Mustadrak al-Hakim — Hadith 8238

أخبرنا أبو عبد الله محمد بن عبد الله الزاهد الأصبهاني، حدثنا أحمد بن مهدي بن رُستُم الأصبهاني، حدثنا أبو عامر العَقَدي، حدثنا قُرَّة بن خالد، عن عبد الملك بن عُمَير، قال حدثنا عامر بن شدَّاد، قال: كنتُ أبطَنَ (1) شيءٍ بالكذَّاب، أَدخلُ عليه بسيفي، فدخلتُ عليه ذاتَ يومٍ فقال: جئتَني واللهِ وقد قامَ جبريلُ عن هذا الكرسيَّ، فأهوَيتُ إلى قائمِ سيفي، فقلتُ: ما أنتظر أن أمشي بين رأسِه وجسدِه حتى ذكرتُ حديثًا حدَّثَناه عمرُو بن الحَمِق قال: سمعتُ رسول الله ﷺ يقول: "إذا اطمأنَّ الرجلُ إلى الرجل، ثم قَتَلَه بعدَما اطمأنَّ إليه، نصب له يومَ القيامة لِواءُ غَدْرٍ" (1).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Amir bin Shaddad: I was well acquainted with the secrets of the Liar (al-Kadhdhab). I used to go to him with my sword. One day I went to him and he said: By Allah! You have come to me just as Jibril has risen from this chair. I reached for the hilt of my sword and thought of cutting off his head, but then I remembered the hadith that Sayyiduna Amr bin al-Hamiq (may Allah be pleased with him) narrated to us, saying: I heard the Messenger of Allah (peace and blessings be upon him) say: "When a man trusts another (gives him safety), and then that one kills him, a banner of treachery will be raised for him on the Day of Resurrection."
This hadith has an authentic chain (sahih al-isnad), but the two Shaykhs (Bukhari and Muslim) did not record it.

(1) في النسخ الخطية: انظر، وما أثبتناه من مصادر التخريج. ومعناه أنه كان من بِطانة الكذاب، ويعني به المختار بن أبي عبيد الثقفي.
Correction and analysis: In the manuscripts the word was "unzur", and what we have established is taken from the source works. Its meaning is that he was among the close confidants of the liar, and by the liar is meant "al-Mukhtar bin Abi Ubayd al-Thaqafi".

(1) إسناده صحيح. لكن اختلف على عبد الملك بن عمير في اسم شيخه، فروى عنه قرة وشعبة أنه عامر بن شداد، وروى عنه الأكثر أنه رِفاعة بن شداد، وهو الصواب، وقد تابعه غير واحد فسمَّوه رفاعةَ على الصواب.
Grading of the chain: Its chain is sahih.
Technical note: However, there is disagreement among those narrating from Abd al-Malik bin Umayr over the name of his shaykh: Qurrah and Shu'bah narrated from him that the shaykh's name is "Amir bin Shaddad", while most narrators narrated that the name is "Rifa'ah bin Shaddad", and this (the name Rifa'ah) is correct. Several narrators corroborated Abd al-Malik and gave the correct name "Rifa'ah".
وأخرجه البزار (2307) عن محمد بن المثنى، عن أبي عامر العقدي - وقرن به وهب بن جرير - بهذا الإسناد.
Reference / Source: Al-Bazzar (2307) narrated it from Muhammad bin al-Muthanna, from Abu Amir al-Aqadi (and he paired Wahb bin Jarir with him), with this same chain.
وأخرجه النسائي (8688) من طريق خالد بن الحارث، عن قرة بن خالد، عن عبد الملك، عن عامر بن شداد، به.
Reference / Source: Al-Nasa'i (8688) narrated it via Khalid bin al-Harith, from Qurrah bin Khalid, from Abd al-Malik, from "Amir bin Shaddad".
