Mustadrak al-Hakim — Hadith 8227

أخبرنا عبد الرحمن بن حَمْدان الجَلَّاب بهَمَذان، حدثنا أبو حاتم الرازي، أخبرنا [محمد بن يحيى الذُّهْلي، حدثنا] (1) أبو غسّان محمد بن يحيى بن علي بن عبد الحميد الكِنَاني، حدثنا عبد العزيز بن محمد الدَّرَاوَرْدي، عن عبيد الله بن عمر، عن نافع عن ابن عمر أنَّ رسول الله ﷺ قال: "لا يزالُ المرء في فُسْحةٍ من دِينِه ما لم يُصب دمًا حرامًا" (2).
هذا حديث صحيح الإسناد على شرط الشيخين، ولم يخرجاه، وإنما يُعَدُّ في أفراد محمد بن يحيى الذُّهلي (1) عن محمد بن يحيى الكِنَاني. وله إسناد آخر صحيح:

It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "A person remains in latitude and ease with regard to his religion as long as he does not unlawfully shed anyone's blood."
This hadith is sahih (authentic) on the condition of the two Shaykhs (Bukhari and Muslim), but they did not record it. It is counted among the solitary narrations of Muhammad bin Yahya al-Dhuhli from Muhammad bin Yahya al-Kinani, while it also has another authentic chain.

Note: The text between the square brackets had dropped out of the manuscripts here, and the author's words after it require that it be present.
Technical note: The one who narrates from Muhammad al-Kinani is "Muhammad al-Dhuhli", not Abu Hatim, as stated in the books of narrator biographies.

(2) حديث صحيح، وهذا إسناد جيد من أجل عبد العزيز الدراوردي.
Grading: A sahih hadith.
Technical note: This chain is "jayyid" (good) on account of Abd al-Aziz al-Darawardi.
وأخرجه البيهقي 8/ 21 من طريق أحمد بن محمد بن الحسن الحافظ، عن محمد بن يحيى الذهلي، بهذا الإسناد.
Reference / Source: Al-Bayhaqi (8/21) narrated it via Ahmad bin Muhammad bin al-Hasan al-Hafiz, from Muhammad bin Yahya al-Dhuhli, with this same chain.
وأخرجه الطبراني في "الأوسط" (1401) من طريق أحمد بن شبويه المروزي، عن أبي غسان محمد بن يحيى الكناني، به.
Reference / Source: Al-Tabarani narrated it in "al-Awsat" (1401) via Ahmad bin Shabbawayh al-Marwazi, from Abu Ghassan Muhammad bin Yahya al-Kinani, with this same chain.

قوله: "في فسحة من دينه" قال ابن العربي فيما نقله عنه الحافظ ابن حجر في "فتح الباري" 22/ 8: الفُسحة في الدين: سَعَة الأعمال الصالحة، حتى إذا جاء القتل ضاقت لأنها لا تفي بوزره، والفسحة في الذنب قَبول الغفران بالتوبة، حتى إذا جاء القتل ارتفع القبول. وحاصله أنه فسَّره على رأي ابن عمر في عدم قَبُول توبة القاتل.
Meanings of the hadith: Regarding the words "fi fushah min dinihi" (he remains in latitude within his religion), Ibn al-Arabi said (as al-Hafiz Ibn Hajar quoted from him in "Fath al-Bari" 22/8): "Latitude (fushah) in religion means the breadth of righteous deeds, until, when killing comes, it becomes narrow, because the deeds cannot make up for its burden. And latitude in sin means the acceptance of forgiveness through repentance, until, when killing comes, acceptance is lifted."
Summary: The upshot is that he interpreted it according to the view of Ibn Umar (may Allah be pleased with them both) that the repentance of a killer is not accepted.

Corroboration: It has passed in the sources that Ahmad bin Shabbawayh al-Marwazi corroborated al-Dhuhli in this narration.
