Mustadrak al-Hakim — Hadith 8352

حدثني أبو بكر محمد بن أحمد بن بالَوَيهِ، حدَّثنا إسحاق بن الحسن بن الحَرْبي، حدَّثنا عفان بن مسلم، حدَّثنا حماد بن سَلَمة، حدَّثنا يوسف بن سعد، عن الحارث بن حاطِبٍ: أنَّ رجلًا سَرَقَ على عهدِ رسول الله ﷺ، فأُتِيَ به النبيُّ ﷺ فقال: "اقتُلُوه"، فقالوا: إنما سَرَق، قال: "فاقطَعُوه"، ثم سَرَق أيضًا، فقُطِعَ، ثم سَرَق على عهد أبي بكر فقُطِع، ثم سَرَق فقُطِع (2)، حتى قُطعت قوائمُه، ثم سَرَق الخامسة، فقال أبو بكر: كان رسولُ الله ﷺ أعلمَ بهذا حين أمرَ بقتلِه، اذهبوا به فاقتُلُوه، فدُفِع إلى فِتْيَةٍ من قريش فيهم عبدُ الله بن الزُّبير، فقال عبد الله بن الزُّبير: أَمِّروني عليكم، فأَمَّروه، فكان إذا ضَرَبه ضَرَبُوه حتى قَتلُوه (3).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from al-Harith bin Hatib that in the time of the Messenger of Allah (peace and blessings be upon him) a man stole. He was brought to the Prophet (peace and blessings be upon him), and he (peace and blessings be upon him) said: "Kill him." The Companions said: O Messenger of Allah, he has only stolen. He (peace and blessings be upon him) said: "Very well, cut off his hand." Then he stole again, and his hand was cut off. Then he stole in the era of Sayyiduna Abu Bakr (may Allah be pleased with him), and (his foot) was cut off; then he stole again, and (the other foot) was cut off, until all four of his hands and feet had been cut off. Then he stole a fifth time, and Sayyiduna Abu Bakr (may Allah be pleased with him) said: "The Messenger of Allah (peace and blessings be upon him) knew best about him when he ordered him to be killed. Take him away and kill him." So he was handed over to some young men of Quraysh, among whom was Sayyiduna Abdullah bin al-Zubayr (may Allah be pleased with him). Abdullah bin al-Zubayr (may Allah be pleased with him) said: Make me your leader. So they made him their leader, and whenever he struck him, all the others struck him too, until they killed him.
This hadith is sahih al-isnad (its chain is authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

Technical note / Defect ('illah): In manuscripts (Z) and (K) there is this addition here: "Then he stole, and (his hand) was cut off", and it is a mistake.

(3) خبر منكر كما قال الذهبي في "السير" 3/ 366، وفي "تلخيص المستدرك"، والظاهر أنَّ النكارة من جهة يوسف بن سعد، فهو مختلف فيه، فقد اختلف حماد بن سلمة وخالد الحذاء في اسمه، فسماه حمادٌ يوسفَ بن سعد، وسماه خالدٌ يوسف بن يعقوب، قال الذهبي في ترجمة يوسف بن سعد من "الميزان" وثقه ابن معين، وقال الترمذي: رجل مجهول، قال: ويقال: يوسف بن مازن، ويقال: هما اثنان. قلنا: والأول مترجم في "التهذيب"، وجعلهما البخاري في "تاريخه" واحدًا، ووقع عنده في الرواية التي ساقها: يوسف أبو يعقوب، وروايته مخالفة لمن أخرج الحديث من طريق خالد الحذاء كما سيأتي مفصلًا.
Grading: This report is "munkar", as al-Hafiz al-Dhahabi said in "Siyar A'lam al-Nubala'" 3/ 366 and in "Talkhis al-Mustadrak".