قال البزار: أخطأ فيه قرة لأنه قال: عن عبد الملك بن عمير عن عامر بن شداد، والصواب ما قاله أبو عوانة، وقد تابع أبا عوانة على مثل روايته غيرُ واحد. قلنا: لم ينفرد قرة بن خالد في تسميته بعامر بن شداد، فقد تابعه شعبة فيما قاله أبو نعيم في "معرفة الصحابة" 4/ 2206، والمزي في ترجمة رفاعة من "التهذيب" 9/ 206، ولعل الخطأ وقع من عبد الملك بن عمير نفسه، فقد ذكر بعض أهل العلم أنه تغيّر وأنَّ له بعض أوهام.
Criticism and praise (jarh wa ta'dil): Imam al-Bazzar says: "Qurrah made a mistake in it, because he said 'from Amir bin Shaddad', whereas the correct version is what Abu Awanah said (i.e., Rifa'ah), and several narrators corroborated Abu Awanah."
Research note: We say: Qurrah bin Khalid is not alone in naming him "Amir bin Shaddad"; rather Shu'bah corroborated him, as mentioned by Abu Nu'aym in "Ma'rifat al-Sahabah" (4/2206) and by al-Mizzi in the biography of Rifa'ah in "al-Tahdhib" (9/206). Perhaps the mistake came from Abd al-Malik bin Umayr himself, for some scholars have mentioned that he deteriorated (at the end of his life) and had some errors.
على أنه قد روي عن قرة عن عبد الملك عن رفاعة على الصواب، أخرجه كذلك أبو داود
Rejoinder: Nevertheless, a narration is also transmitted from Qurrah, through Abd al-Malik, with "Rifa'ah" (the correct name). Abu Dawud narrated it thus (continued)
الطيالسيُّ (1382) - ومن طريقه أبو نعيم في "معرفة الصحابة" (5041)، والبيهقي 9/ 142 - وعثمانُ بن عمر بن فارس عند ابن مردويه في "مجالس من أماليه" (34)، كلاهما عن قرة.
Reference / Source: (continuation) al-Tayalisi (1382), and through him Abu Nu'aym in "Ma'rifat al-Sahabah" (5041) and al-Bayhaqi (9/142); and Uthman bin Umar bin Faris narrated it with Ibn Mardawayh in "Majalis min Amalihi" (34); both of them (al-Tayalisi and Uthman) narrate it from Qurrah (and give the correct name "Rifa'ah").
وأخرجه أحمد 36 / (21946) و (21948) و 39/ (23701)، والنسائي (8687) من طريق حماد بن سلمة، وابن ماجه (2688)، والنسائي (8686) من طريق أبي عوانة الوضاح اليشكري، كلاهما عن عبد الملك بن عمير، عن رفاعة بن شداد به فسمياه رفاعة على الصواب.
Reference / Source: Ahmad (36/21946, 21948 and 39/23701) and al-Nasa'i (8687) narrated it via Hammad bin Salamah, and Ibn Majah (2688) and al-Nasa'i (8686) via Abu Awanah al-Waddah al-Yashkuri; both of them from Abd al-Malik bin Umayr, from "Rifa'ah bin Shaddad", so both of them gave the correct name "Rifa'ah".
وأخرجه أحمد 36/ (21947) و 39 / (23702)، وابن حبان (5982) وغيرُهما من طريق إسماعيل السُّدي، والطبراني في "الأوسط" (7781) من طريق كثير بن إسماعيل النوّاء، وفي "الصغير" (38) من طريق بيان بن بشر، ثلاثتهم عن رفاعة بن شداد، به. بلفظ: "أيما مؤمن أمّن مؤمنًا على دمه فقتله، فأنا من القاتل بريء"، وزاد فيه ابن حبان والطبراني في روايتيه: "وإن كان المقتول كافرًا".
