Mustadrak al-Hakim — Hadith 8277

حدثنا أبو النَّضر الفقيه وأبو الحسن أحمد بن محمد العَنَزي، قالا: حدثنا معاذ بن نَجْدة القرشي، حدثنا خلَّاد بن يحيى، حدثنا بَشير بن المُهاجر، عن عبد الله (1) بن بُرَيدة، عن أبيه، قال: كنتُ جالسًا عند رسولِ الله ﷺ فجاء الأسلميُّ ماعزُ بنُ مالك، فقال: يا رسولَ الله، إنِّي زَنَيتُ، وإني أُريد أن تُطهِّرَني، فقال له النبيُّ ﷺ: "ارجع"، فرجعَ حتى أتاه الثالثةَ، فأتى رسولَ الله ﷺ قومُه فسألَهم عنه، فأحسَنُوا عليه الثَّناءَ، فقال: "كيف عَقلُه، هل به "جُنونٌ؟ " قالوا: لا والله، وأحسَنُوا عليه الثناءَ في عقلِه ودينهِ، وأتاه الرابعةَ فسألهم عنه، فقالوا له مثلَ ذلك، فأمَرَهم فَحَفَرُوا له حفرةً إلى صَدرِه ثم رَجَموه (2).
هذا حديث صحيح الإسناد على شرط مسلم، فقد احتجَّ ببَشير بن مُهاجر.

It is narrated from Sayyiduna Buraydah (may Allah be pleased with him) that he said: I was sitting with the Messenger of Allah (peace and blessings be upon him) when Ma'iz bin Malik of the Aslam tribe came and said: O Messenger of Allah, I have committed adultery, and I want you to purify me (by imposing the punishment). The Prophet (peace and blessings be upon him) said: "Go back." He went back and came again three times. Then the Messenger of Allah (peace and blessings be upon him) sent a man to his people and asked about him. They praised him. He (peace and blessings be upon him) asked: "How is his intellect? Is he not insane?" They said: By Allah, no, and they praised his intellect and his religion. When he came the fourth time, he (peace and blessings be upon him) asked his people again, and they gave the same answer. Then he (peace and blessings be upon him) gave the order, and a pit was dug for him up to his chest, and then he was stoned.
This hadith is sahih on the condition of Imam Muslim, because he used Bashir bin Muhajir as evidence.

(1) تحرّف في (ز) و (ب) إلى: عبيد الله، والمثبت من (ك) و (م).
Note / Corruption: In manuscripts (Z) and (B) the name has been corrupted into "Ubaydullah"; the correct text is recorded according to manuscripts (K) and (M).

(2) حديث صحيح دون قصة الحفر لماعز، فقد تفرَّد بها بشير بن المهاجر، وهو ليّن الحديث، وقد وهم في ذكر الحفر، ونفاه غيره كما في حديث أبي سعيد الخدري التالي، وهو أصحُّ. وقد روى له مسلم هذا الحديث الواحد متابعة وليس احتجاجًا.
Grading: This hadith is sahih, except for the "story of digging a pit" for Ma'iz (may Allah be pleased with him). Technical note / Defect ('illah): Bashir bin al-Muhajir is alone (the only narrator) in mentioning the digging of the pit, and he is "layyin al-hadith" (a soft, weak narrator); he was mistaken in mentioning the pit. Other narrators negated the digging of a pit, as in the next hadith of Abu Sa'id al-Khudri (may Allah be pleased with him), which is more sound. Important point: Imam Muslim narrated this single hadith of Bashir bin al-Muhajir only as "corroboration" (mutaba'ah), not as "proof" (ihtijaj, primary evidence).
وأخرجه أحمد 38/ (22942)، ومسلم (1695) (23)، والنسائي (7129) و (7164) من طرق عن بشير بن المهاجر، بهذا الإسناد. وزاد مسلمٌ في آخر الحديث قصةَ الغامدية التي طلبت من النبي ﷺ أن يطهرها من الزنى، وهذه القصة سترد عند المصنف وحدها بالإسناد نفسه برقم (8282).
Reference / Source: Ahmad (38/22942), Muslim (1695/23) and al-Nasa'i (7129, 7164) narrated it through various routes from Bashir bin al-Muhajir, with this same chain. Details of the narration: Muslim additionally related, at the end of the hadith, the story of the Ghamidi woman who asked the Prophet (peace and blessings be upon him) to purify her from adultery. This story will come separately with the author (al-Hakim) with the same chain at no. (8282).
وأخرجه بنحوه مسلم (1695) (22)، والنسائي (7125) من طريق سليمان بن بريدة، عن أبيه.
Reference / Source: A similar narration was transmitted by Muslim (1695/22) and al-Nasa'i (7125) through the route of Sulayman bin Buraydah, from his father (Buraydah, may Allah be pleased with him).
