حدثنا أبو العبّاس محمد بن يعقوب، أخبرنا أحمد بن عبد الجبار، حدثنا أبو معاوية، حدثنا بشَّار (2) بن كِدَام السُّلَمي، عن محمد بن زيد، عن ابن عمر قال: قال رسول الله ﷺ: "الحَلِفُ حِنثٌ أو نَدَمٌ" (3). قال الحاكم: قد كنتُ أحسبُ برهةً من دَهْري أن بشارًا هذا أخو مِسعَر فلم أَقف عليه (4)، وهذا الكلام صحيح من قول ابن عمر. It is narrated from Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings be upon him) said: "Swearing an oath is either a sin (of breaking one's word) or (a cause of) regret and remorse."
Imam al-Hakim says that for a long period of my life I assumed that this narrator Bashshar was the brother of Mis'ar, but I could not confirm it; and this statement is authentic as a saying of Sayyiduna Ibn Umar (may Allah be pleased with them both).

(3) إسناده ضعيف، بشّار بن كدام ليس له حديث مرفوع غير هذا، وقد ضعفه أبو زرعة الرازي، كما أنه خالف الثقةَ عاصمَ بن محمد بن زيد فرفعه بينما رواه عاصم موقوفًا، لكن اختلفوا عليه فروي عنه أنه من قول عبد الله بن عمر كما في الرواية التالية عند المصنِّف، ولم نقف عليها عند غيره، وروي عنه أنه من قول عمر بن الخطاب، وهذا هو الأشهر والأكثر، والله تعالى أعلم. Grading: Its chain is "da'if". Technical note / Defect ('illah): Bashshar bin Kidam has no marfu' narration other than this one, and Abu Zur'ah al-Razi declared him weak. Moreover, he contradicted the thiqah narrator 'Asim bin Muhammad bin Zayd by reporting it as "marfu'", whereas 'Asim narrates it as "mawquf". There is also disagreement over 'Asim's narration: according to one report it is a statement of 'Abd Allah bin 'Umar (as in Imam al-Hakim's next narration, which we did not find anywhere else), while according to the better-known and more numerous reports it is a statement of 'Umar bin al-Khattab (may Allah be pleased with him). And Allah knows best. وأخرجه ابن ماجه (2103) عن علي بن محمد الطنافسي، وابن حبان (4356) من طريق علي بن الحسين الواسطي، كلاهما عن أبي معاوية محمد بن خازم بهذا الإسناد. Reference / Source: This narration was recorded by Imam Ibn Majah (2103) via 'Ali bin Muhammad al-Tanafisi, and Imam Ibn Hibban (4356) narrated it through 'Ali bin al-Husayn al-Wasiti. Both of them (al-Tanafisi and al-Wasiti) narrate it with this same chain from Abu Mu'awiyah Muhammad bin Khazim al-Darir.
