أخبرنا عبد الله بن محمد بن إسحاق الخُزاعي بمكة حرسها الله تعالى، حدَّثنا عبد الله بن أحمد بن زكريا بن أبي مَسَرَّة، حدَّثنا عبد الله بن يزيد المقرئ حدَّثنا سعيد (4) بن أبي أيوب، حدثني يزيد بن أبي حَبيب، عن بُكير بن عبد الله بن الأشجِّ، عن سليمان بن يَسَار، عن عبد الرحمن بن جابر بن عبد الله، عن أبي بُرْدةَ بن نِيَار قال: سمعتُ رسول الله ﷺ يقول: "لا يُجلَدُ فوقَ عشرةِ أسواطٍ فيما دونَ حدٍّ من حدود الله ﷿" (1).
هذا حديث صحيح على شرط الشيخين، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Burdah bin Niyar (may Allah be pleased with him) that he said: I heard the Messenger of Allah (peace and blessings be upon him) say: "No one is to be given more than ten lashes in any matter other than the prescribed punishments (hudud) laid down by Allah, the Mighty and Majestic."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it.

Technical note / Defect ('illah): In the manuscripts this name has been corrupted into "Isma'il", and what has been adopted (in the text) is taken from the sources of the takhrij.

(1) إسناده صحيح، لكن اختلف في إسناده على بكير بن عبد الله كما سبق بيانه عند الرواية السالفة برقم (8306).
Grading: Its isnad is sahih, but there is disagreement over its isnad from Bukayr bin Abd Allah, as has been explained under the earlier narration number (8306).
وأخرجه أحمد 27/ (16491)، والنسائي (7289)، وابن حبان (4452) من طرق عن عبد الله بن يزيد المقرئ بهذا الإسناد. ووقع في رواية النسائي وحده: عبد الرحمن بن فلان، مكان عبد الرحمن بن جابر.
Corroborating chains and supporting reports: It was also recorded by Imam Ahmad 27/ (16491), al-Nasa'i (7289) and Ibn Hibban (4452) via Abd Allah bin Yazid al-Muqri', with this same isnad.
Note / Clarification: Only in al-Nasa'i's narration does "Abd al-Rahman bin Fulan (so-and-so)" occur in place of "Abd al-Rahman bin Jabir".
