Mustadrak al-Hakim — Hadith 8349

حدَّثنا محمد بن صالح بن هانئ، حدَّثنا الفضل بن محمد الشَّعْراني، حدَّثنا إبراهيم بن حمزة، حدَّثنا عبد العزيز بن محمد، أخبرني يزيد بن خُصَيفة، عن محمد بن عبد الرحمن بن ثَوْبان، عن أبي هريرة: أنَّ رسول الله ﷺ أُتِيَ بسارقٍ قد سَرَق شَمْلةً، فقالوا: يا رسولَ الله، إنَّ هذا سَرَقَ، فقال رسول الله ﷺ: "ما إِخَالُه سَرَقَ" فقال السارق: بلى يا رسول الله، فقال رسول الله ﷺ: "اذهبُوا به فاقطَعُوه، ثم احسِمُوه، ثم ائتُوني به" فقُطِعَ ثم أُتِيَ به، فقال: "تُبْ إلى الله" فقال: تبتُ إلى الله، فقال: "تابَ اللهُ عليك" (1).
هذا حديث صحيح الإسناد على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Hurayrah (may Allah be pleased with him) that a thief was brought to the Messenger of Allah (peace and blessings be upon him) who had stolen a blanket-like wrap. The people said: O Messenger of Allah, this man has stolen. The Messenger of Allah (peace and blessings be upon him) said: "I do not think that he has stolen." At this the thief himself confessed and said: Yes indeed, O Messenger of Allah! (It was I who stole.) Then the Messenger of Allah (peace and blessings be upon him) said: "Take him away and cut off his hand, then cauterise the cut (to stop the bleeding), then bring him to me." So his hand was cut off and then he was brought, and he (peace and blessings be upon him) said: "Repent to Allah." He said: I have repented to Allah. He (peace and blessings be upon him) said: "Allah has accepted your repentance."
This hadith is sahih al-isnad (its chain is authentic) and on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) صحيح لغيره، وهذا إسناد رجاله لا بأس بهم، لكن عبد العزيز بن محمد - وهو الدراوردي - تفرّد بوصله بذكر أبي هريرة، وقد خالفه أصحابُ يزيد بن عبد الله بن خُصيفة الثقات، فرووه مرسلًا عن محمد بن عبد الرحمن بن ثوبان، ورجّحه الدارقطني في "العلل" (1871)، والبيهقي في "معرفة السنن والآثار" 12/ 420، على أنه قد روي عن الدراوردي أيضًا مرسلًا كما سيأتي.
Grading: This hadith is "sahih li-ghayrihi", and there is no harm in the narrators of this isnad (la ba'sa bihim), but Abd al-Aziz bin Muhammad — who is al-Darawardi — is alone in narrating it as "mawsul" (connected) by mentioning Abu Hurayrah.
Technical note / Defect ('illah): The trustworthy students of Yazid bin Abd Allah bin Khusayfah contradicted him: they narrated it from Muhammad bin Abd al-Rahman bin Thawban as "mursal", and it is this (mursal narration) that al-Daraqutni preferred in "al-'Ilal" (1871) and al-Bayhaqi in "Ma'rifat al-Sunan wa al-Athar" 12/ 420. Moreover, this narration has also been reported from al-Darawardi himself as "mursal", as will come.
وأخرجه البزار (8259)، والطحاوي في "شرح المعاني" 3/ 168، والدارقطني في "السنن" (3163)، والبيهقي في "السنن الكبرى" 8/ 271 و 275 من طرق عن عبد العزيز بن محمد الدراوردي، بهذا الإسناد. وقال البزار: وهذا الحديث لا نعلم يروى عن أبي هريرة إلَّا من هذا الوجه بهذا الإسناد.
Corroborating chains and supporting reports: It was recorded by al-Bazzar (8259), al-Tahawi in "Sharh al-Ma'ani" 3/ 168, al-Daraqutni in "al-Sunan" (3163), and al-Bayhaqi in "al-Sunan al-Kubra" 8/ 271 and 275, via several routes from Abd al-Aziz bin Muhammad al-Darawardi, with this same isnad.
