حدَّثَناه أبو العباس محمد بن يعقوب، أخبرنا محمد بن عبد الله بن عبد الحَكَم، أخبرنا ابن وهب، أخبرني مالك بن أنس، عن يعقوب بن زيد (1) بن طَلْحة التَّيمي، عن أبيه: أنَّ امرأةً أتت رسولَ الله ﷺ، فقالت: إنها زَنَت، وهي حُبْلى، فقال لها رسول الله ﷺ: "اذهَبِي حتى تَضَعي"، فذهبت فلما وَضَعَت جاءته، فقال: "اذْهَبي حتى تُرضِعِيه"، فلما أرضَعَته جاءته، فقال: "اذهَبي حتى تستودِعيه"، فلما استودعَتْه جاءته، فأقام عليها الحدَّ (2). هذا حديث صحيح على شرط الشيخين إن كان زيد (3) بن طلحة التَّيْمي أدركَ النبيَّ ﷺ، فإن مالك بن أنس الحَكَمُ في حديث المدنيِّين. Ya'qub bin Zayd bin Talhah al-Taymi narrates from his father that a woman came to the Messenger of Allah (peace and blessings be upon him) and said that she was pregnant and had committed adultery. The Messenger of Allah (peace and blessings be upon him) said to her: "Go until you give birth (to the child)." She went away, and when the child was born, she came again. He (peace and blessings be upon him) said: "Go and suckle him." When she had suckled him, she came again. He (peace and blessings be upon him) said: "Go until you entrust him to someone (until a guardian is found)." When she had entrusted him to someone and came again, he (peace and blessings be upon him) established the prescribed punishment (hadd) upon her.
This hadith is sahih on the condition of the two Shaykhs (Bukhari and Muslim), provided that Zayd bin Talhah al-Taymi met the Prophet (peace and blessings be upon him), because in the hadiths of the people of Madinah, the word of Imam Malik bin Anas is final.

Note / Corruption: In manuscripts (Z) and (K) this name had been corrupted into "Yazid"; the correct text is recorded according to manuscript (M).
(2) صحيح لغيره، وهذا إسناد رجاله ثقات لكنه مرسل، زيد بن طلحة تابعي لم يدرك النبي ﷺ كما قال الحافظ ابن حجر في "إتحاف المهرة" (24216).
Grading: It is "sahih li-ghayrihi"; although the narrators of this chain are trustworthy, it is "mursal", because Zayd bin Talhah is a Successor who did not live in the time of the Prophet (peace and blessings be upon him), as al-Hafiz Ibn Hajar stated explicitly in "Ithaf al-Maharah" (24216). وقد اختلف فيه على مالك:
Technical note: In this narration there is disagreement from Imam Malik (regarding the chain): فرواه عبد الله بن وهب والقعنبي وابن القاسم وابن بكير - كما نقل ابن عبد البر في "التمهيد" 24/ 127 - أربعتهم عن مالك، بهذا الإسناد. Details of the narration: This hadith was narrated by Abdullah bin Wahb, al-Qa'nabi, Ibn al-Qasim and Ibn Bukayr, as Ibn Abd al-Barr reported in "al-Tamhid" (24/127); these four narrators narrate it from Imam Malik with this same chain. ورواه محمد بن الحسن في "موطئه" (696)، ويحيى بن يحيى الليثي في "الموطأ" 2/ 821 - 822، وأبو مصعب الزهري في "موطئه" (1759)، ثلاثتهم عن مالك، عن يعقوب بن زيد بن طلحة، عن أبيه زيد بن طلحة، عن عبد الله بن أبي مليكة فزادوا في الإسناد عبدَ الله بن أبي مليكة، وهو جدُّ زيد بن طلحة. وصوّب ابن عبد البر رواية ابن وهب ومن معه. قلنا: وعلى كلتا الحالتين هو مرسل؛ لأنَّ عبد الله بن أبي مليكة تابعي أيضًا. Reference / Source: Muhammad bin al-Hasan narrated it in his "Muwatta'" (696), Yahya bin Yahya al-Laythi in "al-Muwatta'" (2/821-822), and Abu Mus'ab al-Zuhri in his "Muwatta'" (1759). Details of the narration: These three narrated it from Imam Malik, from Ya'qub bin Zayd bin Talhah, from his father Zayd bin Talhah, from Abdullah bin Abi Mulaykah. They added "Abdullah bin Abi Mulaykah" to the chain, who is the grandfather of Zayd bin Talhah. Technical note / Defect ('illah): Ibn Abd al-Barr held the narration of Ibn Wahb and those with him to be correct. We (the editors) say that in both cases this hadith is "mursal", because Abdullah bin Abi Mulaykah is also a Successor. ويشهد له الحديثان قبله. Corroborating chains and supporting reports: The two hadiths that passed before this one support (as shawahid) this narration.
(3) تحرَّف في النسخ الخطية إلى: يزيد. Note / Clarification: In the handwritten manuscripts this name has been corrupted and written as "Yazid".
