Mustadrak al-Hakim — Hadith 8285

أخبرنا أبو بكر أحمد بن سلمان بن الحسن الفقيه ببغداد، حدثنا أبو الأحوص محمد بن الهيثم القاضي، حدثنا عبد الغفّار بن داود الحرَّاني، حدثنا موسى بن أعْيَن، عن الأعمش، عن القاسم بن عبد الرحمن، عن أبيه، عن عبد الله قال: ما رأيتُ رجلًا قطُّ أشدَّ رَمْيةً من علي بن أبي طالب، أُتِيَ بامرأةٍ من هَمْدانَ يُقال لها: شُرَاحة، فجلدها مئةً ثم أمر برجمها، فأخَذَ علي آجُرَّةً فرماها بها، فما أخطأَ أصلَ أُذنِها منها فصَرَعَها، فرجمَها الناسُ حتى قتلوها، ثم قال: جلدتُها بكتاب الله، ورجمتُها بالسُّنّة (1)
هذا حديث صحيح الإسناد، ولم يُخرجاه. وكان الشعبيُّ يذكر أنه شهد رجمَ شُراحةَ، ويقول: إنه لا يَحفَظ عن أمير المؤمنين غيرَ ذلك:

It is narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) that he said: I have never seen anyone with a surer aim than Sayyiduna Ali bin Abi Talib (may Allah be pleased with him). A woman from the tribe of Hamdan called Shurahah was brought to him. He gave her a hundred lashes, then ordered that she be stoned. Sayyiduna Ali (may Allah be pleased with him) took a brick and threw it at her, and it struck her right at the root of her ear, and she fell. Then the people stoned her until she died. Then he said: "I flogged her according to the Book of Allah and stoned her according to the Sunnah."
The chain of this hadith is sahih (authentic), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) إسناده صحيح، وذكرُ عبد الله فيه. وهو ابن مسعود - وهمٌ من أحد رواته، والمحفوظ أنه من رواية عبد الرحمن ولد ابن مسعود عن علي كما في مصادر التخريج، وابن مسعود كان قد توفي قبل هذه الحادثة بعدّة سنين. وقد أورد الحافظ ابن حجر هذا الخبر في "إتحاف المهرة" (14574) في ترجمة عبد الرحمن بن عبد الله بن مسعود عن علي، ولم يذكر فيه ابن مسعود، فكأنه أسقطه عمدًا.
Grading: Its chain is "sahih".
Technical note / Defect ('illah): The mention of "Abdullah" (who is Ibn Mas'ud) in this chain is a mistake by one of the narrators. What is preserved (mahfuz) is that this is the narration of Abd al-Rahman (the son of Ibn Mas'ud) from Ali (may Allah be pleased with him), as found in the sources that transmit it, since Abdullah bin Mas'ud (may Allah be pleased with him) had died several years before this incident.
Reference / Source: Al-Hafiz Ibn Hajar (may Allah have mercy on him) cited this narration in "Ithaf al-Maharah" (14574) under the entry of Abd al-Rahman bin Abdullah bin Mas'ud from Ali (may Allah be pleased with him), and did not mention Ibn Mas'ud in it, as though he deliberately dropped (omitted) him.
وأخرجه مختصرًا ابن أبي شيبة 10/ 81 عن حفص بن غياث، عن الأعمش، عن القاسم بن عبد الرحمن، عن أبيه: أن عليًا جلد ورجم، جلد يوم الخميس ورجم يوم الجمعة.
Reference / Source: Ibn Abi Shaybah (10/81) narrated it in abridged form.
Details of the narration: This narration is from Hafs bin Ghiyath, from al-A'mash, from al-Qasim bin Abd al-Rahman, from his father, that Ali (may Allah be pleased with him) both flogged and stoned: he flogged on Thursday and stoned on Friday.
وأخرجه أيضًا 10/ 88 عن أبي خالد الأحمر سليمان بن حيان، عن حجاج بن أرطاة، عن القاسم بن عبد الرحمن، عن أبيه، عن علي. وأحال لفظَه على ما أخرجه عن أبي خالد الأحمر، عن حجاج، عن الحسن بن سعد بن معبد، عن عبد الرحمن بن عبد الله، قال: أُتي على بامرأة قد زنت، فحبسها حتى وضعت وتعلّت من نفاسها.
