Mustadrak al-Hakim — Hadith 8289

أخبرني عبد الرحمن بن الحسن القاضي بهَمَذان، حدثنا إبراهيم بن الحسين، حدثنا آدم بن أبي إياس، حدثنا شُعبة، عن أبي بِشر، عن خالد بن عُرْفُطة، عن حَبيب بن سالم، عن النُّعمان بن بَشير، عن النبيِّ ﷺ في الرجل أَتى جاريةَ امرأتِه، قال: "إن كانت حلَّلَتْها له جلدتُه مئةً، وإن لم تكن أحلَّتها (2) له رجمتُه" (3)
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Sayyiduna Nu'man bin Bashir (may Allah be pleased with him) that the Prophet (peace and blessings be upon him) said concerning a man who had intercourse with his wife's slave-girl: "If his wife had made that slave-girl lawful for him, I will give him a hundred lashes, and if she had not made her lawful, I will stone him."
The chain of this hadith is sahih (authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

Note / Clarification: In our handwritten manuscripts the word in both places is "hallatha"; we corrected it to "ahallatha" in light of "Talkhis al-Mustadrak" and the sources that narrated it through the route of Shu'bah.

(3) حديث صحيح لكن بلفظ رواية قتادة كما سيأتي، عبد الرحمن بن الحسن شيخ المصنف - وإن كان ضعيفًا - قد توبع، وخالد بن عرفطة روى عنه جمع من الثقات، وذكره ابن حبان في "ثقاته"، ومع ذلك قال عنه أبو حاتم والبزار: مجهول! وهو متابع أيضًا. وقد اختلف في إسناد الحديث اختلافًا لا يضرُّ مثله كما سيأتي بيانه. أبو بشر: هو جعفر بن أبي وحشية.
Grading: This hadith is "sahih", but with the wording found in the narration of Qatadah (as will come).
Technical note / Defect ('illah): The author's (al-Hakim's) shaykh "Abd al-Rahman bin al-Hasan", although weak, is corroborated. A group of trustworthy narrators narrated from "Khalid bin Urfutah", and Ibn Hibban mentioned him in "al-Thiqat"; despite this, Abu Hatim and al-Bazzar called him "majhul" (unknown)! In any case he too is corroborated (mutaba'). There is disagreement in the chain of the hadith, but such disagreement does no harm, as will be explained. "Abu Bishr" is Ja'far bin Abi Wahshiyyah.
وأخرجه أحمد 30/ (18444)، وأبو داود (4459)، والنسائي (5526) و (7187) من طريق محمد بن جعفر عن شعبة، بهذا الإسناد.
Reference / Source: Ahmad (30/18444), Abu Dawud (4459) and al-Nasa'i (5526, 7187) narrated it through the route of Muhammad bin Ja'far, from Shu'bah, with this same chain.
وأخرجه أحمد (18446)، والترمذي في "الجامع" (1452)، وفي "العلل الكبير" بإثر (424)، والنسائي (5527) و (7188) من طريق هشيم عن أبي بشر جعفر بن أبي وحشية، عن حبيب بن سالم به ليس فيه خالد بن عرفطة. وهذا إما خطأ من هشيم أو تدليس منه، والله أعلم. وقد نقل الترمذي في "الجامع" بإثر (1452) عن البخاري قوله: أبو بشر لم يسمع من حبيب بن سالم، إنما رواه عن خالد بن عرفطة. وأشار الترمذي إلى اضطراب إسناده.
Reference / Source: Ahmad (18446), al-Tirmidhi in "al-Jami'" (1452) and in "al-'Ilal al-Kabir" after (424), and al-Nasa'i (5527, 7188) narrated it through the route of Hushaym, from Abu Bishr Ja'far bin Abi Wahshiyyah, from Habib bin Salim; "Khalid bin Urfutah" is not mentioned in it.
Technical note / Defect ('illah): This is either a mistake by Hushaym or tadlis on his part (and Allah knows best). Imam al-Tirmidhi, in "al-Jami'" after (1452), quoted Imam al-Bukhari as saying: "Abu Bishr did not hear from Habib bin Salim; he narrated this via Khalid bin Urfutah." Al-Tirmidhi pointed to the inconsistency (idtirab) in its chain.
وأخرجه أحمد (18425) و (18426)، وأبو داود (4458)، والنسائي (5529) و (7190) من طرق عن أبان العطار، عن قتادة، عن خالد بن عرفطة، عن حبيب بن سالم: أنَّ رجلًا يقال له: عبد الرحمن بن حنين، وقع على جارية امرأته، فرُفع إلى النعمان بن بشير وهو أميرٌ على الكوفة، فقال: لأقضينَّ فيك بقضية رسول الله ﷺ: إن كانت أحلتها لك جلدتُك مئة، وإن لم تكن أحلَّتها لك رجمتُك بالحجارة، فوجدوه قد أحلَّتها له، فجلده مئة. قال قتادة: كتبتُ إلى حبيب بن سالم، فكَتَب إليَّ بهذا قلنا: وهذا أصح لفظًا من رواية أبي بشر، وفيه أن حبيبًا كتب به إلى قتادة، فبهذا تسقط عهدته عن خالد بن عرفطة، وغيره من رجال الإسناد ثقات، وحبيب بن سالم هذا كان مولى للنعمان وكاتبًا له.