Technical note / Defect ('illah): It appears that this nakarah (objectionable element) comes from "Yusuf bin Sa'd", who is a narrator about whom opinions differ. Hammad bin Salamah and Khalid al-Hadhdha' differed over his name: Hammad named him "Yusuf bin Sa'd", while Khalid named him "Yusuf bin Ya'qub". Al-Hafiz al-Dhahabi says in the biography of Yusuf bin Sa'd in "al-Mizan": Ibn Ma'in declared him trustworthy, while al-Tirmidhi said: He is an unknown man. He said: It is also said that he is Yusuf bin Mazin, and it is also said that they are two separate persons.
Note / Clarification: We say: the former has a biography in "al-Tahdhib", and al-Bukhari in his "al-Tarikh" counted the two of them as one; in the narration that al-Bukhari cites, "Yusuf Abu Ya'qub" occurs. And this narration of his differs from those who recorded the hadith via Khalid al-Hadhdha', as will be detailed ahead.
وقال النسائي بإثر الحديث (7429): ولا أعلم في هذا الباب حديثًا صحيحًا عن النبي ﷺ.
Grading: Al-Nasa'i said after hadith number (7429): I do not know of any sahih hadith from the Prophet (peace and blessings be upon him) on this topic.
وأخرجه البيهقي 8/ 272 - 273 عن أبي عبد الله الحاكم، بهذا الإسناد. وأخرجه أبو القاسم البغوي في "معجم الصحابة" (450) عن هارون بن عبد الله الحمال، عن عفان بن مسلم، به.
Reference / Source: It was recorded by al-Bayhaqi (8/ 272-273) from Abu Abd Allah al-Hakim, with this same isnad. Also Abu al-Qasim al-Baghawi recorded it in "Mu'jam al-Sahabah" (450) from Harun bin Abd Allah al-Hammal, from Affan bin Muslim, in the same way.
وأخرجه ابن الجنيد في "سؤالات ابن معين" (186)، وابن أبي عاصم في "الآحاد والمثاني" (784)، والنسائي (7428)، والطبراني في "الكبير" (3408)، وأبو نعيم في "معرفة الصحابة" (2040)، والضياء في "المختارة" 1/ (41)، والمزي في "تهذيب الكمال" 32/ 429 من طرق عن حماد بن سلمة، بهذا الإسناد. وقال ابن معين عقبه: يوسف بن سعد شيخ بصري ثقة!
Reference / Source: It was recorded by Ibn al-Junayd in "Su'alat Ibn Ma'in" (186), Ibn Abi Asim in "al-Ahad wa al-Mathani" (784), al-Nasa'i (7428), al-Tabarani in "al-Mu'jam al-Kabir" (3408), Abu Nu'aym in "Ma'rifat al-Sahabah" (2040), al-Diya' al-Maqdisi in "al-Mukhtarah" (1/ 41) and al-Mizzi in "Tahdhib al-Kamal" (32/ 429), via several routes from Hammad bin Salamah, with this same isnad. Technical note / Defect ('illah): After this narration Yahya bin Ma'in said: Yusuf bin Sa'd is a Basran shaykh, and thiqah (trustworthy)!
وخالف حمادَ بن سلمة خالدُ بن مِهْران الحذَّاء، فرواه عن يوسف بن يعقوب عن محمد بن حاطب أو الحارث بن حاطب، عند البخاري في "التاريخ الكبير" 8/ 373، وابن أبي عاصم (785)، وأبي يعلى (28) - ومن طريقه الضياء في "المختارة" 1/ (40) - وأبي القاسم البغوي (449)، والطبراني في "الكبير" (3409)، وأبي نعيم (2041).
Details of the narration: Khalid bin Mihran al-Hadhdha' contradicted Hammad bin Salamah: he narrated it from Yusuf bin Ya'qub, from Muhammad bin Hatib or al-Harith bin Hatib. Reference / Source: This narration is found in al-Bukhari's "al-Tarikh al-Kabir" (8/ 373), Ibn Abi Asim (785), Abu Ya'la (28) — and via him al-Diya' in "al-Mukhtarah" (1/ 40) — Abu al-Qasim al-Baghawi (449), al-Tabarani in "al-Mu'jam al-Kabir" (3409) and Abu Nu'aym (2041).