Reference / Source: Ibn Abi Shaybah also narrated it at (10/88) through Abu Khalid al-Ahmar Sulayman bin Hayyan, from Hajjaj bin Artah, from al-Qasim bin Abd al-Rahman, from his father, from Ali (may Allah be pleased with him).
Note / Clarification: He (Ibn Abi Shaybah) referred its wording to the narration he transmitted from Abu Khalid al-Ahmar, from Hajjaj, from al-Hasan bin Sa'd bin Ma'bad, from Abd al-Rahman bin Abdullah, which says: "A woman who had committed adultery was brought to Ali (may Allah be pleased with him), and he kept her confined until she gave birth and was clear of her postnatal bleeding."
وأخرج أيضًا 10/ 90 عن أبي خالد الأحمر، عن حجاج، عن القاسم، عن أبيه، عن علي، وأحال لفظَه على ما أخرجه عن أبي خالد الأحمر، عن حجاج، عن الحسن بن سعد، عن عبد الرحمن بن عبد الله، عن علي، قال: أيها الناس، إنَّ الزنى زناءان … فيكون الإمام أول من يرمي، قال: وفي يده ثلاثة أحجار، قال: فرماها بحجر فأصاب صماخها فاستدارت ورمى الناسُ.
Reference / Source: Ibn Abi Shaybah narrated it at (10/90) from Abu Khalid al-Ahmar, from Hajjaj, from al-Qasim, from his father, from Ali (may Allah be pleased with him).
Note / Clarification: Its wording too is referred to the previous chain (Abu Khalid al-Ahmar from Hajjaj from al-Hasan bin Sa'd from Abd al-Rahman bin Abdullah from Ali), in which Ali (may Allah be pleased with him) said: "O people, adultery is of two kinds" (and at the end of the hadith): "so the imam is the first to throw." The narrator said: Ali (may Allah be pleased with him) had three stones in his hand; he struck her with one stone which hit her ear canal (or eardrum), and she spun around; then the people threw stones.
وأخرج عبد الرزاق (13351) عن الثَّوري، عن عبد الرحمن بن عبد الله، عن القاسم بن عبد الرحمن قال: حفر عليٌّ الشُراحة الهمدانية حين رجمها، وأمر بها أن تحبس حتى تضع. لم يذكر فيه عبد الرحمن والد القاسم.
Reference / Source: Abd al-Razzaq (13351) narrated it from al-Thawri, from Abd al-Rahman bin Abdullah, from al-Qasim bin Abd al-Rahman.
Details of the narration: Ali (may Allah be pleased with him) dug a pit for "Shurahah al-Hamdaniyyah" when he stoned her, and ordered that she be kept confined until she gave birth.
Technical note / Defect ('illah): This chain does not mention Abd al-Rahman, the father of al-Qasim.
وأخرج الطحاوي في "شرح معاني الآثار" 3/ 140، والطبراني في "مسند الشاميين" (2753) من طريق سعيد بن بشير، عن قتادة عن الرضراض بن أسعد، عن علي: أنه جلد شراحة، ثم رجمها، وقال: جلدتها بكتاب الله ورجمتها بسنة رسول الله ﷺ. وسعيد بن بشير ضعيف، والرضراض ذكره ابن حبان في "الثقات"، وذكر الذهبي في "الميزان" عن الأزدي قال: ليس بقوي.
Reference / Source: Al-Tahawi narrated it in "Sharh Ma'ani al-Athar" (3/140) and al-Tabarani in "Musnad al-Shamiyyin" (2753) through the route of Sa'id bin Bashir, from Qatadah, from al-Radrad bin As'ad, from Ali (may Allah be pleased with him).
Details of the narration: That he flogged Shurahah, then stoned her, and said: "I flogged her according to the Book of Allah and stoned her according to the Sunnah of the Messenger of Allah (peace and blessings be upon him)."
Grading: Sa'id bin Bashir is "da'if" (weak). Ibn Hibban mentioned al-Radrad in "al-Thiqat", but al-Dhahabi in "al-Mizan" quoted al-Azdi as saying that he is "not strong".
وأخرجه عبد الرزاق (13354) عن معمر، عن قتادة أن عليًا جلد يوم الخميس، ورجم يوم الجمعة، فقال: أجلدك بكتاب الله، وأرجمك بسنة رسول الله ﷺ. لم يذكر الوساطة بين قتادة وعلي.
