Mustadrak al-Hakim — Hadith 8288

كما حدَّثَناه أبو زكريا العَنْبري، حدثنا محمد بن عبد السلام، حدثنا يحيى بن يحيى، أخبرنا سفيان بن عُيَينة، عن عمرو بن دينار، عن إسماعيل الشَّيباني، قال: بِعتُ ما في رؤوس نَخْلي مئة وشق، إن زاد فلهم وإن نقص فعليهم، فسألتُ ابنَ عمر فقال: نَهَى رسولُ الله ﷺ عن ذلك، إلَّا أنه رَخَّصَ في العَرَايا (1).

Isma'il al-Shaybani narrates: I sold the fruit of my date palms for a hundred wasqs, on the condition that if the quantity turned out greater, it would belong to them (the buyers), and if it turned out less, it would be their loss. I asked Sayyiduna Ibn Umar (may Allah be pleased with them both) about it, and he said that the Messenger of Allah (peace and blessings be upon him) forbade that, except that he (peace and blessings be upon him) granted a concession in 'araya (exchange of dates under specific need).

(1) حديث صحيح، وهذا إسناد حسن من أجل إسماعيل الشيباني، لكن المحفوظ في هذا الحديث أنه من حديث ابن عمر عن زيد بن ثابت يحيى بن يحيى: هو النيسابوري.
Grading: This hadith is "sahih", and this chain is "hasan" because of Isma'il al-Shaybani.
Technical note / Defect ('illah): However, what is "preserved" (mahfuz) in this hadith is that it is the hadith of Ibn Umar which he narrates from Zayd bin Thabit. Yahya bin Yahya is "al-Naysaburi".
وأخرجه أحمد 8/ (4590) عن سفيان بن عيينة، بهذا الإسناد.
Reference / Source: Ahmad (8/4590) narrated it from Sufyan bin Uyaynah, with this same chain.
وأخرجه من غير هذا الوجه عن ابن عمر عن زيد بن ثابت: أحمد 35/ (21657) و (21672)، والبخاري (2173) و (2192) و (2380)، ومسلم (1539)، والترمذي (1300) و (1302)، والنسائي (6078) و (6082) و (6084) و (6086) و (11704)، وابن حبان (5004).
Reference / Source: It was narrated through routes other than this one (Ibn Umar from Zayd bin Thabit) by Ahmad (35/21657, 21672), al-Bukhari (2173, 2192, 2380), Muslim (1539), al-Tirmidhi (1300, 1302), al-Nasa'i (6078, 6082, 6084, 6086, 11704) and Ibn Hibban (5004).