Reference / Source: Ahmad (36/21947 and 39/23702), Ibn Hibban (5982) and others narrated it via Isma'il al-Suddi, al-Tabarani in "al-Awsat" (7781) via Kathir bin Isma'il al-Nawwa', and in "al-Saghir" (38) via Bayan bin Bishr; all three of them narrated it from Rifa'ah bin Shaddad, with this same chain.
Text: Its wording is: "Any believer who grants a believer safety for his life and then kills him, I am free of the killer." Ibn Hibban and al-Tabarani, in his two narrations, added: "even if the slain man was a disbeliever."
وأخرجه ابن الأعرابي في "معجمه" (612) - ومن طريقه القضاعي في "مسند الشهاب" (164).
Reference / Source: Ibn al-A'rabi narrated it in his "Mu'jam" (612), and through him al-Quda'i in "Musnad al-Shihab" (164).
من طريق معاوية بن صالح، عن عاصم بن رفاعة، عن عمرو بن الحمِق، بلفظ: "الإيمان قيَّد الفَتك، من أمَّن رجلًا على دمه فقتله، فأنا بريء من القاتل، وإن كان المقتول كافرًا". فسمّى الروي عن ابن الحمق عاصمًا. وفي إسناده رشدين بن سعد وهو ضعيف، قال البخاري "التاريخ الكبير" 322/ 3: روي رشدين عن معاوية بن صالح عن عاصم بن رفاعة البجلي عن عمرو عن النبي ﷺ، ولا يصحُّ فيه عاصم.
Sources and chain: Via Mu'awiyah bin Salih, from Asim bin Rifa'ah, from Amr bin al-Hamiq, with the wording: "Faith has shackled al-fatk (treacherous killing); whoever grants a man safety for his life and then kills him, I am free of the killer, even if the slain man was a disbeliever." (In this chain) the narrator from Ibn al-Hamiq is named "Asim".
Technical note: Its chain includes "Rishdin bin Sa'd", who is weak. Imam al-Bukhari said in "al-Tarikh al-Kabir" (3/322): "Rishdin narrated from Mu'awiyah bin Salih, from Asim bin Rifa'ah al-Bajali, from Amr, from the Prophet (peace and blessings be upon him), and (the mention of) Asim in it is not sound."
وأخرجه أحمد 45/ (27207)، وابن ماجه (2689) وغيرُهما من طريق عبد الله بن ميسرة أبي ليلى، عن أبي عكاشة الهمداني قال: قال رفاعة البجلي: دخلت على المختار بن أبي عبيد قصرَه، فسمعته يقول: ما قام جبريل إلَّا من عندي قبل، قال: فهممت أن أضرب عنقه، فذكرت حديثًا حدثناه سليمان بن صُرَد عن النب ﷺ، أنّ النبي ﷺ كان يقول: "إذا أمّنك الرجل على دمه فلا تقتله"، قال: وكان قد أمّنني على دمه فكرهت. دمه فجعله من مسند سليمان بن صرد، وإسناده ضعيف لضعف عبد الله بن ميسرة، وجهالة أبي عكاشة الهمداني.
Sources and details: Ahmad (45/27207), Ibn Majah (2689) and others narrated it via Abd Allah bin Maysarah Abu Layla, from Abu Ukkashah al-Hamdani, who said: Rifa'ah al-Bajali said: I entered upon al-Mukhtar bin Abi Ubayd in his palace, and I heard him say: "Jibril has only just now risen from my company." Rifa'ah said: I resolved to strike off his head, then I remembered a hadith that Sulayman bin Surad narrated to us from the Prophet (peace and blessings be upon him), that the Prophet (peace and blessings be upon him) used to say: "When a man entrusts you with his life, do not kill him." He said: Since he had entrusted me with his life, I disliked (killing him).
Technical note: The narrator made it part of the Musnad of Sulayman bin Surad, but its chain is weak, because Abd Allah bin Maysarah is weak and Abu Ukkashah al-Hamdani is majhul (unknown).