Reference / Source: Abd al-Razzaq (13354) narrated it from Ma'mar, from Qatadah, that Ali (may Allah be pleased with him) flogged on Thursday and stoned on Friday, and said: "I flog you according to the Book of Allah and stone you according to the Sunnah of the Messenger of Allah (peace and blessings be upon him)."
Technical note / Defect ('illah): In this narration the intermediary between Qatadah and Ali (may Allah be pleased with him) is not mentioned (i.e., it is munqati').
وخالفهما سعيدُ بن أبي عروبة عند أحمد 2/ (1185)، فرواه عن قتادة، عن الشعبي، عن علي. وسعيد بن أبي عروبة هو المعوَّل عليه في رواية قتادة. وطريق الشعبي عن علي سيأتي تخريجه في الحديث التالي عند المصنف.
Details of the narration: Sa'id bin Abi Arubah contradicted the two of them, as found in Ahmad (2/1185): he narrated it from Qatadah, from al-Sha'bi, from Ali (may Allah be pleased with him).
Technical note / Defect ('illah): In the narrations of Qatadah, Sa'id bin Abi Arubah is the one to be relied upon (al-mu'awwal 'alayh). The route of al-Sha'bi from Ali (may Allah be pleased with him) will be covered in the sources of the author's (al-Hakim's) next hadith.
وأخرج محمد بن نصر المروزي في "السنة" (358)، والطحاوي في "مشكل الآثار" (2062)، وفي "معاني الآثار" 3/ 140، والخطيب في "الأسماء المبهمة" 2/ 138 من طريق مسلم الأعور، عن حَبّة بن جُوَين عن علي: قال أتته شراحة فأقرّت عنده أنها زنت، فقال لها علي: لعلك عصيت نفسك، قالت: أتيت طائعة غير مكرهة، فأخرجها حتى ولدت وفطمت ولدها، ثم جلدها الحد بإقرارها، ثم دفنها في الرحبة إلى منكبها، فرماها هو أول الناس، ثم قال: ارموا، ثم قال: جلدتها بكتاب الله، ورجمتها بسنة محمد ﷺ وسنده ضعيف، مسلم الأعور وحبة بن جوين ضعيفان.
Reference / Source: Muhammad bin Nasr al-Marwazi narrated it in "al-Sunnah" (358), al-Tahawi in "Mushkil al-Athar" (2062) and "Ma'ani al-Athar" (3/140), and al-Khatib in "al-Asma' al-Mubhamah" (2/138) through the route of Muslim al-A'war, from Habbah bin Juwayn, from Ali (may Allah be pleased with him).
Details of the narration: Shurahah came to him and confessed to adultery (the incident is described: he gave her respite until she delivered and weaned her child, then flogged her, then buried her up to her shoulders and stoned her, and said: I flogged her by the Book of Allah and stoned her by the Sunnah of Muhammad, peace and blessings be upon him).
Grading: Its chain is "da'if"; Muslim al-A'war and Habbah bin Juwayn are both weak narrators.
وأخرج ابن أبي شيبة 10/ 89 من طريق عبد الرحمن بن سعيد الهمداني، عن مسعود رجل من آل أبي الدرداء: أنَّ عليًا لما رجم شراحة، جعل الناسُ يلعنونها، فقال: أيها الناس، لا تلعنوها، فإنه من أقيم عليه عصا حدٍّ، فهو كفّارته، جزاء الدَّين بالدين. ومسعود لم نعرفه.
Reference / Source: Ibn Abi Shaybah (10/89) narrated it through the route of Abd al-Rahman bin Sa'id al-Hamdani, from Mas'ud (a man of the family of Abu al-Darda'), that when Ali (may Allah be pleased with him) stoned Shurahah, the people began cursing her, and he said: "O people, do not curse her, for whoever has the rod of a hadd carried out on him, it is his expiation, like a debt repaid with a debt."
Technical note / Defect ('illah): We could not identify the narrator "Mas'ud".
وأخرج عبد الرزاق بإثر (13353)، والبيهقي 8/ 329 من طريق سفيان الثوري، عن سماك 8/ 329 ابن حرب، عن عبد الرحمن بن أبي ليلى، عن رجل من أهل هُذيل وعِداده في قريش، قال: كنت مع علي حين رجم شراحة، فقلت: لقد ماتت هذه على شرِّ حالها، فضربني بقضيب - أو بسوط - كان في يده حتى أوجعني، فقلت: قد أوجعتني، قال: وإن أوجعتك، قال: فقال: إنها لن تسأل عن ذنبها هذا أبدًا كالدين يُقضى. ولم يذكر البيهقي في روايته الرجل الهذلي.