وقع عند البخاري وحده: يوسف أبو يعقوب، وأبو يعقوب هي كنية يوسف بن سعد، ووقع عند الباقين يوسف بن يعقوب، غير أن محققي "مسند أبي يعلى" و "المختارة" عدَّلاها لتكون كرواية البخاري، وقال البغوي: رواه حماد بن سلمة عن يوسف بن سعد ولم يقل: يوسف بن يعقوب، ولم يشكَّ في الحارث بن حاطب. فظاهر كلامه أنه يوسف بن يعقوب لا يوسف أبو يعقوب.
Technical note / Defect ('illah): Only in al-Bukhari are the words "Yusuf Abu Ya'qub", and "Abu Ya'qub" is actually the kunyah of Yusuf bin Sa'd, whereas with the other scholars it has come as "Yusuf bin Ya'qub". Note / Clarification: The editors of "Musnad Abi Ya'la" and "al-Mukhtarah" altered the text to make it conform to al-Bukhari's narration. Al-Baghawi said: Hammad bin Salamah narrated it from Yusuf bin Sa'd and did not say "Yusuf bin Ya'qub", and he did not express doubt about al-Harith bin Hatib. The apparent sense of his words is that he is Yusuf bin Ya'qub, not Yusuf Abu Ya'qub.
ووقع عند البخاري: عن محمد بن حاطب أبي الحارث، وعند ابن أبي عاصم وأبي يعلى والضياء: محمد بن حاطب أو الحارث، وعند البغوي والطبراني وأبي نعيم: محمد بن حاطب أن الحارث بن حاطب، فذكره. ومحمد بن حاطب: هو أخو الحارث بن حاطب، لكنهم لم يذكروا أن كنيته أبو الحارث، والذي في ترجمته من "التهذيب": أبو القاسم، ويقال: أبو إبراهيم، ويقال: أبو وهب.
Details of the narration: In al-Bukhari the wording is "from Muhammad bin Hatib Abu al-Harith"; in Ibn Abi Asim, Abu Ya'la and al-Diya' it is "Muhammad bin Hatib or al-Harith"; while in al-Baghawi, al-Tabarani and Abu Nu'aym it is "Muhammad bin Hatib, that al-Harith bin Hatib" (and he mentioned it). Technical note / Defect ('illah): Muhammad bin Hatib is actually the brother of al-Harith bin Hatib, but the scholars did not mention that his kunyah was "Abu al-Harith". In his biography in "al-Tahdhib" his kunyah is "Abu al-Qasim"; it is also said "Abu Ibrahim", and it is also said "Abu Wahb".
وقال أبو نعيم: ورواه أبو قتيبة، عن المفضل بن فضالة البصري، عن الوليد بن أبي هشام، عن ابن حويطب نحوه. قلنا: والمفضل بن فضالة ضعيف.
Details of the narration: Abu Nu'aym said: Abu Qutaybah narrated it from al-Mufaddal bin Fadalah al-Basri, from al-Walid bin Abi Hisham, from Ibn Huwaytib, similarly. Grading: We say: al-Mufaddal bin Fadalah is a da'if (weak) narrator.
وفي الباب عن جابر عند أبي داود (4410)، والنسائي في "الكبرى" (7429)، وقال بعد أن أخرجه في "المجتبى" (4993): هذا حديث منكر.
Corroborating chains and supporting reports: On this topic there is a narration from Jabir (may Allah be pleased with him) in Abu Dawud (4410) and al-Nasa'i in "al-Sunan al-Kubra" (7429). Grading: After recording it in "al-Mujtaba" (4993), al-Nasa'i said: This hadith is munkar.
