Mustadrak al-Hakim — Hadith 8237

أخبرنا أبو العباس محمد بن أحمد المحبوبي، حدثنا سعيد بن مسعود، حدثنا عبيد الله بن موسى، أخبرنا إسرائيل، عن أبي إسحاق، عن عمرو بن غالب، قال: دخل عمّارٌ على عائشة يومَ الجَمَل، فقال: السلامُ عليك يا أُمَّاه، قالت: لستُ لك بأمٍّ، قال: بلى إنك أُمِّي وإن كرهتِ قالت: مَن ذا الذي أسمع صوتَه معك؟ قال: الأشتَرُ، قالت: يا أشتَرُ، أنت الذي أردتَ أن تقتل ابنَ أختي؟ قال: لقد حَرَصتُ على قتلِه وحَرَصَ على قتلي، فلم نَقدِرْ، فقالت: أمَا والله لو قتلتَه ما أفلحتَ، فأما أنت يا عمارُ، فقد علمتَ أنَّ رسول الله ﷺ قال: "لا يُقتَلُ إلَّا أحدُ ثلاثةٍ: رجلٌ قتلَ رجلًا فقُتِلَ به، ورجلٌ زَنَى بعدما أَحْصَنَ، ورجلٌ ارتَدَّ عن الإسلام" (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه.

It is narrated from Amr bin Ghalib that Sayyiduna Ammar (may Allah be pleased with him) came to Sayyidah Aishah (may Allah be pleased with her) on the day of the Battle of the Camel and said: Peace be upon you, O my mother! She said: I am not your mother. Ammar said: Rather, you are my mother, even if you dislike it. Sayyidah Aishah asked: Whose voice is this that I hear with you? He said: Al-Ashtar's. The Lady said: O Ashtar! Are you the one who wanted to kill my sister's son? Al-Ashtar said: I tried my utmost to kill him and he tried to kill me, but we were not able to. The Lady said: By Allah! Had you killed him, you would never have succeeded. Then she said: O Ammar! You know well that the Messenger of Allah (peace and blessings be upon him) said: "No one is to be killed except one of three: a man who killed someone and is killed in retaliation for him, a married person who commits adultery, and one who turns away from Islam."
This hadith has an authentic chain (sahih al-isnad), but the two Shaykhs (Bukhari and Muslim) did not record it.

(2) حديث صحيح، وهذا إسناد فيه عمرو بن غالب تفرَّد بالرواية عنه أبو إسحاق - وهو عمرو بن عبد الله السبيعي - ونقل الحافظ ابن حجر في "التهذيب" عن أبي عمرو الصدفي أنَّ النسائي وثقه، وصحَّح له الترمذي حديثًا في فضائل عائشة، وقال ابن البرقي كوفي مجهول، احتُملت روايته لرواية أبي إسحاق عنه إسرائيل: هو ابن يونس السبيعي. وأخرجه أحمد 42/ (25700) عن وكيع، عن إسرائيل، بهذا الإسناد.
Grading: A sahih hadith.
Technical note: This chain contains "Amr bin Ghalib", from whom only Abu Ishaq, who is Amr bin Abd Allah al-Sabi'i, narrates. Al-Hafiz Ibn Hajar quoted in "al-Tahdhib" from Abu Amr al-Sadafi that al-Nasa'i declared him reliable, and al-Tirmidhi graded as sahih a hadith of his on the virtues of Aishah (may Allah be pleased with her). Ibn al-Barqi said: He is a Kufan and majhul (unknown); his narration was tolerated because Abu Ishaq narrated from him. Isra'il (in the chain) is Ibn Yunus al-Sabi'i.
Reference / Source: Ahmad (42/25700) narrated it from Waki', from Isra'il, with this same chain.
وأخرجه أحمد 40/ (24304) من طريق يونس بن أبي إسحاق، وأحمد 42/ (25477) و (25700) و (25794)، والنسائي (3466) من طريق سفيان الثوري، كلاهما عن أبي إسحاق السبيعي، به.
Reference / Source: Ahmad (40/24304) narrated it via Yunus bin Abi Ishaq, and Ahmad (42/25477, 25700, 25794) and al-Nasa'i (3466) via Sufyan al-Thawri; both of them (Yunus and Sufyan) narrated it from Abu Ishaq al-Sabi'i.
وأخرجه النسائي (3467) عن هلال بن العلاء، عن الحسين بن عياش، عن زهير بن معاوية، أبي إسحاق، عن عمرو بن غالب قال: قالت عائشة: يا عمار، أما إنك تعلم أنه لا يحلُّ دم امرئ إلَّا ثلاثة: نفس بنفس، أو رجل زنى بعدما أحصن. موقوفًا.
Reference / Source: Al-Nasa'i (3467) narrated it from Hilal bin al-Ala', from al-Husayn bin Ayyash, from Zuhayr bin Mu'awiyah, from Abu Ishaq, from Amr bin Ghalib, who said: Aishah (may Allah be pleased with her) said: "O Ammar, surely you know that the blood of a man is not lawful except in three cases: a life for a life, or a man who commits adultery after being married." This narration is "mawquf".
ورواية زهير عن أبي إسحاق السبيعي بعد تغيّر الأخير كما قال الإمام أحمد وغيره، ورواية الثوري عنه قديمة قبل تغيره، وقال الدارقطني في "العلل" (3734): الصواب: قول الثوري ومن تابعه.
Technical note / Defect ('illah): Zuhayr's narration from Abu Ishaq al-Sabi'i is from after the latter's (Abu Ishaq's) deterioration (of memory), as Imam Ahmad and others said, whereas Sufyan al-Thawri's narration from him is early, from before his deterioration. Al-Daraqutni said in "al-Ilal" (3734): "The correct version is that of al-Thawri and those who corroborated him (i.e., their narration is preferred)."
وأخرجه أحمد بإثر (25475)، ومسلم بإثر (1676) (26)، والنسائي بإثر (3465)، وابن حبان بإثر (4407) من طريق الأسود بن يزيد عن عائشة.
Reference / Source: Ahmad (after no. 25475), Muslim (after no. 1676, 26), al-Nasa'i (after no. 3465) and Ibn Hibban (after no. 4407) narrated it via al-Aswad bin Yazid, from Aishah.
وسيأتي برقم (8239) و (8294) من طريق عبيد بن عمير عن عائشة مرفوعًا.
Note: This hadith will come later at numbers (8239) and (8294) via Ubayd bin Umayr, from Aishah, as "marfu'".
ومن طريق مسروق عن عائشة مرة مرفوعًا برقم (8241)، ومرة موقوفًا برقم (8240).
Note: And via Masruq, from Aishah, it will come once as "marfu'" (no. 8241) and once as "mawquf" (no. 8240).

قوله: "أَحْصَنَ" أي: تزوّج.
Linguistic note: The word "ahsana" means: he got married.
