Mustadrak al-Hakim — Hadith 8278

أخبرنا محمد بن يعقوب الشَّيباني، حدثنا يحيى بن محمد بن يحيى الذُّهْلي، حدثنا مُسدَّد، حدثنا يزيد بن زُرَيع، حدثنا داود بن أبي هند، عن أبي نَضْرة، عن أبي سعيد الخُدْري: أنَّ ماعز بن مالك أتى النبيَّ ﷺ فقال: إني أصبتُ فاحشةً، فردَّده النبيُّ ﷺ مرارًا، فسأل قومَه: "أبِهِ بأسٌ؟ " فقالوا: ما به بأسٌ إلَّا أنه أتى أمرًا لا يَرَى أن يُخرِجَه منه إلَّا أن يُقامَ الحدُّ عليه، قال: فأمَرَنا فانطلقنا به إلى بَقِيع الغَرقَد، قال: فلم نَحفِرْ له ولم نُوثِقه، فرَمَيناه بخَزَفٍ وعِظام وجَنْدَل، فاستكَنَّ، فسعى فاشتَدَدْنا خلفَه، فأتى الحَرَّة فانتَصَب لنا، فرَمَيناه بجَلاميدِها حتى سَكَتَ، فقام النبي ﷺ من العَشِيّ خطيبًا، فحمد الله وأثنى عليه، فقال: "أمّا بعدُ، فما بالُ أقوام إذا غَزَونا فتَخلَّفَ أحدُهم في عِيالِنا له نَبيبٌ كنَبيبِ التَّيس، أمَا إني عَليَّ لا أُوتَى بأَحدٍ (1) فعلَ ذلك إلَّا نَكَّلتُ به"، قال: ثم نزل، فلم يَسُبَّه ولم يَستغفِرْ له (2).
هذا حديث صحيح على شرط مسلم، ولم يُخرجاه.

It is narrated from Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) that Ma'iz bin Malik came to the Prophet (peace and blessings be upon him) and said: I have committed an indecent act. The Prophet (peace and blessings be upon him) turned him away several times, and asked his people: "Is there anything wrong with him (a mental disorder)?" They said: There is nothing wrong with him, except that he has committed a deed from which he sees no way of deliverance except by having the prescribed punishment (hadd) imposed on him. Abu Sa'id said: He (peace and blessings be upon him) ordered us, so we took him to Baqi' al-Gharqad. We neither dug a pit for him nor tied him up. We began pelting him with potsherds, bones and stones. When he was hurt, he ran, and we ran after him until he stood facing us at al-Harrah. Then we pelted him with large rocks until he fell silent (died). Then in the evening the Prophet (peace and blessings be upon him) delivered a sermon; he praised and extolled Allah and said: "Amma ba'd (to proceed): What is the matter with people that, when we go out on a military expedition, one of them stays behind among our families making noises like a billy goat (seeking immorality)? Know that whoever such is brought to me, I will give him an exemplary punishment." The narrator said: Then he (peace and blessings be upon him) came down from the pulpit. He (peace and blessings be upon him) neither reviled Ma'iz nor sought forgiveness for him.
This hadith is sahih on the condition of Imam Muslim, but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) زاد في (ز): منهم، وضبب عليها.
Note / Manuscripts: In manuscript (Z) the word "minhum" (of them) is added, and a "dabbah" (a mark indicating that it is doubtful or superfluous) has been placed over it.

(2) إسناده صحيح أبو نضرة: هو المنذر بن مالك بن قِطعة العبدي.
Grading: Its chain is sahih. Technical note / Defect ('illah): Abu Nadrah is "al-Mundhir bin Malik bin Qit'ah al-Abdi".
وأخرجه أبو داود (4431)، والنسائي (7160)، وابن حبان (4438) من طرق عن يزيد بن زريع، بهذا الإسناد.
Reference / Source: Abu Dawud (4431), al-Nasa'i (7160) and Ibn Hibban (4438) narrated it through various routes from Yazid bin Zuray', with this same chain.
وأخرجه أحمد 17/ (10988) و 18 / (11589)، ومسلم ((1694)، وأبو داود (4431)، والنسائي (7161) من طرق عن داود بن أبي هند، به.

الجندل: الحجارة والحَرّة: بقعة بالمدينة ذات حجارة سود. والجلاميد الحجارة الكبار، واحدها جلمود وجلمد. والنبيب: صوت التيس عند السِّفاد.
Linguistic note: "al-Jandal" means stones. "al-Harrah" is a place in Madinah with black stones. "al-Jalamid" means large stones; its singular is julmud and julmad. "al-Nabib" is the sound a he-goat (tays) makes at the time of mating.