Reference / Source: Ahmad (18425, 18426), Abu Dawud (4458) and al-Nasa'i (5529, 7190) narrated it through the route of Aban al-Attar, from Qatadah, from Khalid bin Urfutah, from Habib bin Salim: A man called Abd al-Rahman bin Hunayn had intercourse with his wife's slave-girl, and the matter was brought to al-Nu'man bin Bashir (the governor of Kufah). He said: I will judge your case with the judgement of the Messenger of Allah (peace and blessings be upon him): if your wife had made her lawful for you, I will give you a hundred lashes, and if she had not made her lawful, I will stone you. On investigation it was found that his wife had made her lawful for him, so he was given a hundred lashes.
Important point: Qatadah says: "I wrote to Habib bin Salim and he wrote this back to me." We say that this narration has more sound wording than the narration of Abu Bishr, and it makes clear that Habib wrote it to Qatadah, which removes the responsibility from Khalid bin Urfutah (i.e., the transmission is established). The remaining narrators are trustworthy, and Habib bin Salim was al-Nu'man's freed slave (mawla) and his scribe.
وخالف يحيى بنُ حماد عند الدارمي (2481)، فرواه عن أبان العطار، عن قتادة قال: كتب إليّ خالد بن عرفطة عن حبيب بن سالم: أنَّ غلامًا وقع على جارية امرأته، فرفع ذلك إلى النعمان، فقال: لأقضين فيه بقضاء شاف: إن كانت أحلّتها له جلدته مئة وإن كانت لم تُحِلّ له رجمته، فقيل لها: زوجك، فقالت: إني قد أحللتها له، فضربه مئة. كذا ذكره موقوفًا، وجعل المكاتب لقتادة هو خالد بن عرفطة، ورواية الجماعة عن أبان أَولى.
Technical note / Defect ('illah): Yahya bin Hammad differed, in al-Darimi (2481), narrating from Aban al-Attar from Qatadah, who said: "Khalid bin Urfutah wrote to me from Habib bin Salim" (then the same incident follows: a young man had intercourse with his wife's slave-girl; al-Nu'man gave his ruling; the wife said she had made her lawful to him; so he was given a hundred lashes). He related it as "mawquf" and made "Khalid bin Urfutah" the one who wrote to Qatadah. (But) the narration of the group from Aban is more worthy (of preference).
وأخرجه بنحو رواية الجماعة عن أبان أحمد (18397) و (18445)، وابن ماجه (2551)، والترمذي في "الجامع" (1451)، وفي "العلل الكبير" (424) من طريق سعيد بن أبي عروبة، عن قتادة، عن حبيب بن سالم، به. وقرن أحمد في روايته الأولى والترمذي بسعيدٍ أبا العلاء أيوبَ بن مسكين.
Reference / Source: Ahmad (18397, 18445), Ibn Majah (2551) and al-Tirmidhi in "al-Jami'" (1451) and "al-'Ilal al-Kabir" (424) narrated it through the route of Sa'id bin Abi Arubah, from Qatadah, from Habib bin Salim, in the same way as the group narrated it from Aban.
Technical note / Defect ('illah): Imam Ahmad in his first narration and Imam al-Tirmidhi (in his narration) mentioned "Abu al-Ala' Ayyub bin Miskin" together with Sa'id bin Abi Arubah (coupling them).
ورواه عن قتادةَ همامُ بن يحيى واختُلف عليه فيه، فرواه عنه حبان بن هلال عند النسائي (5528) و (7191)، وهدبة بن خالد عند البيهقي 8/ 239، كلاهما عن همام، عن قتادة، عن حبيب بن سالم، عن حبيب بن يساف، عن النعمان. فزاد همام في الإسناد بين حبيب بن سالم والنعمانِ حبيبَ بن يساف وحبيبٌ هذا مجهول كما قال أبو حاتم الرازي.
Technical note / Defect ('illah): Hammam bin Yahya also narrated it from Qatadah, but there is disagreement from him in this narration. Habban bin Hilal (al-Nasa'i: 5528, 7191) and Hudbah bin Khalid (al-Bayhaqi: 8/239) both narrated it from Hammam, from Qatadah, from Habib bin Salim, from "Habib bin Yasaf", from al-Nu'man.
Important point: Hammam added "Habib bin Yasaf" to the chain between Habib bin Salim and al-Nu'man, whereas this "Habib" (bin Yasaf) is an unknown (majhul) narrator, as Abu Hatim al-Razi said.