Technical note / Defect ('illah): And al-Bazzar said: We do not know this hadith to be narrated from Abu Hurayrah except by this route, with this isnad.
وتابع الدراورديَّ على وصله بذكر أبي هريرة سيفُ بن محمد عند الدارقطني (3165). وسيف هذا متهم بالكذب، فلا يفرح به.
Technical note / Defect ('illah): Al-Darawardi was corroborated — in narrating the chain as connected by mentioning Abu Hurayrah — by Sayf bin Muhammad, in al-Daraqutni (3165). But this Sayf is "accused of lying", so (his narration) is nothing to rejoice over (i.e. it is unreliable).
ورواه سريج بن يونس وسعيد بن منصور فيما ذكر الدارقطني في "العلل" (1871)، وعلي بن المديني عند البيهقي 8/ 271، ثلاثتهم عن الدراوردي، عن يزيد بن خصيفة، عن محمد بن عبد الرحمن مرسلًا، لم يذكروا فيه أبا هريرة.
Details of the narration: It was narrated by Surayj bin Yunus and Sa'id bin Mansur — as al-Daraqutni mentioned in "al-'Ilal" (1871) — and by Ali bin al-Madini, in al-Bayhaqi 8/ 271; all three of them from al-Darawardi, from Yazid bin Khusayfah, from Muhammad bin Abd al-Rahman, as "mursal"; they did not mention Abu Hurayrah in it.

Corroborating chains and supporting reports: It was narrated in full and in abridged form by: Ayyub al-Sakhtiyani, in Abd al-Razzaq (13584); Sufyan al-Thawri, in Abd al-Razzaq (13583), Ibn Abi Shaybah 10/ 30 and al-Tahawi 3/ 168 and 4/ 323; Ibn Jurayj, in Abd al-Razzaq (13583) and al-Tahawi 3/ 168; Sufyan bin Uyaynah, in Qadi Abu Yusuf's "al-Kharaj" p. 192, Ibn Abi Shaybah 10/ 24 and 31, and Abu Dawud's "al-Marasil" (244); Muhammad bin Ishaq, in al-Tahawi 3/ 168; and Abd al-Aziz bin Abi Hazim, in al-Bayhaqi 8/ 271. These six (6) narrators narrated it from Yazid bin Abd Allah bin Khusayfah, from Muhammad bin Abd al-Rahman bin Thawban, from the Prophet (peace and blessings be upon him), as "mursal", and they did not mention Abu Hurayrah.
ويشهد له حديث السائب بن يزيد عند الطبراني في "المعجم الكبير" (6684)، وإسناده صحيح.
Corroborating chains and supporting reports: It is supported (as a shahid) by the hadith of al-Sa'ib bin Yazid in al-Tabarani's "al-Mu'jam al-Kabir" (6684), and its isnad is sahih.
وفي الباب عن أبي أمية المخزومي عند أحمد 37/ (22508)، وأبي داود (4380)، وابن ماجه (2597)، والنسائي (7322)، وفيه أبو المنذر مولى أبي ذر، وهو مجهول.
Corroborating chains and supporting reports: On this topic there is also a narration from Abu Umayyah al-Makhzumi in Musnad Ahmad 37/ (22508), Abu Dawud (4380), Ibn Majah (2597) and al-Nasa'i (7322).
Technical note / Defect ('illah): Among its narrators is "Abu al-Mundhir, the mawla of Abu Dharr", and he is "majhul" (unknown).
وعن محمد بن المنكدر مرسلًا عند عبد الرزاق (13585)، ورجاله ثقات.
Corroborating chains and supporting reports: It is also narrated from Muhammad bin al-Munkadir as "mursal" in Abd al-Razzaq (13585), and its narrators are thiqah (trustworthy).
