Mustadrak al-Hakim — Hadith 7997

حدثني محمد بن صالح بن هانئ، حدثنا أبو سعيد الحسن بن عبد الصمد القُهُنْدُزِي، حدثنا يحيى بن يحيى وعمرو بن زُرَارة، قالا: حدثنا سعيد بن مَسْلَمة (1) حدثنا إسماعيل بن أُميَّة، عن عمر بن عطاء بن أبي الخُوَار، عن عُبيد بن جُريج، عن الحارث بن البَرْصاءِ قال: سمعتُ رسول الله ﷺ في الحجِّ بين الجَمْرتين وهو يقول: "مَنِ اقتَطَعَ مالَ أخيه المسلمِ بيمينٍ فاجرةٍ، فليَتبوَّأ مَقْعَدَه من النار، ليُبلِّغْ شاهدُكم غائبَكم"، مرتين أو ثلاثًا (2).
هذا حديث صحيح الإسناد، ولم يُخرجاه بهذه السِّياقة.

Sayyiduna al-Harith bin al-Barsa' (may Allah be pleased with him) narrates: During the Hajj, between the Jamarat, I heard the Messenger of Allah (peace and blessings be upon him) say: "Whoever usurps the wealth of his Muslim brother by means of a false oath, let him take his seat in Hell. Let whoever of you is present convey this to those who are absent." He (peace and blessings be upon him) repeated this two or three times.
This hadith has a sahih (authentic) chain, but the two Shaykhs (Bukhari and Muslim) did not record it with this wording.

Note / Clarification: In the manuscripts there was a distortion here and the name was mistakenly written as "Salamah".

(2) حديث صحيح، وهذا إسناد ضعيف من أجل سعيد بن مسلمة، وقد توبع. والحارث بن البرصاء سبق تعريف الحاكم له برقم (6777).
Grading: The hadith is sahih.
Technical note / Defect ('illah): This chain is weak on account of Sa'id bin Maslamah, but he has been corroborated.
Important point: Al-Hakim has already introduced the narrator al-Harith bin al-Barsa' under hadith no. (6777).
وأخرجه ابن أبي عاصم في "الآحاد والمثاني" (908)، وابن أبي خيثمة في السفر الثاني من التاريخ 1/ 162، وأبو نعيم في معرفة الصحابة (2076) من طرق عن سعيد بن مسلمة، بهذا الإسناد.
Reference / Source: Ibn Abi Asim narrated it in "al-Ahad wa al-Mathani" (908), Ibn Abi Khaythamah in his "Tarikh" (1/ 162) and Abu Nu'aym in "Ma'rifat al-Sahabah" (2076) by various routes of Sa'id bin Maslamah with this same chain.
وأخرجه البخاري في "التاريخ الكبير" 2/ 258، والطحاوي في "مشكل الآثار" (446) و (5932)، وابن حبان (5165)، والطبراني في "الكبير" (3330)، وأبو نعيم (2077)، وتمام في "الفوائد" (1339) من طريق روح بن القاسم، عن إسماعيل بن أمية، به. وقال ابن حبان: تفرَّد به عمر بن عبد الوهاب!
Reference / Source: Imam al-Bukhari narrated it in "al-Tarikh al-Kabir" (2/ 258), Imam al-Tahawi in "Mushkil al-Athar" (446 and 5932), Ibn Hibban (5165), al-Tabarani in "al-Kabir" (3330), Abu Nu'aym (2077) and Tammam in "al-Fawa'id" (1339), via Rawh bin al-Qasim from Isma'il bin Umayyah.
Technical note / Defect ('illah): Imam Ibn Hibban says that Umar bin Abd al-Wahhab is alone in relating this narration!
وأخرجه الفاكهي في "أخبار مكة" (2637)، وابن قانع في "معجم الصحابة" 1/ 168 من طريق روح بن القاسم، عن إسماعيل بن أمية به. لكن ليس فيه عبيد بن جريج.
Reference / Source: Al-Fakihi narrated it in "Akhbar Makkah" (2637) and Ibn Qani' in "Mu'jam al-Sahabah" (1/ 168) by the route of Rawh bin al-Qasim from Isma'il bin Umayyah.
Technical note / Defect ('illah): In this route there is no mention of Ubayd bin Jurayj.
وخالف سفيانُ بن عيينة في إسناده، فرواه عن إسماعيل بن أمية عن ابن أبي الخوار عن الحارث، لم يذكر فيه عبيد بن جريج، أخرجه من طريقه الحميدي في "مسنده" (583)، وأبو القاسم البغوي في "معجم الصحابة" (456)، والطحاوي (447) و (5933)، وابن قانع 1/ 168، والطبراني (3331). وأضاف محقق مسند الحميدي الشيخ حبيب الرحمن الأعظمي - وتبعه الأستاذ حسين سليم - في الإسناد عبيد بن جريج من عنده! ووقع في الموضع الأول من "المشكل" ذكر عبيد بن جريج في الإسناد، وهو خطأ، فقد نصَّ الطحاوي على عدم ذكره في الموضع الثاني.
Technical note / Defect ('illah): Imam Sufyan bin Uyaynah differed in its chain and narrated it via Isma'il bin Umayyah from Ibn Abi al-Khuwar from al-Harith, without mentioning Ubayd bin Jurayj.
Reference / Source: Al-Humaydi (583), al-Baghawi (456), al-Tahawi (447, 5933), Ibn Qani' (1/ 168) and al-Tabarani (3331) narrated it.
Important point: The editor of Musnad al-Humaydi, Shaykh Habib al-Rahman al-A'zami, and following him Husayn Salim, added the name "Ubayd bin Jurayj" to its chain on their own, which on investigation is wrong. Imam al-Tahawi stated explicitly in the second place of "Mushkil al-Athar" that Ubayd bin Jurayj is not mentioned there.
وتابع سليمانُ بن سليم سفيانَ على عدم ذكر عبيد بن جريج عند الطبراني (3332). فإن صحَّ سماع عمر بن عطاء من الحارث، وإلا كان منقطعًا، ولا يضرُّ فقد عُرفت الواسطة بينهما.
Corroborating chains and supporting reports: Sulayman bin Sulaym also corroborated Sufyan bin Uyaynah and did not mention Ubayd bin Jurayj, in the narration of al-Tabarani (3332).
Technical note / Defect ('illah): If Umar bin Ata's hearing from al-Harith is established, well and good; otherwise this chain is "munqati'" (broken), but that does no great harm, because the intermediary between them has become known.