Reference / Source: Abd al-Razzaq narrated it after (13353), and al-Bayhaqi (8/329), through the route of Sufyan al-Thawri, from Simak bin Harb, from Abd al-Rahman bin Abi Layla, from a man of the tribe of Hudhayl (who was counted among Quraysh).
Details of the narration: He says: I was with Ali (may Allah be pleased with him) when he stoned Shurahah, and I said: "This woman has died in the worst of states." At that he struck me with a stick or whip that was in his hand until it hurt me. I said: You have hurt me! He said: "Even if I have hurt you (it does not matter)." Then he said: "She will never be questioned about this sin of hers; it is like a debt that has been repaid." Al-Bayhaqi did not mention the Hudhali man in his narration.
وأخرج الطحاوي في "معاني الآثار" 3/ 140 من طريق أبي الأحوص سلام بن سليم، عن سماك بن حرب، عن عبد الرحمن بن أبي ليلى قال: جاءت امرأة من همدان يقال لها: شراحة، إلى علي، فقالت: إني زنيت، فردها حتى شهدت على نفسها أربع شهادات، فأمر بها فجلدت ثم أمر بها فرجمت. لم يذكر الوساطة بين ابن أبي ليلى وعلي.
Reference / Source: Al-Tahawi narrated it in "Ma'ani al-Athar" (3/140) through the route of Abu al-Ahwas Sallam bin Sulaym, from Simak bin Harb, from Abd al-Rahman bin Abi Layla.
Details of the narration: He said: A woman of Hamdan called Shurahah came to Ali (may Allah be pleased with him) (the incident follows: she confessed four times, then the order was given to flog her and stone her).
Technical note / Defect ('illah): Here the intermediary between Ibn Abi Layla and Ali (may Allah be pleased with him) is not mentioned.
وانظر ما بعده. قال الحازمي في "الاعتبار" ص 201: اختلف أهل العلم في هذا الباب، فذهبت طائفة إلى أنَّ المحصن الزاني يجلد مئة ثم يرجم، عملًا بحديث عُبادة (الذي أخرجه مسلم برقم 1690) ورأوه محكمًا، وممّن قال به أحمد بن حنبل وإسحاق بن راهويه وداود بن علي الظاهري وأبو بكر بن المنذر من أصحاب الشافعي.

General principle: One group says that the married adulterer is first given a hundred lashes and then stoned; they act on the hadith of Ubadah (may Allah be pleased with him) (Sahih Muslim: 1690) and consider it unabrogated (muhkam). This is the view of Ahmad bin Hanbal, Ishaq bin Rahawayh, Dawud bin Ali al-Zahiri and, among the Shafi'is, Abu Bakr bin al-Mundhir.
وخالفهم في ذلك أكثر أهل العلم، وقالوا: بل يرجم ولا يجلد، روي ذلك عن عمر بن الخطاب ﵁، وإليه ذهب إبراهيم النخعي والزهري ومالك وأهل المدينة والأوزاعي وأهل الشام وسفيان وأبو حنيفة وأهل الكوفة والشافعي وأصحابه ما عدا ابن المنذر، ورأوا حديث عبادة منسوخًا، وتمسكوا في ذلك بأحاديث تدل على النسخ. ثم أورد حديث رجم ماعز بن مالك، وحديث العَسيف الذي زنى بامرأة مستخدَمه. وانظر "المغني" لابن قدامة 12/ 313.
General principle: Most of the people of knowledge opposed them and said: "He is only stoned, not flogged." This position is narrated from Umar bin al-Khattab (may Allah be pleased with him), and it was held by Ibrahim al-Nakha'i, al-Zuhri, Malik, the people of Madinah, al-Awza'i, the people of Syria, Sufyan, Abu Hanifah, the people of Kufah, and Imam al-Shafi'i and his companions (except Ibn al-Mundhir). They consider the hadith of Ubadah (may Allah be pleased with him) abrogated and argue from hadiths that indicate abrogation (such as the incident of Ma'iz bin Malik and the incident of the hired labourer).