ورواه أبو عمر الحوضي، عن همام، عن قتادة، عن حبيب بن يساف، عن حبيب بن سالم، به مقلوبًا. أخرجه الطحاوي في "شرح معاني الآثار" 3/ 145. وهذا هو الصواب في رواية همام، فإنَّ حبيب بن سالم هو راوي الحديث عن النعمان، فهو مولاه وكاتبه.
Reference / Source: Abu Umar al-Hawdi narrated it from Hammam, from Qatadah, from Habib bin Yasaf, from Habib bin Salim, in "inverted" (maqlub) form. Al-Tahawi transmitted it in "Sharh Ma'ani al-Athar" (3/145).
Note / Clarification: This is what is correct in Hammam's narration (Habib bin Yasaf from Habib bin Salim), because "Habib bin Salim" is the one who narrates the hadith from al-Nu'man, since he was al-Nu'man's freed slave (mawla) and his scribe.
قلنا: ورواية همّام هذه بذكر حبيب بن يساف شاذّة، خالف فيها ثلاثةً من أصحاب قتادة: هم أبان العطار وسعيد بن أبي عروبة وأيوب بن مسكين.
Grading: We say: this narration of Hammam that mentions Habib bin Yasaf is "shadhdh" (not preserved). In it he contradicted three students of Qatadah, namely Aban al-Attar, Sa'id bin Abi Arubah and Ayyub bin Miskin.
وقد توبع قتادة أيضًا، فقد أخرجه أحمد (18405) من طريق خالد الحذاء، عن حبيب بن سالم، عن النعمان بن بشير. بنحو رواية أبان عن قتادة.
Corroborating chains and supporting reports: Qatadah has also been corroborated: Ahmad (18405) narrated it through the route of Khalid al-Hadhdha', from Habib bin Salim, from al-Nu'man bin Bashir, similar to the narration of Aban from Qatadah.
ونقل صالح ابن الإمام أحمد عن أبيه في "مسائله" (1354): أنَّ حديث النعمان هذا يتقوى بخبر عمر. قلنا: خبر عمر انظره عند الطحاوي في "شرح معاني الآثار" 3/ 147.
General principle: Salih, the son of Imam Ahmad, reported from his father (Imam Ahmad) in "al-Masa'il" (1354): "This hadith of al-Nu'man is strengthened by the report of Umar (may Allah be pleased with him)."
Reference / Source: We say: for the report of Umar (may Allah be pleased with him) see al-Tahawi's "Sharh Ma'ani al-Athar" (3/147).
وقال إسحاق الكوسج في "مسائله عن الإمامين أحمد وإسحاق" 4/ 1567: قلت: فيمن يقع على جارية امرأته أو ابنه أو أمه أو أبيه؟ قال: كل هذا أدرأ عنه الحد، إلَّا جارية امرأته فإن حديث النعمان بن بشير ﵁ في ذلك، قلت: يقام عليه الحد في جارية امرأته؟ قال: نعم، على ما قال النعمان، قال إسحاق: كما قال.
General principle: Ishaq al-Kawsaj said in "Masa'il al-Imamayn Ahmad wa Ishaq" (4/1567): I asked: "What is the ruling on someone who has intercourse with the slave-girl of his wife, his son, his mother or his father?" He (Imam Ahmad) said: "In all these cases I would avert the hadd from him, except for his wife's slave-girl, because the hadith of al-Nu'man bin Bashir (may Allah be pleased with him) concerns that." I asked: "Is the hadd carried out on him in the case of his wife's slave-girl?" He said: "Yes, according to what al-Nu'man said." Imam Ishaq (bin Rahawayh) said: "As he said."
وأما البخاري فقد نقل عنه الترمذي في "العلل الكبير" ص 234 أنه قال: أنا أتَّقي هذا الحديث.
Technical note / Defect ('illah): As for Imam al-Bukhari, al-Tirmidhi reported from him in "al-'Ilal al-Kabir" (p. 234) that he said: "I am wary of this hadith" (i.e., he considered it weak or to be treated with caution).
وقال الترمذي في "جامعه" بإثر (1452): وقد اختلف أهل العلم في الرجل يقع على جارية امرأته، فروي عن غير واحد من أصحاب النبي ﷺ منهم علي وابن عمر أنَّ عليه الرجم، وقال ابن مسعود: ليس عليه حد ولكن يعزّر، وذهب أحمد وإسحاق إلى ما روى النعمان بن بشير عن النبي ﷺ.
General principle: Imam al-Tirmidhi said in his "Jami'" after (1452): "The people of knowledge differ about a man who has intercourse with his wife's slave-girl. It is narrated from more than one of the Companions of the Prophet (peace and blessings be upon him), among them Ali and Ibn Umar (may Allah be pleased with them), that stoning is due upon him. Ibn Mas'ud (may Allah be pleased with him) said: There is no hadd upon him, but he is given a discretionary punishment (ta'zir). And Ahmad and Ishaq held to what al-Nu'man bin Bashir (may Allah be pleased with him) narrated from the Prophet (peace and blessings be upon him)."
