حدَّثنا أبو العباس محمد بن يعقوب، أخبرنا محمد بن عبد الله بن عبد الحَكَم، أخبرنا ابن وهب، أخبرني عمرو بن الحارث وهشام بن سعد، عن عمرو بن شعيب، عن أبيه، عن عبد الله بن (1) عَمرو بن العاص: أن رجلًا من مُزَينة أَتى النبيَّ ﷺ فقال: يا رسول الله، كيف ترى في حَرِيسةِ الجَبَل؟ قال: "هي ومِثلُها (2) والنَّكَالُ، ليس في شيء من الماشية قطعٌ إلَّا ما آواهُ المُرَاحُ فبلغَ ثَمَنَ المِجَنِّ ففيه قطعُ اليد، وما لم يَبلُغ ثمنَ المِجَنِّ ففيه غَرامةُ مِثْلَيهِ وجَلَداتُ نَكالٍ" قال: يا رسول الله، كيف ترى في الثَّمر المُعلَّق؟ قال: "هو ومِثلُه معه والنَّكَالُ، وليس في شيءٍ من الثَّمر المُعلَّق قطعٌ إِلَّا ما آواه الجَرِينُ، فما أُخِذَ من الجَرِين فبلغَ ثَمَنَ المِجَنِّ ففيه القطعُ، وما لم يَبلُغْ ثمنَ المِجَنِّ ففيه غَرَامةُ مِثلَيهِ (1) وجَلَداتُ نَكالٍ" (2). هذه سُنّة تفرَّد بها عمرو بن شعيب بن محمد عن جده عبد الله بن عمرو بن العاص، وقد رويتُ في هذا الكتاب عن إمامنا إسحاق بن إبراهيم الحنظلي أنه قال: إذا كان الراوي عن عمرو بن شعيب ثقةً فهو كأيوب عن نافع عن ابن عمر (3).
It is narrated from Sayyiduna Abdullah bin Amr bin al-As (may Allah be pleased with them both) that a man from the tribe of Muzaynah came to the Prophet (peace and blessings be upon him) and said: O Messenger of Allah, what is your ruling on livestock grazing on the mountain that are not secured? He (peace and blessings be upon him) said: "Its penalty is the animal itself and, with it, the same value again as a fine, and an exemplary punishment. There is no cutting of the hand for anything of the livestock except what has been sheltered in the pen; if it reaches the minimum threshold (the value of a shield), the hand is cut for it, and whatever does not reach the threshold, for it there is a double fine and exemplary lashes." He said: O Messenger of Allah, what is your view of fruit hanging (on the trees)? He (peace and blessings be upon him) said: "Its penalty is the fruit itself and the same again as a fine, and an exemplary punishment. There is no cutting of the hand for hanging fruit except what has been placed in the threshing floor (a secured place); so whatever is stolen from the threshing floor and reaches the threshold, the hand is cut for it, and whatever does not reach the threshold, for it there is a double fine and an exemplary punishment." This is a sunnah which Amr bin Shu'ayb bin Muhammad alone narrated from his grandfather Abdullah bin Amr bin al-As, and I have narrated in this book from our Imam Ishaq bin Ibrahim al-Hanzali that he said: When the one narrating from Amr bin Shu'ayb is trustworthy (thiqah), that narration is like Ayyub from Nafi' from Ibn Umar.

(2) الواو سقطت من النسخ الخطية، وزدناها من روايتي النسائي والبيهقي 4/ 152 و 8/ 278. Technical note / Defect ('illah): The letter "waw" had dropped out of the manuscripts, and we have added it (on the basis of) the narrations of al-Nasa'i and al-Bayhaqi 4/ 152 and 8/ 278.
(1) تحرَّف في النسخ الخطية إلى: مثله، وأثبتناه على الصواب من روايتي النسائي والبيهقي. Technical note / Defect ('illah): In the manuscripts this word had been corrupted into "mithlahu"; we have corrected it and established it (in the text) in the light of the narrations of al-Nasa'i and al-Bayhaqi.
(2) إسناده حسن. Grading: Its isnad is hasan. وأخرجه النسائي (7405) عن الحارث بن مسكين، عن عبد الله بن وهب، بهذا الإسناد. Corroborating chains and supporting reports: It was also recorded by al-Nasa'i (7405) from al-Harith bin Miskin, from Abd Allah bin Wahb, with this same isnad. وأخرجه مطولًا ومختصرًا أحمد 11/ (6683) و (6746) و (6891) و (6936)، وأبو داود (1710 - 1713) و (4390)، وابن ماجه (2596)، والترمذي (1289)، والنسائي (7403) و (7404) من طرق عن عمرو بن شعيب به وقال الترمذي: حديث حسن. قلنا: وفي ألفاظ بعض رواته عن عمرو بن شعيب وهمٌ. Corroborating chains and supporting reports: It was recorded at length and in abridged form by Ahmad 11/ (6683), (6746), (6891) and (6936), Abu Dawud (1710 to 1713) and (4390), Ibn Majah (2596), al-Tirmidhi (1289) and al-Nasa'i (7403) and (7404), via several routes from Amr bin Shu'ayb. Al-Tirmidhi said: This hadith is hasan. Note / Clarification: We say: in the wording of some of those who narrate from Amr bin Shu'ayb there is "wahm" (error). قوله: "حَريسة الجبل" قال الإمام البغوي في "شرح السنة" 8/ 319: أراد بحريسة الجبل: البقر أو الشاة أو الإبل المأخوذة من المرعى، يقال: احترس الرجل: إذا أخذَ الشاةَ من المرعى … وأراد "بضرب النكال" التعزير. وانظر "المغني" لابن قدامة 12/ 438 - 439. Note / Clarification: The words "harisat al-jabal": Imam al-Baghawi says in "Sharh al-Sunnah" 8/ 319: By "harisat al-jabal" he meant the cattle, sheep or camels taken from the pasture (before being brought to a secure place); it is said "ihtarasa al-rajul" when a man takes a sheep from the pasture … And by "darb al-nakal" he meant "ta'zir" (discretionary exemplary punishment). (3) سبق عند المصنف أن أسند هذا الكلام لإسحاق بن راهويه بإثر الحديث (259). وأسنده عنه أيضًا ابن عدي في "الكامل" 5/ 114، وانظر ما قاله الحاكم عقب الحديث (2405). Important point: It has passed earlier in the author (al-Hakim)'s work that he transmitted this statement with an isnad to Ishaq bin Rahawayh after hadith (259). Ibn Adi also transmitted it from him with an isnad in "al-Kamil" 5/ 114. And see what al-Hakim said after hadith (2405).
